This item will appear on your July 7th agenda. 1. Docket No. 95-03 OA (03060012); I-1/Industrial District Amendment Amendments to the I-1/Industrial District of the Carmel/Clay Zoning Ordinance. The petitioner seeks to add Development Plan and ADLS provisions to the I- 1/Industrial District of the Zoning Ordinance. Filed by the Department of Community Services. Docket No. 95-03 OA (03060012); I-1/Industrial District Amendment Amendments to the I-1/Industrial District of the CarmeUClay Zoning Ordinance. The petitioner seeks to add Development Plan and ADLS provisions to the I- 1/Industrial District of the Zoning Ordinance. Filed by the Department of Community Services. The Department of Community Services, as petitioner, requests that the City Council adopt a request to amend the I-1/Industrial Section of the CarmeUClay Land Use Regulations (see attached Ordinance). Approval of the amendment would add Development Plan and Architectural Design, Lighting, Landscaping & Signage (DP/ADCs) review by the Plan Commission for development in the I-1 zone. No other changes are proposed. The CazmeUClay Plan Commission forwazds this ordinance to the Common Council with a (13-1) Favorable Recommendation (see attached certification). The Department recommends that this item be forwarded to the Annexation and Land Use Committee for further discussion. However, if there are not issues warranting further discussion by the committee the Department would recommend suspension of the rules and approval of the Ordinance upon conclusion of discussion of the request. Z-411-03 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA An Ordinance to establish Development Plan and Architectural Design, Exterior Lighting, Landscaping &Signage control within the I-1/Industrial District. WHEREAS, the Common Council of the City of Carmel finds that it is reasonable and necessary to the establishment and maintenance of an economically sound and stable industrial zone and the protection of the public health, safety and welfare of the citizens of Carmel and Clay Township to amend the Zoning Code of the City of Carmel and Clay Township; and WHEREAS, the lack of aesthetic controls in the I-1/Industrial District poses an imminent and constant threat to the protection of the health, safety and general welfare of the people, the natural beauty and aesthetic values, and enhancement of the environment of the City of Carmel and Clay Township; and WHEREAS, IC 36-7-4-601(d)(3) authorizes the legislative body to designate zoning districts in areas having special development problems or needs for compatibility in which a plan commission shall approve or disapprove development plans under the 1400 series of IC 36-7-4; and ensure that a development plan so approved is consistent with the comprehensive plan and the development requirements specified in the zoning ordinance; and WHEREAS, IC 36-7-4-1401.5 authorizes the legislative body to designate zoning districts in which a development plan is required as a legislative act; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section I: a. Adopt Section 20A.00.02: Plan Commission Approval to read: 20A.00.02 Plan Commission Approval. A. Development Plan. The Commission shall review the Development Plan (DP) of any proposed use of any Lot or parcel of ground within the I-1 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Development Plan (DP) shall not be materially or substantially changed or altered without the prior approval of the Commission. The Development Plan shall address [he comprehensive arrangement of land uses, buildings, landscape areas, road and parking areas in accordance with harmonious and aesthetic principles of the ADLS. B. Architectural Design, Exterior Lighting, Landscaping and Signagg. To insure the compatibility of the proposed use with adjoining areas, [he Commission shall review the Architectural Desigq Exterior Lighting, Landscaping and Signage (ADLS) application of any proposed use of any Lot or parcel of ground within the I-1 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or substantially changed or altered without the prior approval of the Commission. \~ Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III: This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. The CarmeUClay Plan Commission's recommendation on the petition of the Departnent of Community Services is FAVORABLE. At its special meeting of July 1, 2003, the CarmeUClay Plan Commission voted thirteen (13) in Favor, one (1) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. 7x411-03 with a Favorable Recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4- 607(e)(3), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission. Ninety days from the date of this Certification is Tuesday, September 30, 2003.
