Walter 9944 Big Bend Dr. Indianapolis, Indiana 46234 RE: ORDINANCE VIOLATION — PROPERTY MAINTENANCE Mr. & Mrs. Walter, Sufficient time has passed to allow for either the sale of or for maintenance and repairs to begin regarding your property at 210 Walter Street. The property remains in violation of the General Requirements §6-222 of the City of Carmel Property Maintenance Code, and specifically (C) Exterior Structure, to include, but not limited to: §6-222 (a) (4): Vacant structures and land. All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure, healthful and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety or violate the provisions of this Code. §6-222 (e) (1): General. The exterior of a structure shall be maintained in good repair, structurally sound, and sanitary so as not to pose a threat to the public health, safety, or welfare. §6-222 (e) (2): Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion. Oxidation stains shall be removed. All exterior surfaces shall be of uniform colors and materials to ensure compatibility with adjoining properties. §6-222 (c) (5): Exterior walls. All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface -coated where required to prevent deterioration. ONE QVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 §6-222 (c) (6): Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and down spouts shall be maintained in good repair and free from obstructions. Roof Drain discharges shall be discharged as a Legal Connection or a Legal Discharge. Inappropriate or temporary roofing coverings including but not limited to tarps shall be deemed inadequate protection and not uniform and as such shall be prohibited for a period exceeding seven (7) consecutive days. §6-222 (c) (9): Stairways, decks, porches, and balconies: Every exterior stairway, deck, porch, and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads. §6-222 (c) (11): Handrails and guards: Every handrail and guard shall be firmly fastened and capable of supporting 200 pounds of pressure and shall be maintained in good condition. All chipped and peeling paint needs to be removed and surfaces made weather-tight/water-tight; all holes in siding, etc., need to be made weather-tight/water-tight; the structure's roof system needs to be completed with bearable gutter board, complete and unobstructed gutters and downspouts; masonry needs to be tuck -pointed; stairways need to be sound and completed with code appropriate handrails/guards; the garage either needs to be demolished, or a new roof needs to be constructed with guardrails securing the perimeter of the garage roof . Please make all the required corrections, and/or repairs to the structure (to Code) by June 30, 2008. Failure to comply with this matter will result in further enforcement action to include citations issued daily until work has begun or is completed (under the discretion of the Code Official). Walter 9944 Big Bend Dr. Indianapolis, IN 46234 RE: PROPERTY MAINTENANCE VIOLATION Dear Mr. & Mrs. Walter: This letter is being provided to inform you that it has recently been brought to the City's attention that the structure at 210 Walter St., a property listed under your ownership, is in violation of Carmel City Code §6-220, § 6-88(c). The following are the sections of code in violation: (1) §6-222 (a) 4 Vacant structures and land. All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure, healthful and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety or violate the provisions of this Code. (2) §6-222 (b) 1 Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The owner or occupant shall keep that part of the exterior property, which such occupant occupies or controls in a clean and sanitary condition. (3) §6-222 (c) 1 General. Prohibited property conditions include those conditions defined by Chapter 6, Article 5, Division I Public Nuisances of the Carmel City Code. (8) §6-222 (c) 12 Window, skylight and doorframes. Every window, skylight door and frame shall be kept in sound condition and in good repair. (9) §6-222 (g) 3 Interior Surfaces. Floors, walls (including windows and doors), ceilings and other interior surfaces shall be maintained in good, clean and sanitary condition. Peeling paint, cracked or loose plaster, decayed wood and other defective surface conditions, including mold spores, shall be eliminated. (10) §6-222 (g) 6 Free from Dampness. In every building and all portions of the building including, but not limited to, basements and crawl spaces shall be maintained to prevent conditions conducive to mold formation, decay or deterioration of the structure. (c) Requirement to cut. All owners of real property ("property") located within the City shall cut and remove weeds and other rank vegetation growing thereon that exceeds an average height of six inches, and shall keep their property clear of debris. Additionally, there are 2 open pits on the property that need to be permanently secured. I requested you to temporarily secure them and you accomplished that task already. Please make the required corrections and/or repairs to the structure by May 15, 2007. Failure to comply will result in further enforcement action.
