Planning2oning Department review comments: Page 1 of 2 1) Since there are residential land uses to the north of this site, please address the concern about possible noise/humming from the equipment on/in the equipment building. This is from the Prefab builder: No equipment inside the building will be audible from outside the building. Other equipment include: a. Fire protection siren -This will only occur when there is a fire within the building b. Generator - They will run once a week for testing (day and time adjustable) and whenever power is lost at the site. Given that the generators will be low and behind awall/shrubs sound will likely project towards the parking area and not the apartments. c. Wall mounted HVAC -Our proposal calls for five units total. Four will be located on the parking lot side and one on the apartment side. Two or three units will be running at any given time and individually they do not produce any more noise than a traditional residential unit. 2) Please change the wall lights on the building to 90-degree cut offs with a flat lenses, so that it does not shine on the residential uses to the north. We are removing the light on the north side of the building and putting the other 3 on motion sensors. Do we still need the 90-degree cut offs? I will get you the updated elevations once I receive them from the Prefab builder. 3) Please provide the building materials and colors. Or, provide a color photo example. Also, feel free to bring samples to the meeting. We will have color photo of the building and a sample of the building material and colors at the meeting. 4) Make sure all mechanical equipment is screened from view, with a wooden fence and/or landscaping. The mechanicals on the north and west side of the building will be screened by the retaining wall, existing trees and landscaping per the landscape plan. Will that be adequate? We will need to screen the HVAC units on the south with a fence (I am looking into it right now). 5) Can you paint the mechanical equipment (wall mount HVACs) to match the building color? The manufacture's color of the wall mount HVAC is a beige color similar to the wall color. We can provide color samples at the meeting. Will that work? T also reviewed chapters 20, 26, and 28 of the Carmel Zoning Ordinance. The Site was developed prior to the zoning requirement of DP/ADCs approval of development on I- 1/Industrial zoned parcels. An ordinance amendment in 2004 now requires DP/ADCs submittal/approval for development on I-1 zoned parcels. This requirement also includes complying with the bufferyard provisions. Situations that address landscape/bufferyard standards for I-1 zoned sites developed prior to the DP/ADCs requirements, but now need building additions, or the like are unique. Requiring full compliance with the landscaping/bufferyard standards today places excessive burden on the Petitioner because landscaping was not required prior to the I-1 ordinance amendment. Applying bufferyard requirement compliance to I-1 zoned property acts as a penalty for those wanting/needing to grow their operations. The size of most previously developed I-1 parcels was not patterned to include additional yard area for buffering, especially when I-1 uses are comfortably located next to other I-1 uses. It would seem reasonable to base our review comments upon the issues and needs of each project, depending on the unique circumstances of each project; minor additional landscaping and/or buffering will need to be requested. As a side note, our Department will present a petition to the Plan Commission to amend Zoning Ordinance Ch. 28 (non-conforming uses & exemptions} or Ch. 26 (bufferyard provisions) to address situations like this. In conclusion, you do not need a Development Standards Variance from the buffering requirements; however we will provide a positive recommendation to the Special Studies Committee for ADLS Amendment approval with the condition of planting at least 6 large trees from the list of approved trees for the City of Carmel, as suggested by the City Forester.
