It is a violation of Carmel City Code § 6-114 which states: "Because of the danger to the health from vermin, the danger of personal injury to children attracted by such vehicles, danger of fire by the storage of gasoline and oil thereon, any abandoned, unlicensed, inoperable, disassembled, wrecked or junked motor vehicle on any street or public property for more than five days or upon any private property for more than 15 days, except as hereinafter provided, is declared to be a nuisance and unlawful." The vehicle located in your yard can be stored inside a completely enclosed garage legally. If it continues to remain where it is now located, further enforcement action may result, which can include having the vehicle towed from the property. Furthermore, this letter is being provided to inform you that the property in question is also in violation of the Home Occupation Standards of the Carmel Clay Land Use Regulations. This property is currently zoned residentially (R2), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards of §25.18 and the Sign Ordinance §25.07.02- 03 of the Carmel Zoning Ordinance The nature of the home occupation standards is to allow a home,- business to operate with NO visible evidence or impact upon the property's residential character. Window and wall signs for a cosmetology salon are not in keeping with the unobtrusive nature with which home based occupations are intended to operate. An inspection was performed on the property on April 21, 2009. On this occasion, a small window sign, a wall sign, and a credit card sign on the front door were observed. All of these are violations of the Ordinance and must be corrected by the removal of the signs, or the grant of Architectural Dersign, Lighting, and Signage (ADLS) approval from the Carmel Plan Commission and the issuance of a permit for the signs. If you wish to seek more information about ADLS approval, please call the City's Planning,; Department at 317-571-2417. In the meantime, however, the signs must r be removed from the structure. Failure to abide by the conditions of the Ordinance will result in additional enforcement action, up to and f including written citations and the requirement for you to appear in Carmel City Court. - A reinspection of the property will be performed on May 7, 2009. If at this time the signs have not been removed and the vehicle has not been plated and restored to an lt)W operable condition, additional enforcement action will ensue on both' fronts, including having the vehicle removed from the property and the issuance of a citation for the signs.
