I concur with Dave's recollection. We believe the landscaping and BMP plan can be merged in a way that suits both of
our respective requirements. The original landscape vegetation is native species which can be used in conjunction with

Following up on our May 18, 2009 discussions with regards to the revised design of the Lowe's
Garden Center expansion, the enclosed plan shows:
(1) revising the landscape plan to incorporate trees, one in the front of the store and four along
the east wall to break up the expanse of brick and to soften the effect of a solid brick wall; and
(2) changing the lighting from pole lights on the outside to lights that are hung against the wall.
The reason for the revision in the lighting plan is due to the footings needed for a solid brick wall
which would prohibit the lighting poles from being located close to the wall as previously
planned. Since the new lights will be located towards the top of the wall and pointing down, the
lighting footprint will not change and, in fact, may be slightly reduced.
I anticipate receiving additional drawings with respect to the revisions and will be forwarding
those to you as soon as they are received. I also anticipate receiving an artist rendering which I
will also forward to you.
While I anticipate having full-sized plans, due to the intervening holiday, it may be difficult to
get those to you towards the end of next week as requested by Angie. Therefore, to keep this
matter moving forward, I may be able to only provide I P' x 17" copies of the plans, as well as a
reduced artist rendering for the members of the committee. We will have afull-sized artist
rendering for the hearing and I am hoping to have an extra copy of the full-size rendering to
deliver to you this week.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Office on
April 27, 2009, for this project and have the following comments:
l . The proposed project falls in the incorporated area and MS4 jurisdiction of the City of
Carmel.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in Cool Creek Regulated Drain Watershed.
4. Since the proposed plans is for the Garden Center Expansion over existing impervious area
that has a designed detention system, HCSO has no concerns with this project and will not
require any permits.
5. Please consult with Carmel Engineering for any Phase 11 requirements or other permits.

The applicant seeks design approval for a garden center expansion. The site is located at 14598 Lowes Way
and is zoned PUD/Planned Unit Develo ~ment. Filed by Peter Velde of Kightlinger & Gray, LLP for Lowes.

In the past few years, it has been hard for Lowe's to comply with the PUD requirement that "no outside,
unenclosed storage or refuse or merchandise shall be permitted." Now, as a solution, the applicant seeks design
approval for a garden center expansion, to house the expanding merchandise stock.
All existing landscaping affected will be relocated and shitted east, to a new planting area. The garden center
expansion is bound by a 21-ft tall enclosure, made of black wrought iron-like fencing and brick columns with
pre-cast concrete caps. Please refer to the petitioner's informational packet for more detail.
A variance is needed for the reduction in total parking spaces, and this item will be heard at the May 18 BZA

Okay, hopefully this is the last update today! Gary Duncan of DOE has relayed these comments to me:
Kev Bank/Kite PUD amend: DOE is now okay with the detention and the access. However, the commission
should be aware that the petitioner still needs approval from IDEM or IDNR to cross the wetlands mitigation
easeme re re is an agreement that they would not cross the easement for 50 years???
Lowe's garden center expansion: II looks okay, except they still need 2 BMP's for post construction. DOE is
able with this item b ' roved with the condition of final construction document approval from DOE.
