Dear Ms. May,
I have reviewed your request to use our easement near structure # 814-1312, carrying our 69,000
volt transmission line. Duke Energy does not object to your use of this easement as shown in the
sketch drawing you submitted to Duke Energy. This drawing is labeled "Stafford Place 1, Map # 54-
308,DWG.CMAY 11/11/08, job # 1224778. If possible, I would like to receive a copy of your finalized
plans for this project so that we may record it in our records. You may send them in a pdf format via
email. Please see the "Duke Energy Transmission Right of Way Guidelines and Restrictions" for any
further guidance.
Duke Energy offers the additional guidance to help you accomplish your work in a safe manner. and to
protect the reliability of our transmission lines:
• Contractors operating grading equipment should be instructed not to operate within 25ff of the
poles or towers and the slope shall not exceed 4:1 on the right of way. No spoil dirt is to be placed
within the Duke R/W limits.
• Any damage to the line and or structures and claims due to the damage is the responsibility of the
contractor/owner.

• Duke Energy encourages you to post signs reminding all drivers to make sure dump beds are
completely lowered when crossing transmission R/W.
Duke Energy also offers the following comments to ensure that other potential conflicts are not
created during construction.
• If there are design changes to any drawings that involve the right of way, Duke Energy would like
the opportunity to review these changes for compliance.
Proper clearances must be maintained. If any construction work by Duke Energy is required to
maintain proper clearances, the cost will be the responsibility of the developer.
In not objecting to the use of the easement for use as shown on the drawings, Duke Energy is not
relinquishing the right to control and maintain the right-of-way as specified in the agreements. Any
damage to the tower or lines and claims caused by the damage is the responsibility of the developer.
It is the responsibility of the contractors to ensure all persons working near the transmission lines are
made aware of the safety hazards associated with this line. I have attached a copy of the right-of-way
restrictions.

I found a minor issue after my comments were complete. On Sheet C301, the median closure
calls for a curb and gutter with reverse slope. It should just be Concrete Curb per the
standard detail, without gutter.

This letter serves to acknowledge receipt of a transmittal received 9/5/08 containing the Revised
Secondary Plat and Revised Construction Plans for review. After reviewing the plat and plans
the Highway Department has the following comments utilizing the same numbering system as
previous correspondence:
1. OK.
2. When the Right-of-Way east of the entrance has been obtained, please provide a
completed dedication form to the Highway Department for acceptance. I have attached
that dedication form.
3. OK. The entrance, 146"' Street pavement section, must be installed to the curb
transition prior to access being allowed to 146`" Street. Beyond the curb
transition, stone may be used during construction.

10. OK. You are required to provide an engineers estimate for the cost of the improvements
and a permit bond in that amount.

just wondering if you are okay with the 6-ft wide path along 146^ street, per the county's standards or if it needs to be a
10-ft wide asphalt path per Carmel's alternative transportation plan. I think'the county has jurisdiction of the road right of
way along 146'h street, but just wanted to check now, before the path is built.

Please find enclosed one set of Secondary Plat and Site Construction Plans, Drainage
Report, and landscape plans for Stafford Place, Section 1. The plans have been revised per
your letter dated August 20, 2008. I have addressed each of your items individually with a
numbering system consistent to your letter.

3. An exhibit showing the offsite drainage path from 2' Hamilton County GIS contours for
Pond 1 has been inserted into the drainage report. Aker a visual site inspection, Greg
Hoyes of the Hamilton County Surveyor's Office approved the location of the Pond 1
outlet. The Hamilton County Surveyor's Office was unable to produce a drainage
report for Wedgewood Section 2 that would supply drainage basin and storm pipe
information downstream from the beehive the subject site ties into. Therefore, since
the release rate has been reduced, it can be assumed that the existing storm sewer
will have adequate capacity.
4. See General Note #15 on Development Plan for flood protection grade note. Lowest
Adjacent Grade elevations for lots adjacent to the ponds are listed with the other pond
elevation information.
5. Proposed condition curve numbers have been revised to be the next less infiltrating
capacity category as compared to the existing condition curve numbers.
6. Both ponds have a 12" outlet pipe with a 6" restrictor plate orifice at the pond outlet.
During the 10-year storm event, the developed release rate is not lower than the
allowable, but since the minimum orifice size is 6", the developed release rate is
accepted. During the 100-year storm event, both ponds could have a larger than 6"
orifice in the restrictor plate and have the developed release rate still lower that the
allowable release rate. Each pond outlet will have a 6" outlet however, in order to
lower the developed release rate of the 10-year storm event. Therefore during the
100-year storm event, both ponds are slightly over-detaining what they are required
to.

Since this issue has not been raised in the past, I admit that I am struggling with bringing it up so late in the
process. However, it is a standard that was in place at the time of all filings and it cannot be ignored
With that said, please confirm that providing the 30-foot easement will be a detriment to the project. We would
like this width easement wherever it can reasonably be provided but will consider a reduced width.

referenced project has bean completed. The submittal is in need of additional information in order
to be in compliance with the City of Carmel Stormwater Technical Standard Manual (the manual).

1. Per Section 102.02.xi. of the manual, please provide the following information on the
development plan:
a. Emergency flood routing path(s) and their invert elevations from detention facilities
to the receiving system.
b. A drainage summary, which summarizes the basic conditions of UJe drainage design,
including site acreage, off-site/upstream acreage, allowable release rates, post-
iieveloped 10-year, and 100-year flot~~s leaving the site, volume of detention
required, volume of detention provided, and any release rate.
c. If a storm sewer or similar type of system is used, provide details showing
connection to the main system or method of discharge into stream or reservoir,
distance to scream outlet.

5. Per Section 201.03 of the manual, for the purpose of determining the post-developed
conditions curve numbers, due to significant disturbance to the upper soil layers during the
construction activities, the initially determined hydrologic soil group for disturbed areas
should be changed to the next less infiltrating capacity category (i.e., A to B, B to C, and C to
D). Please review and revise accordingly.
6. Please include in the drainage report those calculations that demonstrate that the
detention volume for each pond is adequate in accordance with Section 302.03. Although
Section 302.06, paragraph 7, provides for the minimum orifice size, calculations must still be
provided to show the pond meets the requirements of Section 302.03. In addition, the
actual orifice size is to be used to determine the secondary outlet elevation for the offsite
areas, as well as the 100-year pond elevation, in accordance with Section 302.05 of the
manual.

7. Per Section 102.02.v of the manual, if the project site is greater than two (2) acres in total
land area, the topographic map shall include all topography of land surrounding the site to a
distance of at least two hundred (200) feet. Additional topography in excess of two
hundred (200) feet may be required for the offsite route for the outlet control structure.
Please review and revise.
8. Per Section 102.03.fi.h of the manual, for Pond ql, please provide a narrative and
photographic record of the condition of the downstream receiving system and a report of
the expected impact of the development's stormwater runoff or any receiving stream or
downstream property. The existing offsite Swale as referenced to in the drainage report
appears to beat least 350 feet east of the outlet point of the control structure.
9. Per Section 302.03 of the manual, the computed release rate for each outlet point shall not
be exceeded at the respective outlet point even if the post developed conditions would
involve a different arrangement of outlet points. The actual discharge rates at the outlet for
each detention area shall be the allowable discharge rates (EX 2 & 4) less the direct
discharge rates (DIR 1 &DIR 3) at those same locations. Please review and revise.
10. Per Section 302.12 of the manual, the flow path from the development outfall(s) to a
regulated drain or natural watercourse (as determined by the City of Carmel) shall be
provided on an exhibit that includes topographic information. The construction plans and
topographic survey provided do not provide any information for the outflow path for Pond
tfl. Please review and revise accordingly. See items 1 and 2 above.
11. Hamilton County Standard Plan shown on Plan Sheet C806 shows a 2-foot minimum
freeboard from the 100-year pond elevation to the top of bank, whereas the typical Pond Hi
Section immediately below it shows a freeboard depth of only 1.69 feet. Please review and
revise.

exceeds both the maximum length and maximum number of lots. Please review and revise
as necessary.
15. Per Section 501.03 of the manual, there should be no less than 2S feet of cover along any part
of itre pipe from final pavement elevation or final ground surface elevation to the top of the
pipe. Reinforced concrete pipe storm sewer minimum cover heights which are less than those
described shall be evaluated on a case by case condition and approved only with written
permission by the City Engineer. Please review and revise.

Dear Mr. Batt:
The City has received the construction plans for this project dated July 17, 2008 to be reviewed at the
August 20, 2008 Technical Advisory Committee meeting. This letter is being issued as a supplement to
any previously issued letters regarding Stafford Lane. Some comments from previous review letters may be
repeated. We offer the following comments:
GENERAL INFORMATION
1. These comments represent the Department of Engineering's first review of the Section
t construction plans after phasing of the subdivision.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Boazd of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off-site easements necessary to install utilities to serve the development are secured.
e. SWPPP is approved.
f All fees are paid.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Stotm Water Management Permit is required prior to commencing any earth
disturbing activity.
8. An approved right-of--way permit is required prior to commencing any work in the public
right-of--way.
9. If it will be necessary to relocate existing utility poles, they must tie relocated to within one
foot of the proposed right-of--way. Costs for such relocations are to be borne by the

16. A schedule for Board of Public Works and Safety meeting dates and agenda deadlines has
previously been sent. Please use the Engineering Department deadlines for submissions to
the Board.
17. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission and/or the Board of Zoning Appeals (if applicable) and completion of
review by the Technical Advisory Committee. All written requests to be placed on [he
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable).
I8. Water and Sanitary Sewer Availability approval from the Board will be required. This is an
EDU approval based upon the total number ofresidential lots @ 1.0 EDU per lot. The letter
of request should include the total number of residential lots and the total platted acreage of
the development.
19. Commercial Curb Cut Approval - It appears that this will be a typical platted residemial
subdivision, which normally would not require BPWS curb cut approval. However, since

]46's Street is under thejurisdiction of the Hamilton County Highway Department, approval
of the 146'" Street entrance should be obtained from them.
20. Temporary Construction Entrance approval if the location is at a site other than the location
of the proposed permanent entrance to the development. Again, if this is to be located on
146u' Street, Hamilton County Highway Department approval will be required.
Z 1. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) within dedicated right of way (other than
146ih Street) or dedicated easements requires the execution of a Consent to Encroach
Agreement between the Owner and the City of Carmel. Such agreements are executed by the
Board of Public Works and Safety. The City Engineer may approve irrigation system
agreements.
22. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of secondary plats for Board of Public Works and Safety approval.
23. Dedication of Right of Way if not platted.
24. Any open pavement cuts of the existing subdivision streets in the Copperwood subdivision.
BONDING REQUIREMENTS
25. Upon initial review, it appears performance guarantees for the Stafford Lane Residential
Section 1 development shall be provided for the following:
a. Interior Streets (stone base, asphalt binder and asphalt surface).
b. Interior Curb & Gutters
c. Water Mains.
d.. Sanitary Sewers. Onsite androffsite may be bonded separately or together. However, if
bonded together, all of the construction must be complete prior to release of the
performance.
e. Storm Sewers/Storm Drainage. Onsite and offsite maybe bonded separately or together.
However, if bonded together, all of the construction must be complete prior to release of
[he performance.
f. Street Signs. Please designate if Standard City of Carmel Street Signs or decorative type
street signs will be installed. A Performance Guarantee is required in either case.
However, if decorative signs are installed, they must meet our minimum standards.
Additionally, after the Performance Guarantee for decorative signs has been released, 3-
Year Maintenance Guarantee will not be required as future maintenance will be the
responsibility of the Developer/Owner/HOA.
g. Monuments & Markers. Street centerline markers and perimeter concrete monuments.
h. Interior Sidewalks. These are the builder's lot right of way sidewalks.
i. Exterior Sidewalks. These are sidewalks that are constructed in the right of way adjacent
to common areas or perimeter streets. Any sidewalk or asphalt path construction in the
right of way of 146`" Street should not be bonded with the City of Carmel
j. 146's Street right of way improvements will be under the jurisdiction of the Hamilton
County Highway Department who may require bonds to be posted. This could include
acce]eration/decelera[ion lanes, passing blister, pavement widening, thermoplastic
sniping, stone shoulders, curbs, paths/sidewalks, etc.
k. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley,
Engineering Department Stormwater Administrator, for details regarding engineer's
estimates/performance guarantee requirements for these items.
26. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc. Please provide
the estimates to this office as soon as possible and certainly prior to submission of
Performance Guarantees by the Developer in order to give us sufficient time to review the
estimates.

27. Upon completion and release of individual Performance Guarantees, athree-year
Maintenance Guarantee will be required (see Street Sign comments above). The

28. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of

RIGHT OF WAY PERMIT AND BONDING

Queensborough Drive in the Copperwood subdivision, a Right of Way Permit with the City

3l. If a Permit with the City of Carmel is required, the bond amount is determined by the number
of instances of work in the right of way at $2,000.00 per instance. However, if the work is
included in the scope of work of a required and posted Performance Guarantee, the
Performance Guarantee maybe used to satisfy the bond requirements of the Right of Way
Permit.

AVAILABILITY AND CONNECTION FEES
33. The Availability Fees are current as of this date but are subject to future revisions.
Availability (acreage) Fees must be paid after all other Engineering Department
Requirements have been satisfied and prior to approval and start of construction activities.
Availability Fees are based upon total platted acreage of legal description acreage and are as
follows:
a. Water Availability Fee = $1,010.00 per acre plus a $300.00 Development Application
Review Fee (effective 7/2/07). Based on the secondary plat, Water Availability Fees for
Section I would be 5.16 Acres @ $1,010.00/Acre = $5,211.60 + $300.00
b. Sanitary Sewer Availability Fee = $1,365.00 per acre. Based upon the secondary plat,
Sanitary Sewer Availability Fees would be 5.16 Acres @ $1,365.00/Acre = $7,043.40
totaling $12,555.00
34. The Connection Fees are current as of this date but are subject to future revisions.
Connection Fees are paid on an individual lot basis after satisfactory completion of
infrastructure construction and when an application for a building permit is submitted.
a. Water Connection Fee = $1,396.00 per I.0 EDU (effective 7/2/07).
b. Sanitary Sewer Connection Fee = $795.00 per 1.0 EDU
35. We would suggest that you contact Carmel Utilities in regard to pending fee revisions, the
timing of the revisions and how the revised fees will be implemented in regard to this

36. If an entryway ircigation system, other community irrigation system, community swimming
pool, community clubhouse or community bath house is planned for this development,
additional Water Availability Fees and Water Connection Fees (and Sanitary Sewer

This letter serves to acknowledge receipt of a transmittal received 7/21/08 containing the
Secondary Plat and Construction Plans for review. After reviewing the plat and plans the
Highway Department has the following comments:
1. Type A curb ramps will be required within the Right-of-Way of 146`h Street.
2. When the Right-of-Way east of the entrance has been obtained, please provide a
completed dedication form to the Highway Department for acceptance. I have attached
that dedication form.
3. A temporary /construction entrance will not be allowed at the existing residential drive.
Please provide a detail for the immediate closure of the median. Any barriers used must
present a deterrent to construction traffic without presenting a safety hazard to motorists
on 146`h Street. Similar barriers may be used to close the residential drive.
4: Please make the following correction on Sheet C301:
General Note #6 -replace seed and straw mulched with nursery sod.
General Note #8 -replace the pavement section with the standard section on the 146`h
Street details sheet.
5. The transition from 8" curb to roll curb should occur at Structure 627 & 628.
6. Neenah casting R-3457-C2 is acceptable to replace the existing curb casting on 146`h
Street. A substitute casting may be used if the dimensions are equivalent.
7. Raised pavement markers are needed between the deceleration lane and the travel
lane, spaced in accordance with INDOT Standards. White lane markings must be
thermoplastic. The stop bar and cross walk at the entrance must be preformed tape
(3M-380ies).
8. Please include the following note on the secondary plat: decorative signs, sprinkler
systems, trees, landscaping mounds, fences, light poles or other such amenities are not
permitted within the Right-of-Way of 146'" Street.
9. A one way sign (R6-1 R) is needed in the median directly across from exiting traffic.
