Graystone has, however, agreed to assign all of its due diligence and devclopmcnt work, including its engineering, plat approvals and landscaping plans, to a third party who will pick up where Graystone Icft off in its devclopmcnt of Cass Estates. The purpose of this letter is to confirm that Graystone's assignee will be able to move forward with the Cass Estaros Project without the need to re-file for any approvals already obtained and/or to pay any fees previously paid to the City of Cannel with respect to Graystone's development activities to date. Description of Real Estate. See Exhibit "A"hereto ("Real Estate"). Docket # 131-03 PP. Statement of Commitments. A. Owner commits to construct roadway improvements to the part of 116`h Street adjacent to the Real Estate to provide either of the following at its discretion: i. A one-half (1/2) roadway (including existing pavement) of two (2) twelve (12) foot lanes with curb and gutter ("Maximum Improveme»ts") or ii. A one-half (]/2) roadway with an addition of three (3) feet of pavement and three (3) foot stone shoulder to the existing pavement ("Minimum Improvements") and contribute in cash to the Carmel Department of Community Services ("DOGS") a sum equal to the difference between the estimated cost of the Maximum Improvements and the estimated cost of the Minimum Improvements (the "Cash Contribution"), as determined by agreement between Developer and DOGS, to be applied by DOGS to such other roadway improvements within anone-mile radius of the Real Estate as DOGS may determine, including roadway improvements within the Westins subdivision. The Cash Contribution, if elected by Owner, shall be paid at the time of the approval of a Secondary Plat for a section(s) in an amount equal to the total Cash Contribution divided by 70 times the number of lots shown on the Secondary Plat for which approval was received. The roadway improvements provided for and contemplated by these commitments require and are subject to the approval of the Hamilton County Highway Department and the Hamilton County Commissioners. 4. Binding on Successors and Assigns. These commitments are binding on the Owner of the Real Estate, each subsequent owner of the Real Estate, and each other person acquiring an interest in the Rea] Estate from the Owner. These commitments may be modified or terminated only by a decision of the Commission made at a public hearing after notice as provided by the rules of the Commission. Exlstine Tree Rowe. We discussed the existing tree row behind lot 15. As I mentioned, we have no plans to disturb this txee row, as we believe it provides a desirable buffer between properties. We will commit not to disturb this true row unless required to do so by either Hamilton County or the City of Carmel. I believe it is very unlikely that there would be any such regairement. , 3. Sewer Connection. We discussed the location of our cormection to sanitary sewer service. As I mentioned, the design of the sanitary sewer system has not yet been finalized, but in the event we need to connect in front of your property, all work will be done in the right of way, and we will return the disturbed property to its previous condition after the work is done. 4. rains e. We discussed the issue of drainage across your property from east to west. I offered to work with you, e.s we design and build our storm drainage system, to help improve the drainage across your property. One possible solution would be to construct an underground pipe from the outlet of otn' pond across all or a portion of your property to Long Branch Creek. If we warn to do this, we would grade and seed your property in order to return it to its previous Condition. I thereafter faxed you a copy of this letter, Upon further consideration and in an attempt to continue to reach compromise and consensus with Mr. Lewin, Sheldon is willing to construct a mound subject to the following: 1. 1'he mound would he 6 feet in height and would be approximately 330 feet in length, but the mound would stop at the beginning of the wildflower/nature area. 2. On top of the mound Sheldon would plant two (2) rows of Norvvay Spruce trees mtnf~y 10 feet in height and said trees would be planted approximately 15 feet apart. 1'he total tree planting for the two (2) combined rows would be 67 Norway Spruces and these trees would be planted along the entire 510 foot common border between the properties. In lieu of mulching the mound tea, it would be seeded with grass. A one-half (1/2) roadway with an addition of three (3) feet of pavement and three (3) foot stone shoulder to the existing pavement ("Minimum Improvements") and contribute in cash to the Carmel Department of Community Services ("DOGS") a sum equal to the difference between the estimated cost of the Maximum Improvements and the estimated cost of the Minimum Improvements (the "Cash Contribution"), as determined by agreement between Developer and DOGS, to be applied by DOGS to such other roadway improvements within anone-mile radius of the Real Estate as DOGS may determine. The Cash Contribution, if elected by Owner, shall be paid at the time of the approval of a Secondary Plat for a section(s) in an amount equal to the total Cash Contribution divided by 70 times the number of lots shown on the Secondary Plat for which approval was received. The roadway improvements provided for and contemplated by these commitments require and are subject to the approval of the Hamilton County Highway Department and the Hamilton County Commissioners. 4. Binding on Successors and Assigns. These commitments are binding on the Owner of the Real Estate, each subsequent owner of the Real Estate, and each other person acquiring an interest in the Real Estate from the Owner. These commitments may be modified or terminated only by a decision of the Commission made at a public hearing after notice as provided by the rules of the Commission. The foregoing notwithstanding, these commitments shall terminate upon the recordation of a Secondary Plat as to the part(s) of the Real Estate described therein. 5. Effective Date. The commitments contained herein shall be effective upon the approval by the Commission of the Primary Plat under Docket # 131-03 PP (Primary Plat) and the approval of a Secondary Plat for all or part of the Real Estate pursuant to the Primary Plat ("Effective Date"). 6. Recording. The undersigned hereby authorizes the Secretary of the Commission or the Director of the Department of Community Services to record these commitments in the Office of the Recorder of Hamilton County, Indiana, following the Effective Date. 7. The prirpose of this letter is to respond to your request for certain modifications to the proposed plan and to offer a solution that I hope will be acceptable to you. My understanding of your request is based upon our discussion on October 25, as well as an email from Greg Zubek to Jim Shinaver on October 28, 2003. 1. Visual Screen. My understanding is that you have requested an earthen mound, 6' in height, running the length of the boundary between your property and tkte Cass property (approximately 510'). Xou have also requested a row of Norway Spruce trees, 10-12' in height, spaced 8' apart on top of the mound. As I mentioned when we met, installing an earthen mound would present several challenges. A 6' high mound would be over 70' in width. Adding such a feature would require redesigning the layout of the project, and would result in the loss of at least two lots. The cost of such a redesign, coupled with the cost of moving a large quantity of material, would be prohibitive. In addition, we are concerned that such a major change in the topography of that area would create drainage issues for both properties. While we would like to accommodate your request to the greatest degree possible, we must respectfully decline this portion of your request. As an alternative, we would propose planting a double row of 10-12' Norway Spruce trees along the property line, with one row on each side of the property line. The trees in each row would be spaced approximately l5' apart, resulting in a visual separation of approximately 7.5'. This solution would contain approximately 67 trees and provide an effective visual screen between the properties. Existine Tree Rows. We discussed the existing tree row behind lot 1.5. As I mentioned, we have no plans to disturb this tree row, as we believe it provides a desirable buffer between properties. We will commit not to disturb this tree row unless required to do so by either Hamilton County or the City of Carmel. I believe it is very unlikely that there would be any such requirement. 3. Sewer Connection. We discussed the location of our connection to sanitary sewer service. As l mentioned, the design of ,the sanitary sewer system has not yet been finalized, but in the event we need to connect in front of your pzopetTy, al] work will be done in the tight of way, and we will return the disturbed property to its previous condition after the work is done. 4. Drainaee. We discussed the issue of drainage across your property from east to west. 1 offered to work with you, as we design and build our storm drainage system, to help improve the drainage across your property. One possible solution would be to construct an underground pipe from the outlet of our pond across all or a portion of your property to Long Branch Creek. if we were to do this, we would grade and seed your property rn order to return it to its previous condition. This scenario would require you to grant an easement for construction of the drain as well as ongoing maintenance of the drain by Hamilton County. I believe this solution would be an improvement upon the current drainage on your property. 5. Timine of Work. Your attorney, Mr. Greg Zubek, has requested that al] work affecting your property be done at the beginning of the development process in order to mitigate the impact of construction on your property. We certainly wish to minimize any impacts on your property, and will work with you to accommodate this request. Please note, however, that we are constrained in the order that we can complete certain tasks. For example, we cannot install landscaping before the majority of the site work is done. I believe a reasonable expectation would be that the landscaping work would be done by the end of August, 2004. 6. Work to be Done on Your Property. Our proposal would require that we come onto your property to plant one tree row, and to install whatever underground drainage we agree upon. For such work, we would prepare the appropriate license to come onto your property, and you would have the right to inspect and approve the work, provided that such approval is both timely and reasonable. The application is identified as Docket No. 131-03PP, 131-D3aSW. This application is the to be discussed by the Carmel Plan Commission on October 21, 2003. I am the owner and resident of the property at 4141 W. 116"' Street. I am the immediate neighbor on the west portion of this proposed development. $ased on the landscape plan provided by your office and the housing plan layout provided by Dennis Olmstead, at Stoeppelworth and Associates, consulting land surveyors, the application presents an unacceptable impact on my property. The current plan does not provide sufficient privacy and security protection for my properly. The street, which stubs at our property, is not acceptable as it assumes at some point that I may wish to extend this street into my property. J have no intention or plans to further develop my property, which would require the extension of this street. The landscape plan does not provide adequate privacy and security protection for my property. I would request the developer to provide a dirt mound barrier between my property and the development. This barrier should be at least ten feet in height and topped with Norway spruce trees at least 10-12 feet in height and spaced no further than 10 feet apart. This will provide privacy and some security for my property. 1 also fmd the entire landscape plan for the application as inadequate. Across 116x' Street, Pulte Homebuilders has developed home sites and the entire landscaping looks simply awful, and it appears this application is a duplicate of this unsightly development. The landscaping by Pulte development is inadequate, containing small trees and spaced so far apart that it looks cheap and unappealing. OCT-20-2003 12 39 P. 03 ' ~ • -2- The Carmel Plan Commission must realize the Pulte development has already added heavy traffic to the area, and this site would only add to anever-increasing problem. I removed several trees on my property bordering 116's Street because I was concerned that entering and leaving our driveway was a safety issue, and the removal of these trees provided an enhanced line of sight for haffic both east and west bound on 116x' Street. The additional traffic generated by this application should be studied further before it is approved, and at minimum should require street improvemrnts. These improvements should include warnings regarding our driveway and perhaps even the removal of the hill on l lba' Street to enhance line of sight for both eastbound and westbound tratyic on 116x'. The entrance to the development being proposed does aot appear to provide an adequate amount of additional street space to ensure that traffic leaving or entering the development can be seen by oncoming eastbound and westbound traffic on 116's Street. This should also be reviewed prior to approving this application. Further, I have not seen the impact of sewers and water caused by this new development. I have city sewers and city water for my property. The Pulte site developers dug under 116'" Street and to our property connecting to city sewerswrthout my knowledge. I want to understand how this development plans to provide city sewage and water service and how this will impact my property. I have made a considerable investment in my property and with great care. The Carmel Plan Commission should consider the concerns I have expressed before approving this application, Until I received a letter from the Stoeppelworth land surveyors, I had no knowledge of this development and the specifics of the development plans. I was not aware that zoning for this development had been approved. I contacted the developer - he did not contact me. This lack of interest in contacting neighbors gives me some cause for concern. I hope the Carmel Plan Commission takes my concerns seriously, and communicates with me regazding these concerns so that I may stay abreast of this application. I will make my Greg Zubek, my legal counsel, and myself available to discuss these concerns at a mutually acceptable time with the Commission and the developer. ROAD IMPROVEMENTS: The typical agreement for existing contiguous Hamilton County Roads which are substandard, with Hamilton County is: The developer will put in 12 inch stone base to the required width of the road, acid grade the shoulders to a minimum of 6 feet width and construct proper side-ditches, or, provide storm sewers and curbs. This will be the black top grade during construction of subdivision. Then the county will come in and cut out 3 inches and put in 3 inch binder asphalt after which the developer will be responsible for 1 inch of asphalt topping. This is being done as joint projects between county and developer. An agreement shall be executed, in writing; between the developer and Hamilton County specifically detailing the exact work to be accomplished by the developer and that to be accomplished by the County, and shall also state the road or roads or portions thereof which are included. If the, subdivision is contemplated to be annexed to the City of Carmel, then the agreement shall include the City of Carmel Board of Public Works as a signatory, which shall be for the purpose of the City of Carmel agreeing to accept for maintenance and operation, the improved road facility upon completion of said improvements and completion of annexation.
