COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard; Council President Ron Carter; Council Members Ke~/m Kirby, Brian Mayo, Joe Grifflths, Fred Glaser and Mark Rattermann; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Came Gallagh~r were also present. Councilor Rick Sharp was absent. Mayor Bralnard called the meeting to order at 7:02 p.m. Pastor Dave Voltz of Centennial Bible Church of Westfield pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: Mayor Brainard presented Tony Collins of the Carmel Fire DeparWnent with the Range Line Pioneer Award in recognition of his dedication and service to the City as well as his selfless volunteer work with the Hoosier Burn Camp. APPROVAL OF MINUTES: Councilor Mayo moved to approve the Minutes of the April 19, 2004 Regular Meeting. Councilor Grifflths seconded. The Minutes were approved 6-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: V~ajyne W/ilson of 24 Wilson Ddve, addressed Council as President/Chairman of Carmelfest Committee, Inc. and read aloud a recent Press Release issues concerning the cancellation of this year's event. Robert Land of 10836 Latonia Lane, addressed Council as Vice-President of Carmelfest Committee, Inc. and commented on the circumstances surrounding the cancellation of Carmelfest. Pamela A/bacete of 3237 Hawthorne Drive W/est, addressed Council as a Carmelfest Committee, Inc. volunteer and -- expressed sadness that an agreement could not be reached so that the hard work and planning of the Committee could be realized. COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Councilor Mayo encouraged the corcanunity to vote on Tuesday, May 4, 2004. Mayor Brainard advised that Carmelfest will take place this year. ACTION ON MAYORAL VETOES: There were none. CLAIMS: Councilor Mayo moved to approve a total claim in the amount of $1,464,715.77. Councilor Glaser seconded. Claims were approved 6-0. COMMITTEE REPORTS: Council President Carter reported that the Finance, Administration and Rules Committee met in a special meeting on April 29, 2004, at which time the Committee continued discussion of the Carmel City Code codification and recommended the matter be tabled. The Comtmttee advised that Ordinance No. D-I698-04 __may be withdrawn and provided a favorable recommendation to Council for the passage of Resolution Nos. CC-05-03-04-01 and CC-05-03-04-02. The next regular meeting of the Finance, Adm/nistration and Rules Corrmmttee. is scheduled for May 17, 2004 at 5:00 p.m. in the Caucus Room. Councilor Rattermann reported that the Land Use, Annexation and Economic Development Committee met on April 22, 2004, at which time the Committee continued discussion of both the annexation and mining issues. The next regular meeting of the Committee is scheduled for May 13, 2004 at 5:30 p.m. in Council Chambers. Council President Carter stated on behalf of Councilor Sharp that the Parks, Recreation and Arts Committee has not met. The next regular meeting of the Comrrfittee is scheduled for May 11, 2004, at 3:00 p.m. in the Caucus Room. Councilor Kirby stated that the Utilities, Transportation and Public Safety Committee has not met. The next regular meeting of the Committee is scheduled for May 10, 2004 at 5:00 p.m. in the Caucus Room. OLD BUSINESS: Council President Carter announced the Second Reading of Ordinance No. D-1691-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Enacting and Adopting a Supplement to the Code of Ordinances of the City of Carmel, Indiana (Fourth Quarter 2003). Council President Carter presented this matter to Council. Councilor Glaser moved to table this item. Councilor Griffiths seconded. There was discussion. Councilor KLrby recommended that the motion be made to include only tabling the matter until the next meeting of Council. Councilor Glaser moved as such. Councilor Griffiths seconded. The motion to table this item until the next meeting of Council was approved 6-0. Ordinance No. D-1691-04 was tabled until May --17, 2004. 2 Council President Carter announced the Second Reading of Ordinance No. D-1698-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Adopting a Promotional Fund for the Carmel Plan Commassion as Chapter 2, Article 4, Section 2-128 of the Carmel City Code. Councilor Rattermann, as sponsor of this item, moved to withdraw this matter from the Agenda. Councilor Kirby seconded. Ordinance No. D- 1698-04 was withdrawn. Council President Carter announced Resolution No. CC-05-03-04-01 (Formerly Resolution No. CC-04-i9-04- 01): A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Resolution of the City of Carmel Plan Commission Relating to the Amendment to and Expansion of Certain Economic Development Areas in the City, and Approving the Expanded Boundaries Thereof. Council President Carter presented this matter to Council. There was extensive discussion. Bruce Donaldson, Attorney with Barnes and Thornburg, responded to Council questions. Loren Matthes of H.J. Umbaugh added additional information in reply to Council inquiry. Brief discussion continued. Resolution No. CC-05-03-04-01 was approved 5-1. Councilor Mayo voted in opposition. Council President Carter announced Resolution No. CC-05-03-04-02 (,Formerly Resolution No. CC-04-i9-04- 0_~; A Resolution of the Common Council of the City of Carmel, Indiana, Approving the Issuance of Certain City of Carmel Redevelopment District Tax Increment Revenue Bonds ($9,500,000.00). Council President Carter presented this matter to Council. There was brief discussion. Resolution No. CC-05-03-04-02 was approved 6-0. PUBLIC HEARINGS: Council President Carter armounced the First Reading of Ordinance No. Z-442-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning District Classification (A Property Located Along the North Side of Main Street, Approximately 800 Feet East of US 31 from the S-2/Single Family/US 31 Overlay District Classification to the OM/SU - Old Meridian Special Use District Classification - St. Christopher's). Councilor Rattermann moved to introduce this item into business. Councilor Kirby seconded. Michael Hollibaugh, Director of the Department of Community Services, presented this matter to Council. Council President Carter opened the matter for Public Hearing at 7:46 p.m. Seeing no one who wished to speak, the Public Hearing was closed at 7:47 p.m. There was brief Council discussion. Mr. Hollibaugh responded to Council concerns. There ~vas no further discussion. Council President Carter referred Ordinance No. Z-442-04 to the Land Use, Annexation and Economic Development Committee for further review and consideration. NEW BUSINESS: There was none. OTHER BUSINESS: There was none. ANNOUNCEMENTS: Council President Carter announced that May 21Stis Carmel Bike to Work Day. 3 ADJOURNMENT: Mayor Brainard moved to adjourn, pending the execution of documents.
