Dear Mr. Patterson,
Thank you for the revised construction set received by this office on 3/17/09. The"following concerns
are being sent for your attention:
o Several questions have been raised within this department pertaining to data and elevations
provided for the infiltration basins/water quality swales and structure control details. Your
information appears to be accurate, hov/ever we would prefer to meet with you to review and
digestYhis data as shown within the plans. Please contact this office to arrange a meeting at
your convenience:
e Where the Multi-Use Path crosses-the proposed driveway, please indicate the cross section for
this location is the same as the drive itself. Note: The City's ROW section is 1.5" HMA #11
surface; 2" HMA #8 binder; 3"'HMA #SD base; 7" #53 stone; 4" #2 stone. The City also accepts
concrete aprons on perimeter roadways which is 6" minimum concrete on cgmpacted subgrade
for residential and 8" minimum concrete on compacted subgrade for commercial, in accordance
with 207,02 INDOT.
o Indicate if the sanitary'sewer under Chyverton Circle is to be open cut or bored. The sanitary
sewer profile is showing what appears to be an open cut with granular backfill, however this
office recommends fqr it to be bored. If it is indeed an open cut,a traffic maintenance plan will
be needetl for the closure of Chyverton Circle in addition to approval by the Carmel Board of
Public Works: This department will require the water line to be bored.
• On sheet C2.2, Maintenance of Traffic Plan, please review the Phase 1 Specifications, current
notes appearto contain information far another project.
• Sheet C4.3,.Storm Plan and Profile, indicates an excessive amount of granularbackftll over
proposed storm pipe. Please verify if this is desired/required at locations.
e SSD~invert for End Section 1 is referenced as elevation 863.50 in profile and 864.00 in plan.
Please confirm correct elevation.
• Review depth of sanitary force main leaving new building. Installation of pump outlet within
structure could possibly raise force main, if feasible or desired.
• Sheets LS1.0 (Landscape Plan) and TP1 (Tree Preservation Plan) are to be eliminated from the
review and final approval sets submitted to this office. The Department of Engineering does not
have authority to approve these items.
• Of benefit for understanding plans, it is of preference by this office to include invert elevations
for all pipe structures which are shown on the site plans.
e Are laterals for sanitary and water service to be provided for the future new west building?

Dear Gregory,
This is our response to your comment letter dated February 9, 2009
Per Section 102.02 v.a of the manual, if the project site is greater than two (2) acres in total land area, the
topographic map shall include all topography of land surrounding the site to a distance of at least two
hundred (200) feet. Please review and revise.
Response:
Please see the C1.0 Expanded Topography Plan. The additional topographic info
requested was gathered by using the Hamilton County GIS countours.
2. Per Section 102.02 vii of the manual, a storm sewer plan/profile sheet(s) at a scale of 5 vertical and 50
horizontal showing the elevation, size, length, slope, location of all proposed storm sewers, including
subsurface drains, is required. The statement provided in the referenced section shall be included on all
storm plan and profile sheets. Please review and revise.
Response:
Additional sheets have been added to show plan and profile of the storm sewer lines as
well as the sub-surface drains for the site. The statement provided in the referenced
section has been added to all storm plan and profile sheetws.
3. Per Section 102.02 xi of the manual, please review and revise the site grading plan shall include the
following.'
a. Delineation of all proposed land disturbing activities.
Response:
The construction limits have been updated.
b. Details of 100-year overFlow paths/ponding areas shown as hatched areas, along with all
associated easements. Please review and revise.
Response:
To prevent confusion and overlapping, the overflow paths have been delineated
with arrows on the sheets C6.2 and C6.3

c. Location, size, and dimensions of detention facilities used for the purpose of stormwater
management, to include top bank elevation, spillway location and elevation, and transverse
slopes of dry detention areas. Please review and revise

Cross sections of the detention facilities have been included on sheet C3.3.
d. A drainage summary, which summarizes the basic conditions of the drainage design,
including site acreage, off-site/upstream acreage, allowable release rates, post-developed
10-year, and 100-year flows leaving the site, volume of detention required, volume of
detention provided, and any release rate.
Response:
Sheet C3.4 has the drainage summary as requested. Also see Drainage Report for
more in depth information and hydrographs.
e. Definition of minimum flood protection grade in accordance with this manual.
Response:
See sheet C3.0 for the definition of minimum food protection grade in accordance
with said manual.
f. Drainage arrows shall be indicated for all surface drainage, swales and on each side of every
break in swale slopes.
Response:
Drainage arrows have been added to the grading plans as requested.
g. Label slopes of all surface drainage swales.
Response:
Drainage arrows have been added to the grading plans to show the slopes of the
surface drainage swales excluding those swales being used as infiltration
trenches.
h. Typical cross section of pond if not in accordance with standard cross section.
Response:
Cross sections of the detention facilities have been included on sheet C3.3.
4. Per Section 102.02 xiv of fhe manual, a structure data table shall be provided in the plan set. Please
review this section for the requirements of this tab/e and revise accordingly.
Response:
See Sheet C4.8 for the required Data Tables.
5. Per Section 102.03 of the manual, the pre-developed watershed map should include any off-site drainage
areas that need to be accommodated by the system, including the fully developed right-of--way per the
City of Carmel Thoroughfare Plan, the post developed curve numbers for each drainage area. Please
review and revise.
Response:
See the revised drainage report, these items have been addressed and discussed within
the drainage report. The individual weighted curve number calculations can be seen on
the node information sheet printout on the existing and developed conditions.
6. Per Section 102.03 of the manual, the post-developed watershed map watershed map shall include
including the fully developed right-of--way per the City of Carmel Thoroughfare Plan. Please review and
revise.
Response:
The fully developed right-of-way has been included within the drainage calculations (0.36
acres approximately at a minimum CN = 90 for existing and lowered a soil classification in
the developed conditions).
The drainage report discusses "...areas of uncontrolled discharge continuing on the existing path of
release." Please indicate and delineate on the pre-developed and post-developed watershed maps these
areas, to include the area in acres and the runoff curve number.

These areas are now delineated are the existing and developed watershed maps, areas
immediately adjoining Elliot Creek and those areas East of Elliot Creek are uncontrolled.
8. The sheet flow length value of 300 feet provided for Segment `A"in both the east pre-and post-developed
time of concentration calculations appears to be much longer than what appears to be delineated in both
the pre-and post-developed watershed maps. Please review and revise.
Response:
All time of concentration values have been updated due to changing of drainage design to
maintain no more than 4 feet of storage within the drainage basin.
9. Per Section 102.03 of the manual, please provide soils hydrologic group calculations.
Response:
This information is provided within the drainage report summaries and within the
appendices of the existing and developed conditions on the individual node report sheets.
10. Per Section 102.03 of the manual, p/ease provide the rainfall intensity data table.
Response:
Included within Appendix A and B of the drainage report at the end of the hydrograph
reports.
11. Per Section 302.04 of the manual, for the purpose of determining the post-developed conditions curve
numbers, due to significant disturbance to the upper soil layers during the construction activities, the
initially determined hydrologic soil group for disturbed areas should be changed to the next less infiltrating
capacity category (i. e., A to 8, 8 to C, and C to D). See also item 9 above. Please review and revise.
Response:
This has been done. Please read the summary of the proposed drainage and the
Appendices A and B of the drainage report.
12. Per Section 302.08 of the manual, for adry-bottom detention basin, the maximum planned depth of
stormwater stored for residential developments shal/not exceed four (4) feet. Per the drainage report,
the depth of the pond (5.35 feet) exceeds this maximum. Please review and revise.
Response:
Calculations and designs have been adjusted and modified to incorporate only four feet of
storage above the finish grade of the dry detention basin.
13. Per Section 302.11 of the manual, an emergency spillway shall be provided. P/ease provide calculations
for the size of the emergency spi//way, show the location on the plans, and provide a detail for the
spillway.
Response:
The calculations on spillways have been done and shown in the drainage report in
Appendix B.

Dear Ryan,
This is our response to your comment letter email dated February 10, 2009.
1. I have attached a markup drawing showing an possibility of how the sewers could be ran. We have passed a
policy for all developments to extend sewer to their farthest most property line. Please see the attached
document. /believe staying away from the Kostanos property if at all possible would be beneficial due to
landscaping, driveway, sidewalk and mailbox repair. Once these changes are made please resend plans for a
final review. Thanks!

DLDS has revised the sanitary sewer main extension to fit best with the conceptual layout that
you, Ryan Hartman, have sent to us.

We will revise the plan to show the required trail across our site within the right-of-way for Clay Center Road
except for that portion that lies within the floodway for Elliot Creek. It is our understanding that Mr. Jamie
Browning of Browning Investments discussed this situation with Mr. Gary Duncan of the City of Carmel and
that it was agreed based upon my client agreeing to pay a sum e uivalent to the construe ion of said trail
based upon City of Carmel standard detail as would e anticipated in a normal and customary right-of-way
cross-section (i.e. trail on existing ground) within the floodway area. -~

The reason for this discussion and agreement is that area of the trail that would be located within said
floodway has a limited space for the placement of said trail over Elliot Creek, within the confines of the
structure carrying Clay Center Road over Elliot Creek, and may create an unsafe condition for those who
would use this trail in this limited and confined area until such time the City of Carmel replaces or modifies said
structure.
We will be happy to meet with you or Gary to discuss and /or prepare the necessary commitments to this end.

I have attached a markup drawing showing an possibility of how the sewers could be ran. We have passed a policy for
all developments to extend sewer to their farthest most property line. Please see the attached document. I believe staying
away from the Kostanos property if at all possible would be beneficial due to landscaping, driveway, sidewalk and mailbox
repair. Once these changes are made please resend plans for a final review. Thanks!

SEWER EXTENSION POLICY
A POLICY FOR THE CONSIDERATION OF EXTENSIONS TO THE SEWER
SYSTEM OF THE CLAY TOWNSHIP REGIONAL WASTE DISTRICT
GENERAL POLICY STATEMENT
In order for the Clay Township Regional Waste District to carry out its purpose of insuring the
proper removal and disposal of sewage, wastes and wastewaters within the District, to insure
proper operation and maintenance of public sewers and sewage treatment plant, to provide
adequate record keeping of sewers, drains, connections and appurtenances thereto, and to
generally benefit the health, safety and welfare of the public in dealing with wastewater
management and water resource protection.
It shall be the goal of the Clay Township Regional Waste District that sanitary sewers
and their appurtenances within the Clay Township Regional Waste District shall be
public sewers, owned and maintained by the District
New Sewers
It is the intent of this policy that, whenever possible and practical, and when consistent
with other policies and procedures of the District, along with pump stations and other
appurtenances to such sewer expansions, should become part of the public sewer
system to ensure that long-range planning and maintenance can best serve the public.
Sewers shall be extended to the far property line of the parcel to be served and
terminated in a manner that accommodates future extensions. The location and depth
of the terminus manhole shall be determined by the District Engineer. This shall apply to
all parcels from single lots to multiple lot developments. Easements shall be granted as
required to allow the District to maintain the sewers.
A proposal that a new sewer line be a "private sewer" is generally counter to the intent of
this policy. However, there may be circumstances in which a "private sewer" is justified.
The burden of persuasion that must be met for such an exception to this policy is that
the factors favoring such a "private sewer" must substantially outweigh the underlying
purposes and intent of this policy statement.
Existing Sewers
In furtherance of this policy goal, and in order to protect the public in the event of a
malfunction, assist the District in making planning decisions and in anticipation of the
possibility of future conversion to public sewers, any existing private sewers should be
adequately documented in records of the District, in a manner prescribed by the Utility
Director from time to time.
In the event of a proposal from an owner or from the District that a "private sewer" is
construcfed or that an existing "private sewer' becomes a public sewer, the Trustees
shall evaluate each such proposal on a case-by-case basis, taking into account such
factors as:

Protection of the environment, water quality, and the health and safety of the
public;
• The standards of quality to which the sewer was or would be constructed and
installed;
The desire of the owner, those with property interests in the sewer, and others, to
have it become public;
The history of maintenance and reliability of the sewer;
• The ability and likelihood of the owner or owners to adequately maintain the
sewer;
The present and future costs to the District, including any contribution from the
owner or other sources of funds;
• Such other information or data presented to or sought by the District that will
assist in furthering the intent of this policy.
2. It is the policy of the Clay Township Regional Waste District that any proposed
extensions to the public sanitary sewer system be evaluated for approval, priority, timing
and financing by using such information and factors as the following:
Whether there are areas in which there is a high incidence of septic system
failure which is adjacent to the existing sewer;
• Whether there are areas in which there is a high incidence of septic system
failure resulting in risk to ground water or runoff contamination, even if not
adjacent to the existing sewer;
• Whether there are areas in which the cost of the extension is being paid by the
developer, or other economic factors that make it advantageous for the District to
add an extension desirable for other reasons as well;
Whether there are areas shown on the District's Master Plan which have not yet
been built;
• Whether there is currently development which is adjacent to the existing sewer;
• Whether there are areas designated on the Comprehensive Plan as high density
development areas;
• Whether there are areas where the majority of the property owners affected
request or agree to the extension;
• Whether there is available capacity to accommodate an expansion;
Whether there is funding available for the project;

• Such other information or data presented to or sought by the District that will

It is the intent of this policy statement to be a guide to the District and the public in planning, and
to protect the environment.

Hi, Mike- this needs to be worked out before the meeting tonight. Otherwise, your item might be tabled, due to pending
issues. Also, the issues of access and storm water detention might be the issues that cause this item to be tabled by the
committee tonight. The committee does not like sending items forward with issues like these, and they are becoming
stricter with not letting petitions with unresolved items back to full plan commission. If you think these items cannot be
resolved this evening, please let me know if you want to go ahead and table the item until the next committee meeting on

Hotel Indigo: We have issued comments; they are technical in nature and subject to final approval of the
construction plans. Engineering has no issues with Plan Commission approval of the project.
St. Vincent's Sports Performance Center: The Department has not received revised plans in response to
comments issued September 8, 2008. There were issued raised that we cannot confirm have been addressed.
Of note is the request for auxiliary lanes and a passing blister at the proposed entrance as well as formalizing
Thoroughfare Plan commitments. We are presently working with Williams Creek on storm water detention and
storm water quality issues; this process is not complete as we are still evaluating the unresolved issues.

12. The Engineering Dept has a few issues -mainly access and stormwater detention. The
primary access to the lot, fronting Clay Center Road would be unpassable during high water
on the creek. The petitioner has suggested that emergency access at these times be provided
.from the rear (same access as the second lot). DOE has no issues with this as long as the
emergency response departments have no issues with this as long as the emergency response
departments have no issue with this (Planning zoning will need the petitioner to provide
written confirmation of this from each Emergency Response Dept affected). It has also not
been clearly established where detention ~~t[l be provided on -site. Options were discussed,
but Engineering has not seen a definitive plan.
Response: Working with the DOE to address detention for the site.
13. The Forestry Dept xzll want a landscape plan that shows existing vegetation, as well as
additional plantings for whatever existing areas do not meet the bufferyard requirements of
the ordinance.

Response: Browning Investment and Carmel Engineering are negotiating this.
8. Why is there a 20 ft wide bike easement along the north property line o~lot 2?
Response: The owner wants to access quickly to siblings property west of lot Z.
9. Will there be any protective covenants or private restrictions? If so, please provide a copy.
Response: We will forward any protective covenants or private restrictions to you as
soon as we receive them.
10. Please provide copies of letters of transmittals and your correspondence to TAC members.
Response: Acknowledged. Will provide the above mentioned copies as soon as they are
available.
11. The Engineering Dept has a few issues -mainly access and stormwater detention. The
primary access to the lotfronting Clay Center Road would he unpassab[e during high water
on the creek The petitioner has suggested that emergency access at these times be provided
from the rear (same access as the second lot). DOE has no issues with this as long as the
emergency response departments have no issues with this as long as the emergency response
departments have no issue with this (Planning zoning will need the petitioner to provide
written confirmation of this from each Emergency Response Dept affected). It has also not
been clearly established where detention will be provided on site. Options were discussed,
but Engineering has not seen a defznitive plan.
Response: Working with the DOE to address detention for the site. Construction
Plans, drainage report and O&M Manual have been submitted DOE, HCSO, and
Crossroads Engineering for review. Will forward written confirmation from each
Emergency Response Dept for the emergency access from the rear of the property.
12. The Forestry Dept will want a landscape plan that shows existing vegetation, as well as
additional plantings,for whatever existing areas do not meet the bufferyard requirements of
the ordinance.
Response: Acknowledged. The owner's landscaper is addressing verbal comments
from Mr. Brewer.

transportation. I have reviewed the drawings submitted for the November 19, 2008 Technical Advisory Committee
and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The Alternative Transportation Plan requires the construction of a 10' asphalt path along the entire
Clay Center Drive frontage. Please revise the plans to include this revision.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay ofthe review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted, particularly if
any such changes are considered `5iew" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
reviews.

Most likely, you will need to submit a Subdivision control ordinance (SCO) waiver application for lot frontage less than 50-
ft at road right of way (SCO 6.05.01), and a Primary Plat application. The Secondary plat application can be submitted
later, after plan commission review of the primary plat.
You will not need to file a development plan application. However, we will want to see a general site plan with setbacks,
landscaping buffers, and approximate house location.
Also check out SCO 6.05.03,6.05.07, and 6.03.19.4.
