1 L Docket No. 08100012 PP: Lakeland Subdivision
The applicant seeks primary plat approval for 2 lots on 10 acres. The applicant also seeks the
following subdivision waiver:
Docket No. 08100013 SW SCO 6.05.01 lot with no road frontage
The site is located at 1260 Clay Center Rd. and is zoned S 1/Residence. Filed by Michael
DeBoy of DeBoy Land Development Services for Christian Browning.
The applicant seeks approval fora 2-lot residential subdivision. Claridge Farms subdivision is to the south of
this site, and the Village of WestClay is located east of this site. The density proposed is 0.2 units per acre.
Since this project is considered a minor subdivision (with fewer than 5 lots) the applicant does not have to
comply with the Open Space Ordinance requirements.
The applicant also seeks a subdivision waiver to have one lot that does not have frontage on a public street.
Instead, the ]ot will access a street within Claridge Fame subdivision via easement from Chyverton Circle. An
easement is in the process of being secured from the Claridge Farntis homeowners' association.
Regarding the path along Clay Center Rd that crosses the creek: the petitioner has agreed to pay a s~mr
equivalent to the construction of said trail, per the Engineering Dept.
January 20 meeting results:
I . The committee needs larger copies that are legible. (See the (/26/09 info packet.)
2. As part of the access easement, Lakeland Subdivision residents would pay dues and be able to use the
Claridge Farris amenities.
March 3 Conunittee meetine results: the conmrittee voted on a favorable reconmiendation to the full
commission with conditions (see below).
Staff comments/concerns:
I. Remember to submit the Findings of Fact sheet at the meeting.
2. The Hamilton Comity Swveyoi's Office has no outstanding issues with this prinury plat. They doti t
foresee any concerns other than the Dept of Engineering's concern of access to lots during flooding.
3. The Engineering Dept has a few issues -mainly access and stormwater detention. Any final Engineering
approvals coy/d affect the land plan layout The prinury access to the lot fronting Clay Center Road
would be unpassable during high water on the creek; the petitioner has suggested that emergency access
at these times be provided from the rear (same access as the Lot #2). DOE has no issues with this as
long as the emergency response departments have no issues with this. It has also not been clearly
established where detention will be provided on-site. Options were discussed, but Engineering has not
seen a definitive plan.
4. The Forestry Dept received a landscape plan that is acceptable.
5. The project is outside the jurisdiction of the Hanulton County Highway Dept.
After all comments/concerns are addressed, the Dept. of Community Services recommends the
Commission vote to approve these items with the following conditions:
I . The fithtre house on Lot #2 will follow the Draft Residential Architectural Design Standards.
2. Letters of Approval from the Police & Fire Deparmrents should be submitted.
3. Path installation along Clay Center Rd, with the Exception of the 40-ft segment (where the
petitioner will pay a sum equivalent to the construction of said segment).
4. Final Construction Documents approval by the Dept of Engineering.
