ORDINANCE. D-1942-09
WHEREAS, there exists no designation of a City fund that will ensure that available
dollars are set aside for Carmel neighborhood drainage issues, specifically to correct drainage
problems attributed to developmental growth; and
WHEREAS, it is desirable to establish a "Non-Reverting Neighborhood Drainage
Improvement Fund" to accept and to disburse funds for the payment of improvements consistent
with the needs of Carmel neighborhoods; and
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section t : The foregoing Recitals are fully incorporated herein by this reference.
Section 2: That Chapter. 2, Article 4, of the Carmel City Code is hereby amended to add
a new Section 2-134 which shall read as follows:
"Sect. 2-134. Non-Reverting Neighborhood Drainage Improvement Fund #212
(a) There is established a Non-Reverting Neighborhood Drainage Improvement
Fund #212 to be used exclusively for the purpose of accepting and disbursing
monies received for City neighborhood drainage improvement projects.
(b) The Non-Reverting Neighborhood Drainage Improvement Fund shall be
administered and maintained as set forth herein:
1. The Non-Reverting Neighborhood Drainage Improvement shall be
managed.by the fiscal officer of the City as required bylaw;
2. The funds contained`in the Non-Reverting Neighborhood Drainage
Improvement Fund shall be received and deposited therein from all
lawful sources in accordance with applicable law;.
3. The funds contained in the Non-Reverting Neighborhood Drainage
Improvement Fund shall be accounted for and maintained separate and
apart from all other City funds, and shall be invested with the interest
eared thereon deposited into this fund; and
4, When Monies are deposited into the Non-Reverting Neighborhood
Drainage Improvement Fund, those fiords may only be spent on
drainage improvement projects located within each individual
councilmatic districts.

5. The. funds, held and accounted for in the Non-Reverting Neighborhood
Drainage,linprovement-Fund -shall-be expended only:
a. By a-majority vote of the Common Council;
b.'For the puipose:of improving"proper drainage:iiT the
neighborhoods of ourrbty;
6. The-life of the=Non-Reverting;Neigli borhood.Dramage Improvement
Fund_shallbe perpetual, unless;terminafed by subsequent ordinance."'
Sectiom3. That the'remaining,provisions of Canneltiiy Code. Chapter 2, Article 4, are
netaffected by this Ordinance and remain iirHull force and effect.
Section 4. If any portion of-this Ordinance is forsany,reason declared `to be,

Section 5: This Ordinance shall be-inYNll'fbrce and effect from and after its passage a_nd
