ORDINANCE NO. Z-412-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
TO ESTABLISH CHAPTER 20I: P-2/PARK & RECREATION DISTRICT TO
ACCOMMODATE PARKS, HISTORIC SITES, AND LIVING HISTORY MUSEUMS
WHEREAS, the Common Council finds that it is reasonable and necessary to promote and
accommodate the orderly growth and development of the City of Carmel and Clay Township by
establishing the P-2/Park & Recreation District to preserve and promote the quality of life for new
and existing residents; and
WHEREAS, the Common Council finds that it is reasonable and necessary to protect the
public health, safety, comfort, convenience and general welfare of the citizens of the City of Carmel
and Clay Township by establishing development standards under which Parks, Historic Sites and
Living History Museums shall operate within the City and Township; and
WHEREAS, the Cannel/Clay Plan Commission has duly approved and reconmaended to the
Common Council the following amendments to the Zoning Ordinance for the City and Township
that will update the Ordinance, pursuant to the Advisory Planning Law of the State of Indiana as well
as the 2020 Vision Comprehensive Plan, such plan having been duly approved by resolution of the
Common Council on September 24, 1996, and remaining in effect as the official Comprehensive
Plan of the City of Carmel and Clay Township;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows: that pursuant to IC 36-7-4-600 et seq. and IC 36-7-4-700 et seq., it adopts this
Ordinance as an amendment to the Cannel/Clay Zoning Ordinance, No. Z-289, as amended (the
"Zoning Ordinance"), and amends and adds certain provisions to the ordinance as follows:
Section I:
a. Adopt new Chapter 201: P-2/Park & Recreation District of the Zoning Ordinance to read as
follows:
CHAPTER 201: P-2/PARK & RECREATION DISTRICT
201.00 P-2/Park and Recreation District.
201.01 Purpose and Intent.
201.02 Pein'fitted Uses.
201.03 Special Uses.
201.04 Special Exceptions.
201.05 Area Requirements.

201.00 P-2/Park and Recreation District.
201.01 Purpose and Intent. The purpose of this district is to provide for historic, museum, and park and recreational
uses and to protect the environment within this district by providing only for those uses and for compatible, less
intensive urban land uses.
201.02 Permitted Uses:
Historic site
Living History Museum
Park
201.03 Special Uses:
There are no Special Uses in the P-2/Park & Recreation District.
201.04 Special Exceptions:
There are no Special Exceptions in the P~2/Park and Recreation District.

Area Reqttirements:
A. Minimum area:
1. All uses: three (3) acres
B. Miffmaum front yard: forty (40) feet
C. Minimum side yard: twenty (20) feet
D. NFmimum aggregate of side yard: fifty (50) feet
E. Minimum rear yard: fifteen (15) feet
F. Minimum lot width: two hundred (200) feet
G. Maximum lot coverage: thirty-five percent (35%) of lot
H. Minknm ground floor area: one thousand (1,000) square feet.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.

The CarmeVClay Advisory Plan Commission offers you the following report on the application (Docket No. 104-03
OA) to the Commission to adopt Chapter 201: P-2/Park and Recreatton District Zone.
The Carmel/Clay Plan Commission's recommendation on the petition is FAVORABLE.
At its special meeting of July 8, 2003, the Carmel/Clay Plan Commission voted twelve (12) in Favor, one (1)
Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-412-03 with a
Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4-
607(e)(3), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the
Commission. Ninety days from the date of this Certification is Tuesday, October 7, 2003.

Notice is hereby given to the taxpayers of the City of Carmel and Clay Township,
Hamilton County, Indiana, that the proper legal officers of the City of Carmel will meet at their
regular meeting place, Council Chambers, Carmel City Hall, One Civic Square, Cannel, IN
46032, at 7:00 p.m. on Monday, the 4th day of August, 2003, to consider the following:
Petition to establish Chapter 201: P-2/Park & Recreation District, an amendment to the
Carmel/Clay Zoning Ordinance, pursuant to the application filed with the City of Carmel
Department of Community Services and identified as Cannel/Clay Advisory Plan Commission
Docket No. 104-03 OA.
Taxpayers appearing at the meeting shall have the right to be heard.
