The technical review and commends are intended to evaluate the completeness of the erosion and sediment control plan for the
project. The erosion and sediment control plan submitted was not reviewed for the adequacy of the engineering design. All
practices included in the plan, as well as those recommended in the comments should be evaluated as to their feasibility by a
qualified individual with structural practices designed by a qualified engineer. The plan has not been reviewed for local, .state,
or federal permits that may be required to proceed with this project. Additional information, including design calculations may
he requested to further evaluate [he erosion and sediment control plan.
The erosion and sediment control plan has been reviewed and it has been determined that the plan:
X Satisfies the minimum requirements and intent of 327IAC 15-5 (Rule 5). Notification will be forwarded to the
Indiana Department of Environmental Management.
Proper implementation of the erosion and sediment control plan and inspections of the construction site by the developer or a
representative are necessary to minimize off-site sedimentation. The developer should be aware that unforeseen construction
activities and weather conditions might affect the performance of a practice or the erosion and sediment control plan. The plan
must be a flexible document, with provisions to mods or substitute practices as necessary.

On October 9, 2003 you sent us a list of observations, comments and requests resulting from your review of the
Hazel Dell Corner Lot 4 Phase II plans and calculations. The following list itemizes your comments and our
response.
Please note that there are many existing sign violations on the property; contact our department to address
prior to the Plan Commission Meeting.
Response: All non-conforming signs have been removed from the shopping center grounds.
2. Please add adjacent land uses and zoning to location map.
Response: See sheet C100.
3. Please provide a lighting plan with foot-candles; fixture cut sheet, and fixture locations.
Response: Alighting plan has been included, see sheet C105.
4. Please forward a copy of Urban Forester, Scott Brewer's approval letter for landscaping.
Response: We have forwarded a copy of these plans to Scott Brewer. They address his TAC meeting
request to add 5 shade trees and 6 ornamental shade trees. We will forward a copy of his approval letter
as soon as he sends us one.
5. Please show/state what you are amending on the development plan.
Response: We are adding a 5,100 square foot building on the north end of Lot 4 in Hazel Dell Corner
Shopping Center. It was shown as "Future Phase 2" in the original Development Plan. Plans show that we
will add 23 parking spaces adjacent to the new building. Building usage will be small retail/commercial
typical of the B-3 zoning district. Plum Creek Partners, LLC has agreed to not allow outdoor seating along
the north side of the proposed building.
6. Please provide a signage plan with size, location, materials, and elevations.
Response: We have enclosed a signage plan with this letter.
7. What is the building use?
Response: Small Retail/Commercial consistent with B-3 zoning.
8. Please label buffer yards.
Response: See sheet C101.

After your initial letter on October 10, we attended the Plan Commission Specials Studies Committee meeting.
The enclosed plans address also address comments we received at that meeting. These comments were as
follows:
The committee requested that temporary pedestrian access be provided from Hazel Dell Parkway and 131x'
Street to Lot 4. Response: Compacted stone paths are shown on the plans connecting 131st Street and
Hazel Dell Parkway to Lot 4.
2. A concern was raised about the potential for parking lot lighting to adversely affect adjacent residential
neighbors. Response: We added a note to the plans that all parking lot pole fixtures will be fitted with a
shield to prevent light from extending beyond the parking lot perimeter. Additionally, we agreed to remove a
pole fixture that was proposed at the north side of the parking lot. We agreed this was acceptable since
there are no parking spaces in that area.
3. Finally, a comment was made about the lack of traffic signs at the interior shopping center intersection.
Response: Plum Creek Partners, LLC has agreed to add stop signs at this intersection.

This office has reviewed the plans submitted for this project. We offer the following comments:
General Information
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
• Streets and Right of Way (Hazel Dell Parkway/East 131" Street) - City of Carmel
• Water, Sanitary Sewer, Storm Sewer -City of Carmel
• Mitchner Ditch -Hamilton County Surveyor's Office
3. Board of Public Works and Safety Approval Requirements:
• Water and Sanitary Sewer Availability (Connection).
• Any permanent improvement, including irrigation systems, to be installed in public right of way or
dedicated easements will require a Conseni to Encroach Agreement between the City and [he
Owner or Owners. If an irrigation system is planned, additional Water Availability will be
required from the Board.
I am enclosing a schedule of Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use [he Engineering Department deadlines for submission to the Board.
Any submission to the Board requires prior final approval by the Carmel Clay Plan Commission
anrUor the Board of Zoning Appeals and completion of review by the Technica[Advisory
Committee. All written requests to be ylaced on the Board's agenda nrrrst include Ere ayyropriate
Docket Numbers and the date (or dotes) of approval by the Plmr Commission and/or BZA.
4. Water and Sanitary Sewer Connection Fees:
• Connection Fees are based upon the average user factor tables from Section 9-35 (water) and 9-
200 (sanitary) of our Utility Ordinance. The Connection Fees are $1,3]0.00 per E.D.U. for water
and $795.00 per E.D.U. for sanitary sewers. Please indicate the intended use of this building in
order that appropriate Connection Fees maybe calculated I am enclosing copies of our Average
User Factors for Water and Sanitary Sewers and our current Fee Schedule.
Note: Any deviation from dre Connection Pee calcrdations listed in our Ordinance will require
Carmel Utilities and Board afPuhlic {Yorks mrd Safety approvals. Such requests must be

5. T.A.C. Review/Drawings submitted for approval: `
We request [hat all comments and comment letters generated by [his office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Carmel Utility issues must also be resolved. The
design engineer must certify all drawings submitted for final approval. This office will require a
minimum of five-sets of approved drawings after all issues have been resolved. The drawings will be
stamped approved and signed by both the City Engineer and Director Carmel Utilities. The
Developer/Owner will receive one-set which is to be maintained on the construction site at all times.
Carmel Utilities will receive two-sets. Our Public Works Inspector will receive one-set and one-set
will be maintained in the Department of Engineering. If more than five-sets are requested to be
approved, we will stamp and sign a maximum of seven-sets. The additional sets must be submitted
with the minimum required five-sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of
way or easements will require a Consent to Encroach Agreement behveen the Owner/Developer and
[he City of Carmel. This agreement requires review and approval by our Law Department and Board
of Public Works and Safety approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted diwctly for all water
and sanitary sewer locates.
8. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues.
9. I am including copies of the following items with this correspondence:
• Department of Engineering Commercial Project Approval Procedures.
• Department of Engineering Subdivision Requirements.
• Performance Release Procedure
• Permit Data, Contacts, etc.
• Commercial Permitting Procedures.
I will send a copy of our Residential Subdivision and Commercial Irrigation System Requirements
upon request.
]0. Performance Guarantees
Upon initial review, there do not appear to be any Performance Guarantee requirements for this
project.
Street Cut/Right of Nay Permit and Bonding Requirements
Upon initial review, there do not appear to be any requirements in this regard.
PROJECT COMMENTS
11. Connection Fees:
Please provide this office with detail regarding the ultimate use of this building. If retail or office
usage, please indicate to total square footage of the building.
12. Availability (acreage) Fees were paid with the development of Hazel Dell Corner and are not
applicable to this project.
13. The original building on this lot has a Consent to Encroach Agreement for various easement
encroachments. It appears that there will be additional encroachments associated with this building:
• A parking lot and drive encroach into a DU&SE on the east side.
• The drive and sidewalk behind the west side of the building encroaches into a DU&SE.
• The trash enclosure at the northwest corner encroaches into a Utility Easement.

15. There are concerns regarding grading and drainage, particularly around the north side of [he parking
area and the east side where it is really close to the detention pond. It appears that there is several feet
of drop of the curb elevation to the existing elevation of the overflow elevation of the pond. How can
[his occur without reducing the volume of the pond? This situation also continues around the north
side, very close to the county's easement. Please provide contours in these areas.
16. There are no easements shown on the site on [he east side. There is an easement along the sanitary
sewer main. It appears that there will be a need for a consent to encroach agreement.
The City Engineer has not reviewed these drawings. Therefore, we reserve the right to provide additional
comments, if required, upon her review.
The above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating al] revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of all moth&cations made on
the plans being re-submitted, particularly if any such changes are considered "ne~v" or fall outside of our
initial review.

Thank you for the notice of the public hearing in regard to the planned building on the Hazell
Dell corner, directly behind our home.
Has a tenant already dedicated to this space? What is the type of business will be moving in?
And, how does the developer plan to handle the environmental and privacy issues of building
so close to the creek and our commons areas? If you are able to give us, the property owners
on the corner lots of Delaware Commons, an idea of the scope of this development it would be
much appreciated.
A few of us plan to attend the public hearing on November 18, 2003. We are concerned with
its impact on privacy, landscaping, foot traffic through the neighborhood, traffic on Hazell Dell,
noise and, most importantly, the lighting. The lightning and landscaping with similar projects at
the corner and on Hazell Dell have been vastly different from what was proposed. For
example, the daycare was to have a privacy fence surrounding the play areas and they
amended their plan to a wire cyclone fence. The lighting still continues to glare at night at the
medical center. And the landscaping at the developments may look good in 15 years but does
little for our separation from the businesses at this time. Carmel's urban forester has also
stated that due to the developments poor site management, the large trees separating our
walk path and the daycare/medical center have been damaged to an extent that we can expect
them to start dying off in the next few years. This leaves us more vulnerable to business noise,
lighting issues and less privacy from a commercial venture.

I am writing, again, to inquire about what kind of business is scheduled for the development
on the north east corner of the Hazel Dell project.
This project will directly affect my privacy as an owner of a single home in the adjacent
Delaware Commons subdivision.
My husband and I walked the property and have a few questions. The foot print of the
proposed building and parking structures would bring the development to the edge of the
treeline at the creek. Is a privacy fence or berm planned to keep noise and fighting issues at
bay? What will be done to protect the large trees from damage? If we lose the mature trees
there will be no barrier to noise and car lights flashing us. Also, If a restaurant is planned...will
there be outside seating? We are concerned because there wasn't going to be outside seating
at Goodfellows and now there is music and party noise until the restaurant closes.
Please respond to this email with at least you are looking into my inquiries. Knowing that you
at least read it will be better than if you keep us in the dark until the meeting. There are several
concerned residents here in Delaware Commons and we would like to know you are receiving
