31. Docket No. 08080020 ADLS: Hotel Indigo Still waiting on some resolution with the Browning camp on the
tree removal that took place by the Overall Developer's contractor. They have not been very speedy in offering a
solution to this or admitting to any wrong doing. They removed 29 trees over 6" in diameter they had preserved, with
about 17 more not in a savable areas, and with 56 still standing that might remain. Out of 102 large trees...

Thank you for your responses, Christine.
I would like clarification on a few of the commitments:
1. Do we need to provide a shared parking agreement prior to the CPC hearing, or
commit to provide one at a certain time, i.e. prior to applying for permits? Committing
to providing an agreement prior to applying for permits should be fine, seeing as how
you're the first building going into the site.
2. Do we need to commit to have the final tree preservation plan approved by the
City Forester by 3/16? We understand that it needs to be done, but, given that Browning
is responsible for it, the deadline may be difficult to meet. It would be ideal to have
it by then, but as long as it's moving forward, if it's not fully approved by then, the
approval could be subject to the Forester's final approval of the plans prior to applying
for permits.
3. Do we need to have the commitments filed with DOGS by March 10? I recall Rick
being adamant on this point. Maybe it wasn't part of the motion, but we don't want
to do anything else to incur his wrath!
I'd have at least a final draft in place by then, if not the full commitments, keeping in
mind that there might be additional commitments that come out of the hearing with the full
Commission.

I have several questions concerning this petition and the Carmel Plan Commission meeting
on March 17:
1. Please confirm that the meeting begins at 6:00 p.m.
Yes, the hearing starts at 6.
2. Am I correct in assuming that we should provide 15 new information packets by
noon this Friday? If so, should it contain all of the information in the packet from the
January 20, 2009, CPC
meeting plus the information in the packet for the March 3 SSC
meeting, or only the information from the March 3 SSC meeting packet?
You will need 15 packets, and they should contain the information from both hearings, in
case the members of the Commission who are in the other Committee have any questions.
3. Where do I find a commitment form? The one that I found on
the Carmel website is for commitment amendments, and that doesn't
seem applicable.
Just the standard format for commitments is fine - you don't need a specific form.
4. I'm unsure of additional commitments that were imposed by
the SSC last night. Can you either provide me with a draft of the
minutes from last night's meeting (I know that Ramona probably hasn't done them yet!) or
with a list of commitments.
I believe the commitments were that written commitments would be provided prior to the
full Commission hearing; that either a shared parking agreement or acknowledgement of a
forthcoming variance would be provided; that the final CD's be approved by the Dept of
Engineering; that the final tree preservation plan be approved by the City Forester; and
that the signs will return to the Committee after they've been through the variance
process.
5. Please confirm that Rick Ripma wants these commitments filed with DOCS on or
before March 10, 2009.

The City received your updated construction plans on December 9, 2008. We offer the following
comments:
GF,NERAL INFORMATION
]. These conunents represent the Department of Engineering's first review of the construction
plans for this project.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted,particularly if any such changes are considered "new' or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review al] drainage plans anddrainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off-site easements necessary [o install utilities to serve the development are secured.

6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Perini[ is required prior fo commencing any earth

9. If it will be necessary to relocate existing utilities, the costs for such relocation shall be borne

Commission andlor the Board of Zoning Appeals (if applicable) and completion of
review by the Technical Advisory Committee. All written requests to be placed on the

approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable).
I8. Water Availability and Sanitary Sewer approval from the Board will be required. This is an
EUU approval based upon the proposed use of the site. Reference hems ?*33 to f?37 below
for additional details/explanations.
I9. Commercial Curb Cut Approval -Not required since access is to a private drive.
20. Temporary Construction Entrance Approval -Not Required.
21. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.j within dedicated right of way or dedicated
easementsaequires the execution of a Consent to Encroach Agreement behveen the Owner
and the City of Carmel. Such agreements are executed by the Board of Public N'orks and
Safety. The City Engineer may approve irrigation system agreements.

22. Secondary Plat approval if applicable. All performance-guarantees must be posted prior to

- Thoroughfare Plan requirements. Dedication documents are available upon request.

BONDING REQUIREMENTS
25. Upon initial review it appears perfornrance guarantees shall be provided for the following:
a. Erosion and Sediment Control and Stonn Water~Qualiry. Please contact Amanda Foley,

estimates/performance guarantee requirements for these items.

27. Uputi completion anti release of individual Performance Guatatitees, a three-year
Maintenance Guarantee will be required (see Street Sign ebmments.above). The
Maintenance Guarantee amount is based upon IS% of the Performance amount for Streets
and Curbs and 10°.~ of the Perfonrance amount for all other improvements.
28. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of
Credit.

RIGHT OF WAY PERMIT AND BONDING

nwnber of seats if a restaurant is to be included in the developmentand square footage of
water surface area if a swimming pool will be part of the development. Please provide this
office with this information in order to calculate Connection Fees.
36. If an entryway or overall site irrigation system is planned for this development, additional
Water Connection Fees will be assessed based upon the size and usage of the system and
upon the recommendations ofthe Director of Cannel Utilities.
37. These fees are required to be paid prior to final approval of construction plans by
Engineering end prior to issuance of building permits by Buildine Codes Services. Please
confirm these fees and calculations with Carmel Utilities.

standards.
59. All swales un site must have sub-surface pipe installed. Pipe to conformao requirements of
Storm Water Technical Standards Manual and shall be double wall. HI-Q pipe.
60. Please omit Sheets LS-1 from construction sets to be submitted for review by this
department. TheDepartment of Engineering cannot approve landscape or li:hting plans.
61, Please label all planting areas on site plan to avoid confusion of areas and sidewalk locations.
62, It is the opinion of this Department that silt fence is not needed on the northern side of the

I have looked over the revised plans submitted by CDG Consulting and they are in line with
the master plans. I can't grant "official" approval yet because the overall master plans
in not finally approved yet (by us and Carmel Engineering). This project also has a few
issues to work out with Crossroad Engineers, but nothing major. The also still have the
J.R. Collins #2 Regulated Drain Easement across this parcel that will not be vacated until
the hearing for the reconstruction of the drain that is part of the master plan. I have
no issues that would affect the Plan Commission approval, and hopefully everything will be
worked out before they request a Pre-submittal meeting for the building permit. If not,
the existence of the regulated drain easement will be a delay at that time. If you have
any questions, please let me know.

Revised, up-to-date plans have been delivered to Engineering, CrossRoads Engineers, and Scott Brewer as of
Tues 12/9/08. None of the revisions were, in my opinion, significant enough to warrant revised exhibits for the
subcommittee members. Please let me know if you feel differently.
I have asked my lighting designer to re-work the lighting plan so the pole+base height is less than 25', we may
ask for a waiver as well based on the original design, but thought it prudent to have both design as options. No

Is there anything else that needs addressed at this time? I want to make sure we don't spring anything on the

I think this is what the plan commission committee is looking for... a place where patrons of the hotel can sit outside at the
patio area and relax and enjoy the water body with native plantings (and eventually wildlife). It will be a peaceful, natural
environment that serves as a nice buffer to the highway.
Right now, our file does not show a plan as you describe below. Is there any way that you or Jay can convey that to the
subcommittee graphically, perhaps with a rendering or an image that shows what this might look like from an aerial or 3D
view? The next committee meeting is January 6.

Angie,
I would like to point out that the detention/ water quality systems on the Opus parcel functions differently than the
Browning thus there are differences in the design elements.
Also on December 4th and 5th Cripe met with Amanda and Gary and discussed all of the cities outstanding issues in
respect to the infrastructure project, which included some comments in regards to the basins.
The current plans provides a natural looking basin with the respect that all the plantings in the bottom or water quality
treatment area are native plantings which shall bloom and fill in the area thus appearing like a preserved vegetated area.
The engineering plans have been resubmitted to the City for Final approval and this project shall go in front of the board of
Public works on January 7th thus no plan changes are proposed at this time.
Feel free to give me a call or email the group to discuss. I have also included Browning and the Hotel Representatives on
this email for clarification.

On 11/19/08 during a phone conversation, you said to me that

2. Bufferyard and tree preservation details would be coordinated through Chris Wiseman of Weihe,
3. environmental designs in the parking lot strip would be coordinated through Amanda Foley of City Engineering.
So far I have not received word of any of this happening
On your current landscape plan you also need graphic planting details, tree preservation details for existing trees, and any
planting notes. Also on your plant schedule you need a column which details the number of plants of each species. The
standards for plant sizes are 2.5 inches for shade trees, 1.5 inches (in caliper) for ornamental trees, and 8 feet in height
for evergreens, please change the table accordingly.

Please keep us on the agenda for Dec. 2nd. We are incorporating a last minute revision to the building - a 10' by
45' warming kitchen was added to the west side of the building, requiring shifting the building to the east a bit,
reworking the parking lot, etc. Additionally, we are incorporating comments received from Scott Brewer into
the LS plan.
The plans revisions will be completed today (LS plans to be completed over the weekend per LA) and will have
hard copies delivered Monday am.
1 understand that the overall infrstructure plans went through TAC this past Tues. (per Scott) and I am under the
understanding (from the Browning people) that they are on track for approval.

1. This item will be on the September 17 agenda of the Technical Advisory Committee (TAC). The petitioner must
submit plans and review materials to all TAC members directly by August 22. (Failure to submit plans and review
materials to TAC members by this time will result in the tabling of this petition to the October TAC meeting, and
subsequently the November Plan Commission meeting. For a list of current TAC members go to:

33. Please revise the lighting plan; parking lot lighting shall not exceed 0.3 foot candles at the property
lines.
34. Provide the parking pole light design details/specs.
35. Provide the wall sconce and security lighting design details and specs.

37. Please consider using LEED or'green' building practices, such as a white roof or solar panels.

40. The percent of the gross floor area used for a Full Service Hotel Use will probably not be regulated by
Section 23B.05.03. (I am currently trying to verify this.)

42. Show/label the 15-ft side yard setbacks.
43. Per Chapter 236.08.05, please provide your Ground Floor Areasfor the 1st and 2nd Floors. The 1st
floor maximum is 40% and the 2nd floor max is 35%.
44. Please provide your lot cover percentage; the lot cover required is less than or equal to 65°/ ,and this
includes pavement and building footprint.
45. In your parking summary, you must add 1 parking space per employee of the largest shift, in addition
to the meeting space and hotel room parking space requirements.
46. BZA: variance approval will be required for the reduction of required parking spaces. Or, just show that
you will have a recorded parking agreement for shared parking with an adjacent property, or possibly provide
underground parking or a parking structure.
