Dear Scott
I have reviewed your comments and the project history with Chris since I have been involved with the project
since its beginning.
I have attached as -001.tif the landscape plan which was submitted and approved as part of the DP submittal
package. As I recall, at your request, Cripe field located the trees located within the buffer yards based on the
caliper size. Browning committed to preserving those trees as delineated in this plan.
As you will see, the proposed storm water detention/water quality treatment basins have always been located
within the 90' Build To Line with an overlap into the outermost 30' Greenbelt. This was approved as part of the
DP.
To address your concerns regarding the tree preservation areas being located in the drainage easement,
attached are exhibits which modify the drainage easement. The proposed sketches allow for planting areas as
well as the tree preservation. This should alleviate the issue of trees being located in an easement whose
primary use is drainage. The exhibits show the areas with dimensions and proposed contours. Since we are only
planning to construct phase 1 improvements at this time, we thought it would be prudent to send the design
data for the future development area to the northeast which also shows the future basin with the tree
preservation areas.
.~(We will also prepare a Tree Preservation Plan which will show construction fen_ci~n as the protective barrier
rather tha the si nce as you in icated~ince roll caning is very aware o thf e tree preservation issue, I am sure
tha the clearing and cons ruc ion activities will be emphatically addressed with the contractor prior to the
commencement of work. So as to avoid any confusion, the trees being preserved will be shown on all affected
sheets of the construction plan set.
Since we are in this overlap situation relative to the landscape area and the drainage easement, we are also
asking Gary Duncan to approve this proposed scenario since we believe it should be acceptable to both
agencies concerned.
An important item to also note is that the water quality basins will be planted and seeded with native plant
material. Once these areas are fully established, the affected area will be greener than the typical detention
ponds constructed along the majority of the developed portions of the Meridian Street Corridor.
Please review the attached documents and contact Chris or me with any questions.
We believe these revisions should be acceptable and ask for your approval so that we can continue in the
permit process.

Looking through my files for this submittal I can not find any plan labeled "Tree Preservation Plan", so it would be
appreciated if you could forward me another copy. In looking at those original plans for the development, they seem
some what conceptual in natural.
Now that the engineering has been done for construction plans, I am asking that a TREE PRESERVATION PLAN be
submitted in relation to the construction drawings. It would show graphically and in word the methods being used to
protect the trees and vegetation trom construction equipment and processes.
The single note on sheet C401 that says, "NOTE: CONTRACTOR TO AVOID THE EXISTING TREES DURING
CONSTRUCTION AND TAKE CAUTION WITH EARTH WORK EQUIPMENT IN VICINITY' is not sufficient. The circle it
appears around only refers to a group of six large trees in the middle of the US 31 side of the project. There are trees all
along that side of the project that must be preserved.
A complete Tree Preservation Plan needs to be submitted showing all the existing trees that are to remain on site, the
Tree Protection Best Management Practices (BMPs) that are being used to preserve them, all this on an engineered site
plan that includes other pertinent construction information like roadways and utilities. The existence of this plan shall be
noted on other plans as needed, such the grading plan, the stormwater pollution prevention plan, etc., and made available
to contractors that are working on site to prevent accidental oversights such as unscheduled tree removal.
The entire greenbelt on the US 31 side should not be place in a drainage easement. The Trees that are being preserved
should be placed in a landscape easement of some type (landscape, or tree preservation easement).
If the entire greenbelt becomes a drainage easement, that becomes its highest priority and any landscaping or
preservation to no longer protected. There should be no arguing about this point; the Greenbelt is stated in our
Ordinance.
I appreciate the update on Randy at Browning Day and his progress on the landscape plan. And I also appreciate
the anxiousness with Mr. Browning is trying to get this wrapped up for Hotel Indigo. I will be off for two weeks starting
tomorrow, but I will try to keep an eye on the submittals.

The proposed construction documents which we are requesting final approval dated 12-10-08 illustrate saving all the tress
located within that area previously defined.
The greenbelt and ponds are located in an easement defined as drainage along the US 31 corridor, which has been
discussed and has been approved by the City throughout the TAC process.
Is Scott suggesting adding another easement overlapping the drainage easement for buffer planting? This has not been
completed at this time since the 30' greenbelt is defined in oridinance relative to the US 31 roadway. Please advise.
Jamie is working with Browning Day on the Planting Plan for this development, which he requested during the last TAC
meeting.
Randy at Browning Day can advise on the status and note any issues Scott may have in regards to the proposed plan.
If Scott Brewer or Dave Barnes has specific comments relative to this infrastructure project please advise so we can
address accordingly.
Browning is very anxious in breaking ground early January for this new development in the City of Carmel and a delay in
city approvals will hold up the construction of the infrastructure project as well as the Indigo Hotel.
Please CC all on correspondence since this impacts everyone and we would like to resolve any outstanding issues as
efficiently and fast as possible.

come up soon. I sent the message, below, to Scott brewer and dave Barnes, relating to the tree preservation of certain
trees between the pond and US 31. I think Scott thought that there was a landscape preservation easement along there,
but I think it is just the 30-ft wide greenbelt. He will probably want a tree preservation plan submitted so that these trees
easement. is separate from the greenbelt. But, I will let you work that out with him.
"On the plans submitted by both Cripe and CDG, 1 see that there is the 30-ff wide greenbelt shown on the hotel indigo
plans, which is good. Also, the hotel indigo plans and the Gripe plans show the specific area o/existing trees that will be
preserved in that greenbelt, between the pond and US 31. 1 think Scott wants a tree preservation plan submitted, so that
these frees are protected during construction of the retention/detention facility.
The Tree Preservation Easement is shown on the original development plan, on the east side of the whole development,
adjacent fo the North Meridian Heights neighborhood.
The US 31 overlay calls for preservation of a certain number of trees in the bufferyards:
ZO chapter 238.10.04 Protection of Existing Trees:
Sites with existing trees or stands of trees should make reasonable efforts to protect and incorporate them into the overall
site design. The Landscape Plan must preserve not less than seventy percent (70%) of all trees that are:
A. nine-inch (g') DBH or larger, and
8. located within the Greenbelt, Planting Strips and perimeter buffering."
