ORDINANCE NO.
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance to establish Development Plan and Architectural Design, Exterior Lighting,
Landscaping &Signage control within the S-1, S-2, R-1, R-2, R-3, R-4, R-5 /Residential District.
WHEREAS, the Common Council of the City of Carmel finds that it is reasonable and
necessary to the establishment and maintenance of an economically sound and stable industrial
zone for the protection of the public health, safety and welfare of the citizens of Carmel and Clay
Township to amend the Zoning Code of the City of Carmel and Clay Township; and
WHEREAS, the lack of aesthetic azchitectural design guidelines in the S-1, S-2, R-1, R-
2, R-3, R-4, R-5 /Residential District poses a threat to the protection of the general welfare of the
public, the natural beauty and aesthetic values of the community, and enhancement of the built
environment of the City of Carmel and Clay Township; and
WHEREAS, IC 36-7-4-601(d)(3) authorizes the legislative body to designate zoning
districts in areas having special development problems or needs for compatibility in which a plan
commission shall approve or disapprove development plans under the 1400 series of IC 36-7-4;
and ensure that a development plan so approved is consistent with the comprehensive plan and
the development requirements specified in the zoning ordinance; and
WHEREAS, IC 36-7-4-1401.5 authorizes the legislative body to designate zoning
districts in which a development plan is required as a legislative act;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section I:
a. Adopt Section 06.08: Plan Commission Approval to read:
06.08 Plan Commission Approval.
A. Develoument Plan. The Commission shall review the Development Plan (DP) of any
proposed use of any Lot or pazcel of ground located within the corporate limits of the City of
Carmel, Indiana, and within a residential district prior to the issuance of an Improvement
Location Permit by the Department. Once approved by [he Commission the Development
Plan (DP) shall not be materially or substantially changed or altered without the prior
approval of the Commission. The Development Plan shall address the comprehensive
arrangement of land uses, buildings, landscape areas, road and parking areas in accordance
with harmonious and aesthetic principles of the ADLS.
B. Architectural Design. Exterior Liehtine. Landscanine and Sienaee. To insure the
compatibility of the proposed use with adjoining areas, the Commission shall review the
Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) application of any
proposed use of any Lot or pazcel of ground located within the corporate limits of the City of
Carmel, Indiana, and within a residential district prior to the issuance of an Improvement
Location Permit by the Department. Once approved by the Commission the Architectural
Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or
substantially changed or altered without the prior approval of the Commission.
b. Adopt Section 06.09: Architectural Guidelines to read:
6.08 Home Architectural Design Guidelines
6.08.01 Roofing Elements
A. Ridge Lines
1. Shall be a minimum of three (3) per main stmcture
2. No maximum requirement
B. Roof Planes
1. Shall be minimum of three (3) per stmcture
2. Shall be a minimum of one (1) must be perpendicular to the front of structure
C. Overhangs
1. Minimum of five inches (5")
2. Maximum of twenty inches (20")
3. Required wherever the edge of a roof plane meets the vertical side of the
stmcture
D. Roof Pitch
1. All roofing planes must meet at the same pitch throughout a structure
2. Minimum Pitch:

E. Roofing Materials
1. Shall be of the same product, type and style throughout the structure
2. Shall be shades of either brown or black
3. Multiple colors shall not be used in conjunction with one another.
4. Shall be asphalt
5. Shall be symmetrically shaped.
F. Equipment Vents
1. Shall be visible from the side and rear of the home only
2. Shall be the same color as either the window accents or siding material
6.08.02 Foundations
A. Shall not be visible or exposed at any point on the stmcture
6.08.03 Facades
A. Windows
1. Shall make up a minimum of five percent (5%) of the total frontage
2. Shall not make up more than twenty-five percent (25%) of the total exterior
facade
3. Shutters or architecmral accents must be used around each window and must
be a color complimentary to the siding color or material
4. Main windows shall be a square, rectangle or circle
5. Accent windows shall be any variety of geometric shape
B. Siding Material
1. The facade must be a minimum of twenty-five percent (25%) masonry
2. The masomy portion of the home must be brick or natural stone (limestone)
3. Shall be a minimum of two (2) materials throughout home
C. Corner Breaks
1. Shall be a minimum of three (3) per facade
2. Shall be a maximum of ten (10) per facade
3. Each break shall be at a minimum of forty-five (45) degrees
D. Color
1. Shall be a minimum of two (2) colors throughout structure
2. Shall be a maximum of five (5) colors used throughout stmcmre
3. Each new material shall be considered a new color
4. There shall be no color variation per each architectural element (all window
shutters shall be the same color, all roof planes shall be the same color etc...;
6.08.04 Garaee /Garaee Door
A. Percentage of Frontage
1. Shall not cover more than twenty five percent-(25%) of the frontage of the
home

B. Setbacks
1. Shall be setback from the front line of the home by two (2) feet
2. Shall be setback from the sheet curb by twenty-five feet (25')
C. Total Area
1. Shall hold a minimum of two (2) cars or be aminimum oftwo-hundred and
twenty (220) square feet
2. Shall not hold more than four (4) cars or be over amaximum ofsix-hundred
(600) square feet
6.08.05 Porches
A. The squaze footage of a porch on the front of a home shall not be larger than twenty
percent (20%) of the total square footage of the home
B. A porch or deck on the side of the home shall be setback ten feet (10') from the lot
line
C. A porch or deck attached [o the rear of the home shall not cover more than twenty
percent (20%) of the back yard.
c. Adopt Section 06.10: Subdivision Design Guidelines to read:
6.08 Subdivision Architectural Guidelines
6.08.01 SheetLiehts
A. Street lights with working compact florescent light bulbs shall be installed by the
developer
B. Shall be lit from dusk to dawn
C. Shall be located two and one half feet (2 ''/z') from the street curb
D. Shall be installed along every street at twenty feet (20') increments
E. Shall be maintained by [he Homeowners Association
6.08.02 Fences
A. Front yard
1. Minimum Height: two feet (2')
2. Maximum Height: three and one half feet (3 'h')
B. Side Yard
1. Minimum Height: three feet (3')
2. Maximum Height: five feet (5')
C. Rear Yard
1. Minimum Height: four feet (4')
2. Maximum Height: six feet (6')
D. Wood, vinyl, masonry and metal shall be permitted fencing materials
E. Split rail, picket, privacy and decorative fences shall be permitted styles
F. Chain link fences shall be prohibited
G. Privacy fences shall only be permitted along the rear of a lot
H. All setback regulations shall apply to fences
6.08.03 Mail Box Desien
A. Posts shall be constmcted of either wood or stone
B. Shall be identicalthroughou[the neighborhood
C. Homeowner shall accept liability for the replacement of any mailbox damaged by a
city vehicle
D. Shall comply with the U.S. Postal Service Mailbox Regulations
6.08.04 Porch and Coach Liehtine
A. Shall use compact florescent bulbs
B. Shall be lit from dusk to dawn
C. Shall be setback a minimum of twenty feet (20') from the street[
D. Shall allocate a minimum of one per entryway
E. Shall not install more than ].5 fixtures per entryway
6.08.05 Stmctural Diversiri
A. Adjacent structures shall not have a difference of square footage greater than twen[y-
five percent (25%)

6.08.06 Driveways
A. Shall be a minimum length of twenty feet (20') after the sidewalk
B. Shall be a minimum width of twenty feet (20')
C. Shared drives shall be prohibited when accessing front loading garages
D. Four-hundred (400) square feet closest to [he garage and four-hundred (400) square
feet closest to the sheet shall be made of concrete, brick or stone. Areas in-between
these portions shall be concrete, brick, stone or blacktop.
6.08,07 Pedestrian Orientation
A. Sidewalks shall line all streets
B. Sidewalks shall be a minimum of five feet (5') in width
C. Sidewalks shall be no less than five feet (5') and no more than ten feet (] 0') from the
street curb
D. Handicapped curb cuts shall be made at all sidewalk and curb intersections
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section III: This Ordinance shall be in full Force and effect from and after its passage and
signing by the Mayor.
