When I hear that a construction or demo crew is being sent in to "clean up" an area, I have To cringe because their mission is usually to aggressively wipe out any thing that'could by considered a weed. They usually wipe out as much vegetation as possible, and at the same time wipe out the young trees and undergrowth that protects them. They just are not trained to do the particular job we want them to do here. It is easier to just stay out of the area that is being protected. 90% of tree preservation is prevention of negative things that disrupt the natural processes: soil compaction, removal of young plants and seed source and nutritional layer of the forest floor. Believe me, if you don't take it away, you do not have to spend money putting something back. And I think that is the key to focus on here. It is ultimately less expensive for the client, and the neighbors are happier with the project, and the City is happier because the environment is preserved. Thanks for being a part of our team! Janet has no objection to the current paved driveway in the easement that leads to 146u' Street being removed in Dress' construction process so long as she is provided a temporary driveway to the nearest neighborhood street. Her understanding is that this will have a gravel surface of sufficient quality to allow her to travel it without any difficulty. It is also her understanding that the site construction manager will be working directly with the post office to insure that alternate arrangements will be made for uninterrupted mail delivery, in as much as her current mail box is on 146x' Street. Although we did not discuss the Thompson property itself, I would assume that Drees will not disturb the portion of the driveway that is on the Thompson property, and will not disturb any other portion of the property during the construction process, until tltle to the property is transferred to Estridge in January. Construction activities will require the removal of the Thompson's existing private drive within the boundary of Section 1. The agreed upon plan between the two parties will be to provide temporary access to Queensborough Drive during the remainder of occupancy, roughly January. This location is consistent with the scope of work within Section 1 for the connection/extension of Queensborough Drive within the Stafford Place development. Thompson's will require their mailbox be relocated from 146~h Street to the new access point off of Queensborough Drive (Copperwood Subdivision, access on 146~h Street) to continue to receive uninterrupted USPS mail service. In addition, a sign will be posted indicating Private Drive, and No Construction Vehicles. The new/temporary access point should also be known by Emergency response services. USPS (Dale Sparks), Carmel Communications (Bill Akers), Carmel Police Dept (Michael Fogarty), and Carmel Fire Dept (Chris Ellison) are included in this transmittal. A Hard copy is being sent as well. The drawings reviewed are numbered sheets C-100 through C-902, have a project number of 5622.002. Duke Energy does not object to your use of this easement as shown in the drawings you have submitted to Duke Energy. Please send an official signed and stamped copy of these drawings to this office once they are finalized. Please see the Duke Energy Transmission Right of Way Guidelines and Restrictions for any further guidance. Duke Energy offers the additional guidance to help you accomplish your work in a safe manner and to protect the reliability of our transmission lines: • Please place a marker indicating the location of structure # 623, beehive inlet valve, on the ground in our easement, to avoid the possibility of our crews driving over the inlet. • Contractors operating grading equipment should be instructed not to operate within 25ft of the poles or towers and the slgpe shall not exceed 4:1on the right of way. No spoil dirt is to be placed within the Duke Easement limits. • Any damage to the line and or structures and claims due to the damage is the responsibility of the 8/13/2008 October 12, 1997 Page 2 of 2 contractor/owner.. Duke Energy encourages you to post signs reminding all drivers to make sure dump beds are completely lowered when crossing transmission easements. Duke Energy also offers the following comments to ensure that other potential conflicts are not created during construction. If there are design changes to any drawings that involve the easement, Duke Energy would like the opportunity to review these changes for compliance. • Proper clearances must be maintained. If any construction work by Duke Energy is required to maintain proper clearances, the cost will be the responsibility of the developer. In not objecting to the use of the easement for use as shown on the drawings, Duke Energy is not relinquishing the nght to control and maintain the right-of-way as specified in the agreements. Any damage to the tower or lines and claims caused by the damage is the responsibility of the developer. It is the responsibility of the contractors to ensure all persons working near the transmission lines are made aware of the safety hazards associated with this line.
