August 4, 2003 To Whom it May Concern, I am writing on behalf of The Children's TherAplay Foundation (TherAplay). TherAplay is anot-for-profit outpatient rehabilitation clinic that incorporates the movement of horses into physical and occupational therapy sessions for disabled children. I am writing today with a concern about the safety of our TherAplay horses. TherAplay is located at 9919 Towne Road, which is a very busy road. Because there is no gate at the entrance to TherAplay or at the entrance to the adjacent neighborhood, Treesdale, if one of our horses were to get out of a pasture or stall, there would be nothing to deter them from going out onto Towne Road. This would be a dangerous situation for both our horses and for those traveling on Towne Road. A gate at both the entrance to TherAplay and into Treesdale would effectively deter any horses who might get loose on our property from ending up on busy Towne Road before they are caught. The private street statement on the plat needs to read, Lucky LLC and any and all successors and assigns hereby waive all rights to petition the Hamilton County Highway Department, the Hamilton County Board of Commissioners, or Hamilton County, or the successor unit of government to be responsible for the maintenance of the Ingress-egress easement, or to have the easement considered a public road necessitating maintenance by any unit of govemment. 4. All references to right of way on the interior street need to be removed and replaced with notes that the area where the street lies is an ingress-egress easement. 5. The covenants and restrictions for the subdivision must cover the Homeowner Association's responsibility for maintenance of the streets. 6. The plans received by the District need to be revised to show labeled sewer profiles and- manhole, lateral and bedding details which are in accordance with District specifications. The plans also need show the most recent version of the District specifications. Revised plans need to be submitted. An IDEM permit willbe required and the submittal packet should be sent to the District for review. The District will then submit the project to IDEM for permit approval. A preconstruction meeting will need to be held before the construction of the proposed sanitary sewers. Building permits should NOT be issued unless the District has issued connection permits. Coxhall Park & Garden (Development Plan) The plans received by the District need to be revised to show the water and storm infrastructure in the sewer profiles. The manhole and bedding details need to be revised in accordance with District specifications. The influent hub shown in the grinder pump station is not the same size as the pipe shown in the sanitary plan and profiles. Revised plans need to be submitted. An IDEM permit will be required and the submittal packet should be sent to the District for review. The District will then submit the project to IDEM forpermit approval. A preconstruction meeting will need to be held before the construction of the proposed sanitary sewers. Building permits should NOT be issued unless the District has issued connection permits. Hearthview Residential PUD (Rezone) The plans received by the District need to be revised to show individual laterals for every lot. The manhole and bedding details need to be revised in accordance with District specifications. The most recent version of the District specifications need to be included on the plans. Revised plans need to be submitted. An IDEM permit will be required and the submittal packet should be sent to the District for review. The District will then submit the project to IDEM for permit approval. A preconstruction meeting will need to be held before the construction of the proposed sanitary sewers. Building permits should NOT be issued unless the District has issued connection permits. College Park Baptist Church (Development Plan Amendment) The plans received by the District need to be revised to show the lateral and bedding details in accordance with District specifications. The plans also need show the most recent version of the District specifications for lateral connections. Note #2 on sheet C103 needs to be modified to state that Clay Township Regional Waste District specifications apply for all sanitary sewers. Revised plans need to be submitted. Building permits should NOT be issued unless the District has issued connection permits. Ritz Charles (Amended Development Plan) The plans received by the District need to be revised to show the lateral and bedding details in accordance with District specifications. As of the date of dais letter, the City of Carmel/Clay Township has not received nor denied any replat or subdivision waiver application regarding the stone wall or pillars at the entrance. However, we ulticipate filing by the end of April, 2003, on behalf of the neighborhood, the necessary documentation with the City of Cazmel, Department of Commrmity Services, a~sd Hamilton County to allow the stone wall and pillars to remain at their current locations.
