A subsequent site investigation revealed the complaint to be valid, as the sign is located within the existing right-of-way of 136'h Street. This represents a violation of Carmel Zoning Ordinance for a lack of required sign permits and of §25.07.01-04(i), which states: 25.07.01-04(i) Prohibited Signs Signs which are located upon, over, or in any street or highway right-of-way except for official highway signs. Please bring the property into compliance with the Carmel Land Use Regulations by March 31, 2009. Failure to resolve the violations will result in further enforcement action by the City of Carmel, up to and including removal by the City's Street Department.
