Indiana, has the authority, to establish motor vehicle speed.limits on streets within the City's corporate limits pursuant to City Code Section 8-15 and Indiana Code Sections 9-21-1,-3,9=21-5-3. and 9-21-5-6, and WHEREAS, pursuant-to such autliority, the Common Council has designated•certain.City stre . ets, as having twenty'mile per hour (20 mph), speed Iimits,,lhirty mile per hour (30 mph) speed limits or forty mile per hour (40',mphi speed limits, such d'esignations:being.codified in City Code Sections 8-19, 8-21 and &22,f&spectively; and WHEREAS, the Common Council finds that it- is in the best interests of the City and of public safety to now'amend those City CodeSections. NOW, THEREFORE; BE IT ORDAINED, by the Common Council of-the City of Carmel, Indiana, as follows: Suction 1-. The foregoing Recitals,are fully incorporated Herein by Ihis_reference. Section 2. Chapter=8, Article-3,. Section 8-'19(a) of•the Carmel 'City'Code, should-be and the same is hereby amended to include the following streets. "aunty Lane, Forest Lane; Hoster Road, Northwood Drive, Pebblebrook Lane, Prairie Place, Shieling Court and Westwood Drive" Section 3. Chapter°8,, Article 3;.Seetion 8-21(a) of the Carmel City Code should be and°the;same is hereby ainended'to include the following streets:, ""(21) River, Road from1160^St'reefto122n°Street (22) River Road from,1261^ Streetto 1311E Street (23) River Road from 13111 Street to Haverton Way (24) (Reserved)'," Section 4 Chapter 8, Arti'cle 3, Se6tion,8-22(a),ofthe Carmel City Code should,be_and the.same is hereby amended to include the following streets: "(14} River Road from Haverton Way to 146'n'Street (15) (Reserved) Page One of Three Pages This Ordinance was prepared by Douglas B. Section 6. The Cannel Street Department-is directed t6 .promptly prepare and' post 'appropriate= signage to fulfill thc?mnndalcs contained:in this,Ordinance upon-its passage. Section 7. All prior ordinanccsor parts thereof inconsistent,with:any provision of this Ordinance are hereby repealed, to,the extent of Such, inconsistency only. as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does.ltot affect,any rights or liabilitics,accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance- Those rights,,habilities and"proceedings are continued and penalties,shall:be imposed and enforced. under such repealed or amended<ordinance as if this Ordinance had.not been adopted. Section 8. If any portion of this Ordinance is`for airy reason- declared to be,unconstitutional or invalid, such decision shall notaffect the.?val dity of•thetremaining portions:of this,Ordinance so long as- enforce.ment.of,sal-ne can -be given the.same,,effeCl: Section.9.
