Docket No. ORIIfi11017 %: North Meridian Heiehts Rezone The applicant seeks approval to rezone approximately 21.9 acres from the S-2/Residence to the B-6/Business zoning classification, within the US 31 Overlay. The site is located at 131" St. and Catherine Dr, east of US 31. Filed by Steve Ihvdin of Baker & Daniels; LLC for Browning Associates, LLC. This area is currently a platted residential area consisting of 47 lots. The intent of this rezone is to extend the B-6 zoning east. This site does partially lie within the US 31 Overlay Zone. The Comprehensive Plan Landuse Plan Map does show this area as a high to medium regional-commercial employment area within the US 31 Corridor. Note: if approved to become zoned B-6/Business, site plan and architectural design (DP/ADCs) approval by the Plan Commission will be required for any proposed development. At the August 19 meetine: The Commission asked [he petitioner [o bring, to the Sept 2 committee meeting, a graphic of the INDOT proposed improvements along US 31 and a graphic to show which lots have consented to the buyout. Outstanding Staff comments/concerns: 1) As part of approval of [he rezone, the Plan Commission may require that you dedicate road right-of- way and install a 10-wide path along 131" Street, as prescribed by the 20-Year Thoroughfare Plan and the Alternative Transportation Plan. 2) A plat vacation, or a replat of the subdivision info multiple large lots, will eventually be required. 3) The current recorded subdivision restrictions, included with the current plat, will need to be amended with a plat amendment, plat vacation, or private agreement between the property owners. 4) Provide the status of the consents obtained from al] of the property owners. 5) The Department highly recommends tha['you try to meet with the property owners that abut this subdivision, to gain their comments/concerns. 6) Please address connectivity through this site if/when connected to the west and to the easdnortheast. 7) Dept of Engineering Comments: no comments on the rezone. 8) Dept of Forestry Comments: The city forester would like a commitment on tree preservation with a possible tree inventory of the current existing trees. Ile does not want what happened to the site just west of this, where only a Development Plan was approved, and most, if no[ all, of the trees are removed. The Department of Community Services recommends the Committee forwards this item to the September 16 Plan Commission meeting with a favorable recommendation, only after all comments/concerns are addressed.
