DEPARTMENT REPORT
JUNE 3, 2008
1. Docket No. 08020028 DP/ADCs: The Legacy Towns & Flats
The applicant seeks site plan and design approval for aretail/residential development of 23
buildings with 288 residential units. The site is located southeast of the 7000 block of E. 146` St.
and is zoned PUD/Planned Unit Development.
Filed by Charlie Frankenberger of Nelson &Frankenberger for J.C. Hart Company, Inc.
The applicant seeks site plan and design approval for aretail/residential development of 32 buildings with
288 residential units. The site is approximately 13 acres in size and located within the Village Core Use
Block of the Legacy District. The applicant has prepared a very thorough information packet; please refer
to it for more detail. The Legacy PUD (Z-501-07) was adopted in 2007. The Planned Unit Development

The project was introduced at the April 15 Plan Commission meeting and then sent to the Subdivision
Committee for further review. At the May l2 Subdivision Committee meeting, this project was discussed
at great length and then continued to the June 3 Committee meeting.
May 12 Subdivision Committee meeting comments summary:
1. Incorporate architectural/design features to break up the rears of the buildings, especially buildings #
3 & #4. This can be material changes, wrapping [he Firs[ floor with brick, facade projections/ _~ ~\
recessions, more roofline variations with ridgelines/dormers/skylights, etc.
2. Provide a sketch of a residential building elevation for Building #I. - ~ ~ ~~
3. The parking is adequate and exceeds the PUD ordinance requirements.
4. Try to add more permeable pavers in the large areas of asphalt.
5. Make sure the floor plans and building elevations match up.
6. Verify that lofts that are sprinkled can have a bedroom with no windows..- C~Q~~~
7. The info packet supplement will contain: rear elevations of buildings 3 & 4, a residential building
sketch of Bldg 1, more evergreen trees on the landscape plan, and add more windows to areas of -~f
blank walls. ~~ ~
8. The site will utilize a common trash compactor. _ ~ ~~ ~ ~~~ .

I . Please provide electronic copies of the plans and elevations; PDF or JPG format is preferred.
2. Though not required, please consider using LEED or Green Building practices.
3. Engineering dept: DOE is currently reviewing the plans, but there are no significant issues. An \~
update will be provided at the meeting.
Forestry dept comments: The trees and sewer on Equality Blvd (page 3), I understand, as long as
Engineering and the Utility Department is ok with it because of the depth (IS ft). The row of 9 ~~
crabapples (on page I) between Hopewell Parkway and Testimony Avenue: I would like switched
to a taller canopy native tree such as the American hornbeam; the area is just too narrow for \~
crabapples there. ~~
J5! The petitioner is working withthe Postmaster on the groupings of mail kiosks.
After all questions/concerns are addressed, the Dept. of Community Services recommends the
Committee forward this item to the June 17 Plan Commission meeting with a favorable
recommendation and a condition that the petitioner tables his item if Forestry and Engineering
concerns are not addressed by June 17.
