We DO NOT support the curb cut request by Kite for 146th St access. We have worked with Kite for several months to address our concerns with lighting, noise, hours of operation, access etc. Given the current and future state of commercial azeas surrounding Danbury Estates, we feel this development will be the least intrusive of all possible commercial use. Access to the site from Lowes Way is acceptable to the Highway Department. Access from 146`" Street has not been approved by the Hamilton County Commissioners. Stormwater drainage is subject to the review and approval of the Hamilton County Surveyor. At this time we are not aware of any outstanding issues with the Surveyor's office. We have not received any additional comments from the Carmel Department of Engineering nor are we aware of any outstanding issues. Construction plans will be submitted in due course upon approval of the project by the Plan Commission and the rezoning of the site by the City Council. 2. The current plans for the upgrade of U. S. 31 do not utilize Lowes Way for entrance onto or exit from U.S. 31. The current lane configuration will be modified to add a new left turn lane for southbound traffic to enter the site. The proposed access to the site from Lowes Way will not otherwise affect current or future southbound traffic on Lowes Way. 3. Access to 146`" Street has not been resolved with the County. Therefore, the project and development plan are being submitted to the Plan Commission with access to the site from Lowes Way. Should access to 1461h Street be approved in the future, Kite Realty Group will revise the Development Plan accordingly. 4. We received comments from Scott Brewer of the Forestry Department on April 30. The deadline to submit revised plans for the Committee was April 24. The comments and recommendations of the Mr. Brewer are acceptable. The landscape plan will be revised to satisfy his requests for: alternative shade tree species; clarification of shrubs bordering the parking area; additions to the plant schedule; and notation for tree protection on the demolition plan. ~~. A copy of the Adjacent Property Owners List was filed with the Department on March 12, 2009. ~~. There are no proposed commitments or covenants at this time. The 146'h entrance still shows on the landscape plan. If it is not approved by the Hamilton County Highway Department, I would suggest that it could possibly be left as an emergency entrance only marked by bollards, low shrubs, and grass pavers, so that the landscaping appears to go across it but it can be driven on by emergency vehicles. 2. Crossing the mitigation area along Lowe's Way with a drive may require access and permission from the State of Indiana and/or Hamilton County. Could you please supply me with copies of their letters of grant if any are required. 3. Please make sure that the revisions have been also cleared by the City of Carmel's Engineering Department. 4. The new extended drive is lined on the west side with 14 Princeton elms. Because of the elms' historical battle with disease in Indiana, please choose a significant alternative shade tree species such as Quercus macrocarpa - Bur Oak, Quercus coccinea -Scarlet Oak, Quercus imbricaria -Shingle Oak, Quercus rubra -Northern Red Oak or perhaps Platanus x acerifolia -London Planetree 5. There is a row of shrubs that border the south and east side of the parking lot. It is unclear which side of the wall they area on (or if there is a wall) on the landscape plan. Can you explain the layout or provide a view from that angle? 6. There are 27 shrubs along this line tabled Pan-v. That label does not appear on the plant schedule. Please correct this. 7. Add a note to sheet C2.3 that directs the installation of the tree protection fencing before the silt fence, and that it remain in place for the length of construction activity. A similar note should be added to the demolition plan as well 8. Although Acer saccharum, sugar maple is a fine shade tree, it usually does not do well over time in areas of limited soil volume and high urban heat (parking lots). Level of Service of 146`" Street for any access or change of access use to be considered. The Operatidns Analysis does not show any improvement over the existing Level of Service of 146' Street. It shows improvement only if the development occurs and the 146`" Street access is allowed as opposed to a single access on Lowe's Way. The 146' Street access will not be considered. In regards to the Lowe's Way access, you must first contact IDEM for approval to cross the mitigation wetland. The Highway Department will not issue any approvals until IDEM has granted that crossing. If IDEM allows you to cross the wetland, we will require a detailed set of plans to review at that time. The design submitted on 2/26/09 does appear to correct the deficiencies in the initial submittal. HCSO would like Drainage Calculation that support this theory, either in the form of Drainage Calculation from a past project that prove this was accommodated or new calculations that prove the new 100 year elevation of the Danbury Estates pond does not have a negative impact on homes or surrounding roads. 8. Please make sure to use appropriate erosion control/energy dissipation practices to prevent the storm outlet pipe from creating a channel across the floodplain mitigation shelf in the Danbury Estates basin. If the water can not be slowed down to prevent a channel forming by erosion, then consider an engineered channel from the pipe outlet to the normal pool of the pond. 9.
