Westernmost corner of Lot #4; thence Norteasterly 30.1 feet to the Northernmost
corner of Lot #4; thence Southeast 280.32 feet to the Place of Beginning.

Highway Commission for right of way purposes for Project S 165(14)• Subject to a 25

Explanation of Application
Applicant Metro Acquisitions, LLC is applying to vacate Lots 1, 2 and 3 and
portions of Lots 3 and 4 of the Charles E. Walter's Rolling Acres Resubdivision to
remove lot lines, drainage and/or utility easement, covenants and building set-back lines
to facilitate inclusion of Lots 1, 2 and 3 and portions of Lots 4 and 5 as part of
redevelopment and creation of the Clay Terrace Development. The application is being
filed to facilitate development of the Clay Terrace subdivision consistent with the
Preliminary Development Plan.

Petitioner: Metro Acquisitions. LLC
Part of Plat to be Vacated: Lots 1. 2, 3, 4, and 5 of the Charles E. Walter's Rolling Acres
Resubdivision. Plat Book 2, pages 35 and 35 in the Hamilton
County Recorder's Office
Pursuant to Indiana Code 36-7-3-11, based on all of the evidence presented by the
Petitioner at a hearing held on September 16, 2003, the Plan Commission hereby approves the
Petitioner's Application to Vacate Plat, Covenants and Public Utilities for Lots 1, 2 and 3 and
portions of Lots 4 and 5 of Charles E Walter's Rolling Acres Resubdivision, Plat Book 2, pages 34
and 35 in the Hamilton County Recorders Office (the "Lots") based upon a finding that:
1. Conditions in the platted Lots have changed so as to defeat the original purpose of
the Lots in the plat that the Petitioner seeks to vacate.
2. It is in the public interest to vacate the Lots within the plat.
3. The value of that part of the land in the plat that is contiguous to the Lots that is not
owned by the Petitioner will not be diminished by vacation.
