Carmel Drive Carmel, IN 46032 RE: ZONING ORDINANCE VIOLATION — OUTDOOR SALES/TEMPORARY USE Dear Sir or Madam: This letter is being provided to inform you that an outdoor sales/temporary use violation has been brought to this department's attention. The outdoor sales merchandise and outdoor storage materials. are located at 1425 W. Carmel Drive under the zoning jurisdiction of the City of Carmel, a property that you are currently a tenant of. The Carmel/Clay Zoning Ordinance states in section 25.22.01 Sales, Outdoor, Temporary Use that: Outdoor Sales shall only be permitted in the zoning districts as per Appendix A: Schedule of Uses, such uses shall be allowed only as a Temporary Use, requiring a Temporary Use Permit. Also in section 25.22.04, the Carmel/Clay Zoning Ordinance prohibits such uses from interfering with pedestrian access: 25.22.04 Outdoor Sales may be located within parking areas, provided it: A. Does not interfere with pedestrian or vehicular access or parking. B. Does not create a visibility obstruction to moving vehicles within a parking lot. The Carmel/Clay Zoning Ordinance makes provision for the temporary outdoor sales of merchandise, but not without an approved permit, as well as the provision that it does not interfere with pedestrian access. This letter shall serve as the first and final warning for this type of violation. Please permanently store all merchandise within the facility and remove it from the sidewalks, as you do not have an approved Temporary Use Permit for the temporary outdoor sales of merchandise no later than July 11, 2008. Should you continue to be in violation of these ordinances after this date, you may be subject to further enforcement action including a possible court appearance.
