Applicant is seek a Development Standards Variance to reduce the number of parking spaces
required by Section 27.08 of the Carmel/Clay Zoning Ordinance from 676 to 633, to allow for
the expansion of the existing gazden center into part of the parking lot on the east side of the
store. After the expansion, 70 parking spaces will remain in the east side parking lot.

Since the opening of Petitioner's store, the residential development in the area has created
a considerable increase in the public's demand for garden supplies, plants, pla~rting materials,
and related products. As a result of this increase in public demand, Petitioner has realized and
determined that the size of its existing garden center is inadequate for it to stock, display, and
maintain the quantity and diversity of garden type products necessary to satisfy the public's
needs.
The inadequate size of the garden center does not only hamper Petitioner's ability to
provide enough quantit}' and type of garden product to satisfy the public's demand, it also
negates any simp]e resolution of the problem. Specifically, due to both safety regulations and
Petitioner's concern for the safety of its employees and the public, Petitioner ca~mot overstock
the garden center. Similarly, due to lire ordinance governing its store, Petitioner cannot engage
in either outside sales and/or outside storage of garden products to meet the public's demand.
To adequately correct the problem, Petitioner has determined that it needs to expand the
existing garden center into part of the area of the parking lot to the east of the store. Petitioner
has determined that this expansion will provide enough room for the stocking, displaying, and
selling of enough garden products to meet not only the cun~cnt public demand, but any increase
in that demand. In formulating its plan, Petitioner has also taken into consideration the
requirements for the saPcty of its employees and customers. hinally, as the application in_iicatcs,
the only thing that is affected by the expansion is the reduction of 43 parking spaces from the
