Docket No. 118-03 PV (#03080004) Walter's_Rolling Acres- Plat Vacation The applicant seeks to vacate lots within this subdivision in order to develop the Clay Terrace Development. The site is located at southwest of 146th Street and US 31. The site is zoned PUD/Planned Use Development. Filed by Joe Downs for Clay Terrace Partners, LLC. The applicant is requesting that the Plan Commission approve a request to vacate a portion of the Walter's Rolling Acres subdivision (see exhibit within the information packet distributed prior to the public hearing). This area is specifically the location of the proposed Clay Terrace Blvd. extension and detention facilities being constructed as part of the Clay Terrace Development Project. This process is similar to the situation addressed as part of the Danbury Subdivision adj acent to the Lowe's PUD site for the construction of the new ramp off of Keystone. However the developer of Clay Terrace did not have control over the subject ground at that time. Several concerns were raised at the public hearing including the following: 1. Desire to see a fence. 2. Concem that plan will change make-up of neighborhood 3. Concern about local wells and water table changes 4. Enforcement of "Mud Ordinance, street sweeping, etc. The Commission requested that the applicant provide a better aerial view of the area and a summary of who was notified, and when, as part of the process. The confusion with notice maybe that the subject azea was not part of the rezone request for Clay Terrace. It was adjacent to the PUD and not owned or under contract by the petitioner. After the rezone the parcel was acquired as part of the TIF agreement for the construction of the road segment between 146th Street and US 31. The Department recommends that the Subdivision Committee forward this request to the full Commission with a favorable recommendation after all comments and concerns have been addressed.
