A presentation was made by the Camlel City Engineer Mike McBride regarding the drainage issues in ' Carmel (attachments 1 and 2). Sump pump or roof drain discharges at the property line. 2. Poor swale or roadside drainage. 3. Soft, saturated soil on the property making mowing or other maintenance difficult. 4. Standing water in rear or front yards due to poor swale or roadside drainage. 5. Why do I need to deal with runoff from other properties? How do,properties drain? Most properties are split and drain both to the front and the rear. The system in place to convey runoff from each property varies throughout the City. Most properties rely on downstream easements to convey this runoff. City Code requires lots to be platted with drainage easements for this purpose. Surface Drainage Systems. A system of rear yard and roadside swales with limited inlets and piping. Drainage is typically facilitated by a long, flat swales and drive culverts. Piped Drainage Systems. Rear yard swales run for only several lots or a few hundred feet before entering an inlet. Front yard drainage is to the curb and gutter system of the street and into inlets. No roadside. is swales or drive culverts. Swales sometimes have underdrains that allow saturated soil after rain events to better drain. What typically causes drainage problems? Most drainage issues in the City are the result of lack of Swale maintenance, lack of drive culvert maintenance, installation of improvements within the swales or swales being filled in. Over time, the result is reduced swale capacity. The result is standing water and saturated soil long after the end of the rain event. The prevailing soil types in the City are also.slow draining, subject.to seasonal high water tables and in many areas, the topography is. fairly flat which slows the surface drainage of runoff. Who maintains the system? Unless a private street, the City maintains the roadway and the curbing system and the piped drainage system in the right-of-way. The City maintains piping in subdivisions that is 12-inces in diameter or larger that is not part of a legal or regulated drain. The City accepts maintenance responsibility for these primary conveyance systems due to the fact that these systems drain the right-of-way, benefit many properties and because it is not feasible for individual property owners to maintain these systems. The City does not maintain drive culverts or rear yard swales. The property owner or the homeowners association is responsible for such maintenance. Accetturo, John V; Greskamp, Dan Subject: RE: drainage ditch problem Mr. Morton, As you probably noticed by my automated reply to your email on Aug. 16th, I was out of the State attending a continuing education session and only returned to Indiana last night. I am attempting to catch up with emails that were received in my absence. As I attempted to make clear in my last email, this drainage way benefits all the properties in the area by providing a way for the storm water that falls on each of these properties an avenue by which to drain away: The Waterford Subdivision, the Maples subdivision, Merchants Square, a good portion of Woodland Springs (including your property), as well as sizable area of Eden Estates all drain to this drainage way. Without this drainage course, the rain that4alls of these properties would simply find its way to low areas within each property and stand until it evaporated or infiltrated the ground. I would be happy to request that one of my inspectors meet with you to review your concern; however, as I mentioned previously, this is a drainage way that I have investigated before and I fairly certain that our findings will be the same. I have lived in this house for 18 years and the house is approximately 35 years old. I have no ® way of knowing if this ditch was there before the subdivision was constructed or not, however the only property between my residence and Keystone Avenue is the Maples condominiums. Therefore it is difficult for me to understand how this waterway benefits other properties in the area, especially west of my residence. It is my belief that the volume of storm water discharge.from Merchants Square over time has caused this issue. Thank you in advance. I am sorry that no response was provided, but this is the first I've been made aware of such an email. I am however, familiar with this ditch and have been out to look at it several times over the past 7 years. This ditch does convey a fair amount of drainage from upstream areas including a portion of the Merchants Square drainage area. This is a naturally occurring drainage way that existed prior to the development of the subdivision that is now positioned around it. This waterway benefits the properties in.ihe area that continue to drain to it. However, the City does not protect individual properties from erosion due to drainage courses such as this. It is each individual property owner's responsibility to protect their land against erosion due to flow within these naturally occurring waterways. It is also a responsibility of each adjacent property owner to remove any object that exists on their property that is obstructing the flow of such a ® drainage way. If there are specific issues related to the culvert under Rolling Springs Drive, the City, as the owner of the Right of Way, would have an interest and a responsibility in,.repairing those items that fall within the right of way. I am hoping that you can help get this issue resolved soon. I am sending this e-mail in response to a ditch that borders the edge of my property. I live at 11618 Rolling Springs Drive, Carmel, In 46033. The ditch runs along the northern side of my property, under Rollings Springs Drive and I believe eventually flows into Woodland Springs Lake on 116th Street. I believe that the surface water from the. Merchants Square Mall creates the majority of the water which feeds the ditch. The ditch is in need of repair as the water has eroded away much of the south bank and is currently very close to causing some very large trees on my property to collapse into the ditch. One can view from Rolling Springs Drive how the water flow has eroded away the northern edge of my property. I can be reached at 317-848-7878. Our Inspector made an on-site inspection on September 10, 2003, and our findings are summarized in this letter. The erosion that you described in your call appears to be a natural ravine located on your private property. You, as the property owner, are responsible for stabilizing and maintaining drainage ditches, swales, and easements that exist on your property. It is not City policy to expend its resources to correct this type of issue. Our suggestion.is. to line the bottom and side of the ditch with riprap to preserve the existing,bank while still maintaining the flow of water through the drainage ditch. Whatever method of ® erosion control you choose to use in this area, you should take a moment prior to commencing work to bring in your plan and discuss it with someone in this department. This will allow us to verify that the installation is being done according to established standards and that the flow is being maintained. I appreciate you taking the time to bring this matter to our attention. The.Engineering Department Inspector visited this area on July 16, 2004 to investigate these concerns, and our observations are summarized in this letter. First, to address your concerns pertaining to the shrubs and brush creating a fire hazard. this ® forested area is platted as common area for the Shadybrook Homeowners' Association. (HOA). Therefore, it is the responsibility of the FICA or the adjoining homeowners in the subdivision (depending on the covenants of the subdivision) to maintain this area. It is not the City's policy to expend its resources to -maintain common areas within subdivisions. Second, in regards to the drainage pipe and swale along Chester Drive, the Street Department is responsible for maintaining concrete storm sewers that are 12-or greater in diameter within the right-of- way and in platted orrecorded easements. The Street Department does not maintain drive culverts. Homeowners, or the.HOA's are typically required to maintain and repair these types of driveway culverts. It does appear that the pipe needs to be lowered in order to better facilitate the flow of water through this Swale. If the party:responsible for the maintenance of the ditch and pipe, or reconstruction of the pipe chooses to make improvements to the ditch or pipe; they must first obtain a right-of-way permit.. from this office. This Department would require that a detailed plan be submitted.prior to issuing a right-of-way permit.
