Thank you for the plans. Here are my review comments:
Species: please choose another species for one of the maple trees. The sugar maple will probably do better for you
in this situation (you have too many of the genus for good diversity - 20%). Unless you have some abnormal soil
for the area, the pin oaks are not a good choice, they are acid-lovers. Bur oaks or regular swamp white oaks would
be a better choice. And I think you want to specify trees that are a minimum of 2.5 inches in caliper (which would
be measured at six inches in height at that size).
Please make sure that your planting detail matches the points of the one I have provided, especially root flare
planted at grade level.

We have reviewed the use variance request submitted to the Hamilton County Surveyor's Office
on March 23, 2009, for this project and have the following comments:
1. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of
Carmel.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project does not fall in a Hamilton County Regulated Drain Watershed.
4. Hamilton County Surveyor's Office has no objections to the use variance.

Dear Mr. Gleissner:
The City received the construction plans for this project which is scheduled for review at the April I5, 2009
Technical Advisory Committee meeting. We offer the following comments:
GENERAL INFORMATION
1. These comments represent the Department of Engineering's first review of the construction
plans for this project.
2. We request that al] responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted,particularly ifany such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a se[ of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All ofi site easements necessary to install utilities to serve [he development are secured.
e. SWPP is approved.
f All fees are paid.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Permii is required prior to commencing any earth
disturbing activity.
8. An approved right-of-way permit is required prior to commencing any work in the public
right-of--way.
9. if it will be necessary to relocate existing utilities, [he costs for such relocations are to be
borne by the developer. If it will be necessary to relocate existing utility poles, they must be
relocated to within one foot of the proposed right-of--way.
] 0. The Department requires that the construction drawings be developed in accordance with the
City of Carmel digital submission standards and that all required submittals for primary plat,
secondary plat, and construction drawings be made. The digital files must be submitted to

the Department of Engineering prior to the approval of the construction plans. Please contact
the City GIS Department for the requirements.
Il. Jurisdictions:
a. The project site is located within current City of Cannel Corporate Limits.
b. Streets and Right of Way -City of Carmel (West Road)
c. Water -City of Carmel Utilities service area.
d. Sanitary Sewers -Clay Township Regional. Waste District service area.
e. Storm Sewers/Drainage -Hamilton County Surveyors Office & City of Carmel.
f Legal Drains -Hamilton County Surveyor's Office.
12. Drawings submitted for approval:
a. The design engineer must certify all drawings submitted for final approval.
b. This office will require 5 sets of drawings for approval afrer all issues have been
resolved. The drawings will be stamped as approved and signed by the Ci[y Engineer.
The Owner will receive 3 sets, one of which must be maintained on the construction site
at all [itnes. If this project is subject to review and approval by the Hamilton County
Surveyor's Office, a total of 7 sets will be required for final approval.
13. Cannel Utilities will provide separate reviews of this project for water issues if applicable. If
applicable, please assure that copies of all drawings are sent to:

BOARD OF PUBLIC WORKS AND SAFETY
16. A schedule for Board of Public Works and Safety meeting dates and agenda deadlines will be
sent electronically for your use upon request. Please use the Engineering Department
deadlines for submissions to the Board.
17. Any submission to the Board requires prior approval by [he Carmel Clay Plan
Commission and/or the Board of Zoning Appeals (if applicable) and completion of
review by the Technical Advisory Committee. All written requests to be placed on the
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable).
18. I[ does no[ appear that the project will involve water service. Therefore, Water Availability
approval from the Board will not be required.
19. Commercial Curb Cut Approval - It appears that this approval will not be applicable to this
project unless the temporary construction entrance will become a permanent entrance.
20. The Temporary Construction Entrance indicated ort Sheet C3.0 will require Board approval.
Please provide a letter of request for approval to [his office and include an 8'/~ x I 1 exhibit of
the temporary entrance including all pertinent data associated with the entrance.
21. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated
easements requires the execglion of a Consent to Encroach Agreement between [he Owner
and the City of Carmel. Such agreements are executed by the Board of Public Works and
Safety. The City Engineer may approve irrigation system agreements.

22. Secondary Plat approval ifapplicable. All performance guarantees must be posted prior to
submission of secondary plats for Board of Public Works and Safety approval.
23. Dedication of Right of Way if not platted. This is based upon the City of Cannel 20-Year
Thoroughfare Plan requirements. Dedication documents are available upon request.
24. Any open pavement cuts of West Road will require Board approval.
BONDING REQUIREMENTS
2i, Upon initial review it appears performance guarantees shall be provided for the followine:
a. Right of Way hnprovements including removing high-points and re-grading swales,
replacing culverts, temporary-construction entrance/restoration, etc.
b. Erosion and Sediment Control and Storm Water Quality. Please contact John Thomas,
Engineering Department Construction Inspector, for details regarding engineer's
estimates/performance guarantee requirements for these items.
26. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cos[ of labor and materials [o construct [he individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc.
27. Upon completion and release of individual Performance Guarantees, athree-year
Maintenance Guarantee will be required (see Street Sign comments above). The
Maintenance Guarantee amount is based upon I S% of the Performance amount for Streets
and Curbs and 10% of the Performance amount for all other improvements.
28. Performance Guarantees may be Performance or Subdivision Bonds or Irtevocable Letters of
Credit.
29. Please reference [he enclosures for more detailed explanation of our procedures.
RICHT OF WAY PERMIT AND BONDING
30. Any work in the dedicated right of way of West Street will require an approved Right of Way
Permit and a License & Penni[ Bond.
31. The bond amount is determined by our Right of Way Manager. However, if the work is
included in the scope of work of a required and posted Performance Guarantee, the
Perfornance Guarantee maybe used to satisfy the bond requirements of the Right of Way
Pernti[.
33. Please contact our Right of Way Manager, Fred Glaser, [o arrange right of way permitting
and bonding.
AVAILABILITY AND CONNECTION FEES

Since it appears that this project will no[ require water service, Water Availability Fees,
Water Connection Fees and Development Application Review Fees will no[ be applicable to

Connection and Availability Feeswill be assessed based upon [he size and usage of the
system and upon the recommendations ofthe Director of Carmel Utilities.
CONSTRUCTION DRAWING REVIEW COMMENTS

Ordinances.

review [he Department's construction requirements, staff notification requirements,
required inspections for certain stages of the work and [o review the authority of the
Department as it relates to work within the existing and proposed City right-of-way.

After discussing this with the Plan Commission /BZA attorney, it is most likely that this item will need Special Use
approval from the BZA. However, this petition can heard by the BZA hearing officer, which is a faster process, has a
lesser application fee, and public notice is 10 days prior, rather than 25 days. Christine can work with you on that.
The Planning Director will not be in until April 7, and then we can let you know the final determination, but it also seems
that he thinks SU approval is needed based on previous email conversation.

The site is located at 12351 West Rd. and
I have sent packages to all TAC members. Please do keep me in the loop regarding a need for a variance. If it helps
any, the existing golf holes and the proposed ones are only for the use of the property owner and his guests. There will
not be any access for the general public or any type of Country Club operation. The guy apparently likes to play a few
holes of golf when he gets home in the evenings and that's really the extent of the operation.

Right now you are slated to be on the April 15 TAC meeting agenda.
The Director may determine that this item also requires Special Use approval from the Board of Zoning Appeals
(BZA) for the golf course/private recreational facility, as specified by the zoning ordinance Appendix A. This
would then become a public hearing approval process, rather than an administrative review process. I will keep

In my review of the plans, there is not an overall landscape plan like there would normally be for a commercial

Good morning, Duan:
your client will need a Special Use approval from the Board of Zoning Appeals (a public hearing process), in order for your
client to have a private golf course/private recreational development on an S-1/Residence zoned property. Attached are
the Special Use application, instruction sheet, and BZA calendar. Items that need to be submitted will most likely have to
be site plan and things similar to what you will submit to Amanda Foley in the Carmel Engineering Dept, such as drainage
calculations, a site plan with topography/land elevations, etc.
Right now, you will have to appear before both the Technical Advisory Committee (TAC) and BZA as part of the approval
process for a Special Use approval.

Hi Mike - I am not so sure we can require special use BZA approval for a golf course (at least 9 holes) or a private
recreational facility at this property.... Neither of the definitions really fit. I think the contractor said it has 5 holes & 5
greens. Could you make a director's decision? Or should we send it to TAC only for approval?
