AGREEMENT The developer shall be responsible for any drainage problems including standing water, flooding and erosion control, which azise or become evident at any time during the 3 year maintenance period after release of subdivision bonds, and which is attributable to a deficiency in subdivision drainage design or construction of drainage improvements. This shall include all pipes, structures, swales, ditches and ponds which are pertinent features to the proper drainage of the subdivision. This responsibility of the developer shall not, however, include problems which are created, subsequent to the completion of the subdivision improvements by the improper grading by individual builders, or structures and improper grading installed or accomplished by individual homeowners. It is the intent of this requirements, that the developer shall, specifically, provide such sub-surface drains, or storm sewers or ditches as are required to properly rectify any drainage problem or sub-surface water problem which was not contemplated in the original approved subdivision design, including, but not restricted to, disposal of sub- surface water from footing drains of individual lots. ROAD IMPROVEMENTS: The typical agreement for existing contiguous Hamilton County Roads which are substandazd, with Hamilton County is: The developer will put in 12 inch stone base to the required width of the road, and grade the shoulders to a minimum of 6 feet width and construct proper side-ditches, or, provide storm sewers and curbs. This will be the black top grade during construction of subdivision. Then the county will come in and cut out 3 inches and put in 3 inch binder asphalt after which the developer will be responsible for 1 inch of asphalt topping. This is being done as joint projects between county and developer. An agreement shall be executed, in wrifing, between the developer and Hamilton County specifically detailing the exact work to be accomplished by the developer and that to be accomplished by the County, and shall also state the road or roads or portions thereof which aze included. Most of the wooded portion of the project is defined as "Young Woodland" according to Carmel's Residential Open Space Ordinance (ROSO III). The north or south fencelines have only a few scattered, individual trees on them. The 150 foot zone at the east end of the property is approximately 50% of the wooded portion of the property. Wildlife relocation on the project is infeasible due to legal issues, logistics and ineffectiveness. No evidence was found of any flora or fauna listed as a species of concern by state or federal agencies. The report contains lists of all flora and fauna discovered during the inspection. Evaluate the wooded portion, especially a 150 foot strip on the east side, of a Pittman Partner's development named Weston Point to determine the woodland's definition under the City of Carmel ordinance. 2. Evaluate the eastern halves of the south and north fencelines. 3. Photo-document this work. 4. Record species of flora and fauna. 5. Examine the feasibility of wildlife relocation for this project. Limitations Inspections were conducted on August 20, 2003. As such, they are limited by the time frame and present field conditions. These are not the long-term observations needed to represent the full spectrum of plants and animals, which use the land over the course of the year and the changing seasons. Spring ephemeral plants, migrating animals, and spring nesting animals are some of the categories that are not represented in this report. Methodology All areas in the scope of work were inspected on foot. Tallies of the tree species were taken by species and size. The property was separated into different areas defined by changes in timber stand characteristics. These areas are plotted on the aerial photo (attached). Photos were taken in an effort to represent "typical" examples of the plant communities. All animals and birds seen, heard, or found evident by sign were noted. Plants seen along the way were also noted. All plants, animals and other life noted during the inspection are listed in the appendices. More complete lists could be obtained through more intensive investigations. Each area was rated using the definitions as stated within the Residential Open Space Ordinance (ROSO III) for Carmel/Clay Township.: The definitions used were: • Woodland, Mature - An area of plant material covering one-half acre, or more, and consisting of thirty (30) percent of more canopy trees having a sixteen (16) inch or greater caliper, or grove consisting of seven (7) or more trees having ten (10) inch or greater caliper. Scott, RCA #392 317.846.1424 Pittman Partners/Weston Point JCM 9/2/2003 Page 3 • Woodland, Young - An area of plant material covering one half acre, or more, and consisting of thirty (30) percent or more canopy trees having an eight (8) inch or greater caliper, or any grove consisting of seven (7) or more trees having ten (10) inch or greater caliper. • Woodland, Scrub - An area of plant material covering one half acre, or more, and consisting of thirty (30) percent or more canopy trees having a two and one-half (2 1/2) inch or greater caliper, or any grove consisting of fifteen (15) or more trees having four (4) inch or greater caliper. Findings The area primarily inspected was the eastern most 150 feet of the woodlands. It is approximately 150 feet wide and 660 feet long. This area is primarily regenerating young woods with very large trees scattered throughout. It is approximately 73% young woodland and 27% woodland scrub according to Carmel's ROSO. There are 3 distinct forest types in this area. AREA 1: The southernmost end has been cleared at some point. It contains a lot of small tree saplings mostly under 1" in diameter. This area is defined as "Woodland, Scrub" under Carmel's ROSO. AREA 2: The rest of the southern third of this area is dominated by trees in the sapling and pole size classes (1" to 8" in diameter). The ground vegetation is sparse and there are several shrub species present most notably of which is the tartarian honeysuckle (Lonicera tartarica). This area would also be defined as "Woodland, Scrub" under Carmel's ROSO. AREA 3: The northern two third's of this area is dominated by trees in the 8" to 16" size class. There are several very large trees scattered throughout this stand. The large trees dominate everything under their canopy but do not form the majority of the canopy overall. This northern two thirds would be defined as "Young Woodland" under Carmel's ROSO. AREA 4: The remainder of the woods that lies west of, and adjacent to, this 150 foot wide strip is also made up of sapling and pole stands with scattered large trees. It would all be defined as "Woodland, Young" under Carmel's ROSO. The fencerows were also evaluated: Almost all of the trees along the fencerows are outside of the fence. It was assumed that the fence is the property boundary. There are only a few, widely scattered trees within the fencerow. The fencerows would be defined as "Open Space" under Carmel's ROSO. Temperatures were in the 90's and it had not rained for 2 weeks or so. As such, the plant and animal life was not very active. The findings listed here will underestimate the abundance of plants and animals that may be present at this site due to these conditions. FORESTED AREA: This area is primarily regenerating young woods with very large trees scattered throughout. There is a little evidence of past firewood cutting. No stumps were found. Whatever process removed most of the larger trees seems to have happened at least 20 years ago. The topography is relatively flat. No soil samples were taken. The woods are bordered on the East and South sides by newer housing developments. It is bordered on the north by open fields and on the west by an agricultural field. Swamp white oak and white ash comprise 70% of the trees present. The remaining 30% is made up of burr oak, pin oak, red oak and red elm. At the edges, especially along the south edge, there are a few black cherry, hackberry, black walnut, white mulberry, and shagbark hickory. The swamp white oaks and the burr oaks are the dominant canopy trees. The white ash are the predominant understory trees. The larger trees that are scattered throughout the woods are usually large burr oaks or swamp white oaks. Plants species commonly found include: poison ivy, Virginia creeper, ,spicebush, tartarian honeysuckle, enchanter's nightshade, jumpseed, garlic mustard, raspberries, multiflora rose, grape vines, rough avens, goldenrods, and sedges. A few species typical of a mesic woodland were found including: jack-in-the-pulpit, green dragon, Indian tobacco, and Mayapples. FENCEROWS: The fencerows have very few trees. They are mostly tall vegetation. The trees that are present are mostly; black walnut and hackberry with a few black cherry, white mulberry, hawthorns and crabapples. Most of these trees are on the outside of the fence so they may not be on Pittman Partner's property. There is one nice burr oak in the southern fencerow. The vegetation in the fencerows was composed of species more adapted to the open sunlight conditions and typical of plants found near fields and "waste" places. The typical plants found in the fence rows include: tall ragweed, multiflora rose, tartarian honeysuckle, Canada thistle, black raspberries, black berries, trumpet creeper, goldenrods, field thistle, agrimony, queen anne's lace, and ironweed. There are a few notably large trees that would add considerable value to the community if they were considered for preservation. No other highly notable natural features were found. The trees and plants combined with the topography indicate wetter conditions. Drainage should be seriously investigated during the planning of this development. Any large trees that are to be preserved should have individual health assessments done to minimize future risks and to maximize the long-term health of these trees. A tree preservation plan should be written once the trees to be preserved are identified. A site specific tree preservation plan is the first step towards giving the trees the best chance of surviving the stress of construction. Trees need care before, during, and after construction to optimize their ability to handle these stresses. Copyright ©2003 Vine & Branch, Inc. Judson R. Scott, RCA #392 317.846.1424 Pittman Partners/Weston Point JCM 9/2/2003 Page 6 Wildlife Relocation On August 21, 2003 the Pittman Partner's Weston Point was investigated at the request of Steve Pittman of Pittman Partners. Vine & Branch was asked to discuss the feasibility of wildlife relocation for the Weston Point project. It is Vine & Branch's position that this procedure is not a viable option during this development unless there are species present that are State or Federally endangered. We have inspected the property and find no such animals. The Weston Point project should proceed without special attempts to relocate wildlife. The Effect of Development on Wildlife Communities The wildlife community present on this property appears to be typical of what is seen in areas heavily encroached upon by development. Raccoons, squirrels, woodchucks, and deer are present. These are non-conservative species that remain and adapt to increasing urbanization. The more conservative species that do not adapt well are gone including: foxes, piliated woodpeckers, turkey, quail, and mink. As this area is developed, the non-conservative animals that are displaced will move into the remaining areas and compete for new living space there. As we ail know, squirrels and raccoons thrive in urban settings. Relocation of the wildlife is realistically impossible. While it may be possible to catch as much as 50% of the wildlife present, it would take thousands of man-hours. Secondly, it is logistically and physicaily impossible to catch more than 80% of the wildlife. While it is possible to exterminate a population, it has been proven to be impossible to capture all individuals of most species in a natural situation. An example would be the recent attempts to capture white-tailed deer in Indiana's state parks. Even in "secure", completely fenced areas, the researchers were unable to capture even a small percentage. of the population. Even if it were possible to capture a significant number of animals, there is no place to release them. Indiana State law prohibits the releasing of wildlife onto another property without the express permission of the landowner. This issue was researched by Internet including sites of the: Indiana DNR, Audubon Society, Indiana Wildlife Federation, University wildlife extension offices, and county extension offices. Phone calls were made to wildlife biologists and conservation officers. All agree that relocation of wildlife has many, many problems associated with it including: ineffectiveness, inhumaneness, disease/pathogen transfer, political and regulatory issues, This development should proceed without special attempts to "save" wildlife. There is no evidence of any conservative species or species of concern on the property. Attempts to capture and relocate the wildlife here would be an expensive, and ineffective, procedure that would only hurt the wildlife we are trying to save. Copyright ©2003 Vine & Branch, Inc. There are 3 distinct forest types in this area. The remainder of the woods is also young woodland according to Carmel's ROSO. There are some notably large trees scattered throughout the woods that could add value to the community if they were preserved. The fencerows have very few small trees and only one large tree. They are mostly tall vegetation. Wildlife relocation is not realistically feasible on this project. No flora or fauna listed as state or federally as endangered or of concerned were found.
