Please let this letter serve as a request to table the above-referenced ADLS application until further
notice. Due to a contractual dispute, Ryland Homes signed a lease in another building and is no longer
requesting a sign for the Penn Mazk II Building. However, Penn Mark II, LLC is conducting ongoing
negotiations with several prospective tenants for the same space, and each prospective tenant will likely request
a sign in the same location as the proposed Ryland Homes sign. Since Penn Mazk II, LLC had already filed the
application for ADLS approval and paid the filing fees, it is our request that the above application be tabled until
a new tenant with a specific sign request enables us to amend the original application.
With regard to the two developmental standazds variances requested above, please let this letter serve as
authorization to withdraw the applications filed under the above-referenced docket numbers. Once a new tenant
is secured wither specific sign proposal, we will amend the original ADLS application referenced above and file
rwo new developmental standards variance applications.
We apologize for any inconvenience this may have caused you, and we appreciate your understanding.

As you know, the Depamnent of Community Services for the Ciry of Carmel has
contacted us and is requiring additional information for the Sign Variance Application, which
information is due on September 12, 2003. The City of Carmel has requested the following
supplemental information regazding the above:
1. A Site Plan which shows the proposed sign location on the building, street
frontage, and distances ofthe building from the adjacent public streets.
2. A location map showing the surrounding land uses of the adjacent properties.
I forwazded the Site Plan you provided previously to the Department, and they have
indicated that it is acceptable. Asper our conversation, you have a broker working on a location
map, showing the surrounding uses. Once received, we will forwazd all information requested to
the Department.

Finally, the Department has provided us with the Docket Number for the ADI-S
Application. and the filing fee. For your reference, the Docket Number is 130-03 ADLS Amend
and the filing fee is $364.00. Please make the filing fee check payable to the order of the
"Department of Community Services" and deliver to the Department no later than noon on
Friday, September 26, 2003. Failure to deliver the check will result in the request being tabled
until the November meeting.

As per our conversation, the foregoing will not be placed on the agenda for the Technical
Advisory Comrnirtee meeting on September 17, 2003. As per your letter dated September 2,
2003, you have requested additional information from us by the end of the business day on
September 12, 2003: (i) a building elevation/photo which shows the proposed sign superposed on
the southern facade of the building; (ii) a Sitc Plan and location map which shows the
surrounding uses of the adjacent properties, the proposed sign location, street frontage, and
distances of the building from the public street; and, (iii) a diagram showing the material and
colors of the sign.
1 have enclosed herewith a Site Plan, which shows the building footprint, frontages and distances
from the public streets. Please let me know immediately if this diagram on 11" x 17" paper will
not suffice. We will provide you with the surrounding uses on a separa[e diagram, along with
the rest of the information requested. Finally, please let me lmow if you might be able to meet
on September 17, 18 or 19 to discuss the status of these requests.
