I apologize for the delay in my response to your email. I agree with the requirements of
the study and David's email. I agree that it would be difficult to assume a growth rate on
this roadway considering how quickly the traffic reached the original design volumes
If we will exclude the mainline traffic projections in the analysis, will it be assumed in
the analysis that there is no growth rate of traffic on 146th Street and that existing
conditions will be used? My expectation would be then that the peak traffic from full
build out of this site must be used in the analysis, even if this is not expected to occur
for some time. Please verify if this is the case.
We assume that the traffic analysis will include the proposed Gray Road intersection and
indicate its effect on the level of service of the 146th Street/Gray Road intersection as
requested by Robb Chadwell of the Hamilton County Highway Department at the TAC meeting.

Changes have taken place since this project was initially discussed. The major change is
the resolution, the attachment, passed by the Board of Commissioners. We worked with you
to find what we felt was the best solution, however, it was never permitted. Since no
approvals were given at that time, it must now go to the Board of Commissioners for any
approvals.

The traffic study must include the updated uses. The attachment includes the requirements
of the study and A&F has worked with us on similar studies, so they should not be totally
in the dark. As for the forecasts, our main concern is with a large development, such as
a multi-section subdivision, that could take many years to complete. I do not have a
problem excluding the 5 & 10 year projections. If you have any questions, feel free to

Hello:
I wanted to touch base with all of you regarding our proposed project at 146th Street and
Gray Road. We previously did a traffic study for the project in August 2007. At that
time, the proposal including 18,000 sf of retail along with 60,000 sf of office and a bank
outlot. The current proposal in for 75,000 sf of office plus a bank outlot.
It has been requested during the TAC process that we provide an updated traffic study. I
want to make sure I understand the scope of this update.
We would propose that we provide a traffic operation analysis that would update traffic
counts and analyze existing traffic along with traffic from our development. During the
last process, we identified that we would only have limited access on 146th Street with a
full access on Gray and determined the location of these access points, which I believe
was agreeable to both the County and City. Therefore, we will not need the extensive
access analysis presented previously. Also, our traffic engineer
(A&F) does not believe the 10-year forecast holds much validity given that the 146th/Gray
intersection is built out, the area is fairly well developed and right now with the
economy, no one can predict what a valid growth rate would be. Therefore, we would
propose not to include these forecasts in the update.
Can you let me know if you agree with the plan above and, if not, what additional
information you would like to see?

Sorry for any confusion on this. We have listed Billy Price as the owner and we submitted his consent for us W file the
petition. He is still the owner and we just have an option on the property and would close following the rezoning. I
understand Darren just inserted our names into [he old letter but I am afraid that it will appear HV has been non-responsive
if the letter as drafted is par[ of [he tile. We were just informed of the issue this week and as I mentioned we will get it secured
ASAP to avoid any entrance into the property.
I do understand all the issues with the structure and we will try to work with the property owner [o get it remedied right
away. I understand that it will reflect on us whether we like it or not given our current rezone petition. Billy Price lives most
of the time in the Canadian country in a very remote fishing location. We do not even have a direct mrmhcr for him. We have
to contact an outpost that he checks in with every so often. So, we will do our best to get in touch with him but it often takes
some time to hear back.

Hi, Kelli -this letter was more to show what sections of the ordinance are being violated. The deadline dates were the old
expiration dates sent to the original property owner, I think. Also, your plans submitted for the rezone states that you
(hearthview) are/is the property owner of the site, and that is why we thought to send you the violation letter next, since
Darren was not having much luck with the first property owner. Are you on contract to own/buy the land if the rezone is
approved?

We have been out to look at it but with the weather haven't been able to get much done. i never have received

the attached letter and the dates on the letter are now already expired so I do hope this does not go into some file
that can be used against us at a later date (especially since we are not the owner). if this will be kept in the
property file, t would request that you note on the letter that we are not the owner and provide future dates for
completion (i.e. March 21 deadline has expired).
As Darren mentions, we are not the property owner so while we are willing to secure it to make sure people
cannot enter we should not be responsible to raze the stnuture as required in the letter. We will work to contact
the property owner to inform them. Again, I just ask that since we are not the owner of the property we are not
vilified for the condition of the house on it. However, we will do our best to get it secure ASAP. I was told it
would happen this week but will confirm when that is done.

In order to avoid Enforcement action by the City, please obtain a demolition permit by Aprfl
24, 2009, in order to have the structure razed. Also, please have all access points (doors, first
floor windows) on the property secured by March 21, 2009. Failure to do so will result in
enforcement action by the City to include daily citations (as long as Code violations persist),
mandatory appearance in Carmel City Court, and/or remediation of these violations by the
City at the property owner's expense (plus, administration costs).
