ORDINANCE NO.
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance to establish Development Plan and Architectural Design, Exterior Lighting,
Landscaping &Signage control within the S-1, S-1, R-1, R-2, R-3, R-4, R-S /Residential District.
WHEREAS, the Common Council of the City of Carmel finds that it is reasonable and
necessary to the establishment and maintenance of an economically sound and stable industrial
zone for the protection of the public health, safety and welfare of the citizens of Carmel and Clay
Township to amend the Zoning Code of the City of Carmel and Clay Township; and
WHEREAS, the lack of aesthetic architectural design guidelines in the S-1, S-2, R-1, R-
2, R-3, R-4, R-5 /Residential District poses a threat to the protection of the general welfare of the
public, the natural beauty and aesthetic values of the community, and enhancement of the built
environment of the City of Carmel and Clay Township; and
WHEREAS, IC 36-7-4-601(d)(3) authorizes the legislative body to designate zoning
districts in areas having special development problems or needs for compatibility in which a plan
commission shall approve or disapprove development plans under the 1400 series of IC 36-7-4;
and ensure that a development plan so approved is consistent with the comprehensive plan and
the development requirements specified in the zoning ordinance; and
WHEREAS, IC 36-7-4-1401.5 authorizes the legislative body to designate zoning
districts in which a development plan is required as a legislative act;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section I:
a. Adopt Section 25.01.01 B: Architectural Standards to read:
B. Architectural Standards. To insure the compatibility of [he proposed use with adjoining areas,
the Commission shall review the Architectural Design, Exterior Lighting, Landscaping and
Signage (ADCs) application of any proposed use of any Lot or parcel of ground located
within the corporate limits of the City of Carmel, Indiana, and within a residential district
prior to the issuance of an Improvement Location Permit by the Department. Once approved
by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage
(ADCs) shall not be materially or substantially changed or altered without the prior approval
of the Commission.
a. Any accessory stmcture constmcted on the lot shall be similar to the main stmcture
in all facets including but not limited to: roof pitch, roofing materials, roof style,
equipment vent placement and style, foundation, window accents and shape, siding
material (proportionally), color and lighting.
b. The accessory s[mcture shall comply with the following:
i. Shall have a minimum of one (1) ridge line per stmcture
ii. Shall have a minimum of two (2) roof planes per structure
iii. Overhangs shall not be less than five inches (5") or greater than ten inches
(10") and shall exist wherever a roof plane meets a vertical side of the
structure.
Section II: All sections following the inserted amendment shall follow the correct numbering
and lettering system, typical to the Zoning Ordinance
Section III: Al] prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section IV: This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.
Ordinance No. PASSED by the Common Council of the City of Carmel, Indiana
this day of , 2003, by a vote of ayes and nays.
