RE: NOTICE OF CITY CODE VIOLATIONS
Dear Ms. Mackey:
This letter is being provided to inform you of the multiple ongoing Carmel City Code violations
being committed by your company and/or its agents. The following violations have been brought to
our attention.
1. The use of temporary weekend directional signage within the City of Carmel, Indiana.
Pursuant to Section 25.07.01-4 (Prohibited Signs) of the Carmel/Clay Zoning Ordinance,
as incorporated into the Carmel City Code, the following sign(s) are specifically prohibited:
i) Signs which are located upon, over, or in any street or highway right-of-way, except for
official highway signs;
j) Portable signs which are portable or moveable, except as permitted under provisions of
this section.
2. The driving and parking of trucks and other vehicles on City sidewalks and multi -use
paths while placing illegal signs. Pursuant to Carmel City Code Section 6-63:
"No person shall operate any motorized vehicle along any sidewalk."
This letter shall serve as your only warning as to these types of violation. It is imperative that you
discontinue the use and placement of illegal signage and any activity related to the driving and/or
parking on City sidewalks and/or multi -use paths immediately. Future violations will be cited and
prosecuted in Carmel City Court. Please discontinue this illegal conduct no later than February
20, 2009 to avoid further enforcement action.

It appears that neither the Mayor or Doug Haney has provided you with any details on this matter to enable you to
write the letter. While I am not surprised, I am chagrined.
About two months ago, on a Sunday afternoon, I was driving east on 131 st at Town Road when I saw an SUV
parked on our multi -use path at the southwest corner of the intersection. It was facing west on the east bound
path. Attached to the SUV was a steel frame trailer loaded with metal real estate development signs. The driver of
the SUV was picking up the twenty or so signs that were clustered around that quadrant of the intersection. He
had, I presume, decided that the safest way for him to pick up the signs was to drive over the tree lawn and onto
the multi -use path. I would also presume that he did the same for each of the corners and that he did so to put
them up. Those paths are not made for the weight of that combination. Nor is the grass tree lawns intended to be
his access to the path if that is what he is doing. The fact that Redirections finds it needs to drive on our multi -use
paths in order to not tie up traffic while they put these illegal signs in our public ROW is one more reason why the
ordinance needs to be strictly enforced.
I was told the City Attorney was going to write the letter. If your department is to be the author then, at least, copy
the City Attorney on it.
