ORDINANCE NO. Z-xxx-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance to establish Architectural Design review and control
within all Districts for new construction.
WHEREAS, the Common Council of the City of Carmel finds that it is reasonable and
necessary to the establishment and maintenance of an aesthetically sound and stable community
for the protection of the public health, safety and welfare of the citizens of Carmel and Clay
Township to amend the Zoning Code of the City of Carmel and CIay Township; and
WHEREAS, the lack of aesthetic controls in all Zoning Districts poses a threat to the
general welfare of the public, the natural beauty and aesthetic values of the community, and
enhancement of the built environment of the City of Carmel and Clay Township; and
WHEREAS, IC 36-7-4-601(d)(3) authorizes the legislative body to designate zoning
districts in azeas having special development problems or needs for compatibility in which a plan
commission shall approve or disapprove development plans under the 1400 series of IC 36-7-4;
and ensure that a development plan so approved is consistent with the comprehensive plan and
the development requirements specified in the zoning ordinance; and
WHEREAS, IC 36-7-4-1401.5 authorizes the legislative body to designate zoning
districts in which a development plan is required as a legislative act;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section I:
a. Adopt Section 26.5: Plan Commission Approval to read:
26.05 Plan Commission Approval.
A. Architectural Desien. To insure the compatibiliTy of the proposed use with adjoining
areas, the Commission shall review the Architectural Desi n a lication of an~~~pro osed
use of any Lot or parcel of ground located within the m,,.. l ~ .t~l~~ ~.
Indiana, and within a Residential District prior to [he issuance of an
Improvement Location Permit by the Department. Once approved by the Commission
the Architectural Design shall not be materially or substantially changed or altered
without the prior approval of the Commission.

BOARD OF COMMISSIONERS MEETING
On May 2, 2001, the Board HELD FOR 60 DAYS the applicant's petition to allow the applicant
and community time to resolve differences over construction materials, unit size and ]ot size. The
applicant and community have agreed to prohibit the use of vinyl siding, increase the minimum
unit size to 1,700 square feet and increase the minimum lot size to 9,000 square feet. Staff will
reflect these agreements in the Recommended Conditions.

Woman fights for right to have vinyl siding on home BY MARK WINEKASALISBURY POST
Mary Alexander Tate's efforts to instal] vinyl siding on her house at 800 N. Main
St. hit another snag Monday, although the city has offered her an interesting alternative. The
Salisbury Zoning Board of Adjustment voted 4-1 Monday against a variance to allow the vinyl
siding.But Tate may qualify for a city program that offers to pay at least the cost of the paint for
her house. Tate said she's interested in that option if her insurance would cover volunteers to
paint her home. Otherwise, she would still prefer the one-time, costlier expense of vinyl siding to
the prospects of painting her 1912, wood-sided house every five or six years. Tate's house lies
within the local North Main Historic District. Significant changes to the exterior of properties in
a local district (Salisbury has three) must be approved by the Historic Properties
Commission. The commission denied Tate's request for vinyl siding July 8, based on both U.S.
Department of Interior standards and Salisbury's own local historic district guidelines. Though
several passages apply, the design guidelines for Salisbury historic districts state specifically: "It
is not appropriate to replace or cover wooden siding or trim with a substitute cladding material
such as aluminum siding, vinyl siding or brick veneer." Zoning Board of Adjustment member
Jeff Smith said he was sympathetic to Tate's request. He told her she has a lovely home with lots
of charm, but he expressed concern that it would lose that charm and its historic value if
covered by vinyl.He added that the Zoning Board, as did the Historic Properties Commission,
must look at her case within the guidelines spelled out in the city's zoning ordinance. That
ordinance says no vinyl siding, he noted.Smith said the ordinance serves an important role in
protecting Tate and all of Salisbury beyond just the isolated question of siding.Tate learned only
Friday of the city's offer to recommend her for the Community Development Department's paint
program, which might buy new paint for her home. Fixing rotten boards and hiring someone to
paint the house would be her responsibility, Zoning Administrator Hubert Furr said."The city has
offered you a way out," Zoning Board Chairman Arthur Steinberg told Tate. "... It's up to you
whether you accept the kindness of the city of Salisbury."Tate said if her home insurance would
not cover the possibility of volunteers' painting her house, she would take her case to Salisbury
City Council. The city needs to provide a hardship clause in its historic district guidelines
for people who can't afford to make improvements fitting in the stricter standards, she
said."I would like to see a kinder, gentler Salisbury that would put people before houses," Tate
said, adding that she has lived in her house for 20 years, while the historic district has only been
in place for about five. The Zoning Board members encouraged her to make her concerns known
to the mayor and council. Tate said vinyl siding would cost her $14,000 to $15,000, while
painting would cost about $10,000. But vinyl siding makes more sense because the house would
have to be painted again in five to six years, she said.Karen Alexander, chairman of the Historic
Properties Commission, testified on why her commission reached its mling and also made the
case against vinyl siding over existing wooden siding in historic districts.Overall, vinyl siding
significantly damages the historic character of a home, Alexander said. It costs more. It is not
maintenance-free and leads to moisture problems that would accelerate the original wood's
decay underneath, Alexander said.Alexander also contended that vinyl can shatter in the cold
and warp in hot weather.

3.0 ARCHITECTDRE
3.3 Exterior Materials
The Developer recognizes the dynamic nature of the building materials industry and recognizes
that building materials are constantly changing and improving. The ARC will consider material
options not listed below, that due to changes in the material or new materials, suggest better
options from either a cost, maintenance or aesthetic context which justify such reconsideration.
The following exterior materials are acceptable:
Brick -Earth tone colors. Bricks shall meet standard specifications established by The
Brick Institute of America.
Masonry -Natural stone, manmade stone and precast panels made from natural stone are
acceptable.
Mortar Joints -All mortar joints for brick shall be tooled. Sump will not be allowed.
Mortar color shall be selected to compliment stone or brick color.
Wood Siding -Stained in earth tone colors or painted in neutral colors. Horizontal
application only.
Hardboard Siding -Pre-finished. The use of plywood sidings is prohibited.
Vinyl Siding- Limited application, generally above the first floor elevation and on
soffits and gables.
Stucco - A recent trend in the building industry has repopularized the use of solid stucco.
While it is not the intentioti of the Developer or the ARC to prohibit solid stucco applications,
stucco in combination with brick or masonry is preferred.
Aluminum or Wood Windows -Bronze or white finish.
a. For historic residential or commercial buildings, aluminum or vinyl siding may be an
acceptable alternative only if:
1. the existing siding is so deteriorated or damaged that it can not be
repaired;
2. the substitute material can be installed without irreversibly damaging or
obscuring the architectural features and trim of the building; and
3. the substitute material can match the historic material in size, profile, and
finish so that there is no change in the character of the historic building.
4. In cases where anon-historic artificial siding has been applied to a
building, the removal of such a siding, and the application of aluminum
or vinyl siding would be an acceptable alternative, as long as the above
mentioned first two conditions are met.

AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance to establish residential Architectural Design controls for new construction within
all Districts.
WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in
IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances
must first approve by resolution a comprehensive plan for the geographic area over which it has
jurisdiction; and
WHEREAS, the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") Docket
No. 16-96 CP was given a favorable recommendation by the Carmel/Clay Advisory Plan
Commission on August 20, 1996, and duly adopted by Resolution No. CC-09-03-96-03 of the
Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of
the City of Carmel and Clay Township; and
WHEREAS, the Common Council of the City of Carmel finds that it is reasonable and
