2b. Docket No. 118-03 PV (#03080004) Walter's Rolling Acres- Plat Vacation
The applicant seeks to vacate lots within this subdivision in order to develop the Clay
Terrace Development. The site is located at southwest of 146th Street and US 31. The site
is zoned PUD/Planned Use Development.

The applicant is requesting that the Plan Commission approve a request to vacate a portion of the
Walter's Rolling Acres subdivision (see exhibit within the information packet distributed last
week with the meeting agenda). This area is specifically the location of the proposed Clay
Terrace Blvd. extension and detention facilities being constructed as part of the Clay Terrace
Development Plan.
This process is similar to the situation addressed earlier this year for another part of the Clay
Terrace Development and also the area of the Danbury Subdivision adjacent to the Lowe's PUD
site for the construction of the new ramp off of Keystone. However the developer of Clay
Terrace did not have control over the subject ground at that time.
The Department recommends that this item be approved at the conclusion of the Public
Hearing if there are no questions or concerns raised that warrant Committee
consideration.
Note: Taking final action on this item this evening will require a vote to waive the
Commission's Rules of Procedure that would otherwise direct the item to the Subdivision
Committee.
Additional Note: Written findings are required for action on the Plat Vacation.

In addition, please note that the following was returned to the agenda under old business. The
Committee has not completed its discussion of the item. However, there was a desire to get
comments form the full Plan Commission due to the nature of changes proposed by the applicant.

The applicant seeks to rezone a 6.5 acre pazcel from R-1/Residence to a PUD (Planned Unit
Development) District designation. The property is generally located at the southeast corner of
116`h Street and the Monon Trail.
