The property is not part of a PUD (Planned Unit Development) or Overlay District. Single-family dwellings are permitted within the RI district, and two-family dwellings are only permitted within RI district by Use Variance Approval from the Board of Zoning Appeals (see the attached Appendix A: Schedule of Uses). It cannot be determined if the site went through Plan Commission or BZA approval for the buildingluse. However, Permit Number 30-74 was issued, on February 26, 1974, for a two-family dwelling on this site. The use has existed here ever since. Properties abutting the subject site to the south, east, and west are zoned RI/Residential; Westfield is to the north. To the best of our knowledge, the property complies with current setbacks and parking requirements of the Zoning Ordinance of the City of Carmel, and is legally non -conforming. If sections of the current zoning ordinance have been amended and the site has remained unchanged over the years, then it is legal non -conforming or "grandfathered". There are no outstanding zoning or building code violations. The property is not pending a change of zoning. If destroyed, the property can be completely rebuilt in accordance with the zoning ordinance, particularly with Chapters 10 and 28 of the zoning ordinance. The most recently updated, pertinent sections of the zoning ordinance, which spell out setbacks and lot coverage, etc. that apply to the said Property are attached. The concern cited that the property was currently being utilized for multi- family purposes and/or as a duplex. This property is currently zoned residentially (R1). As per Appendix A, Schedule of Uses, of the Carmel/ Clay Zoning Ordinance (see attached), a duplex/multi-family uses are not a permitted use in this zoning district. This department performed an initial site inspection of the subject property and documented evidence of the non -permitted use. This letter shall serve as your first and final notice pertaining to this type of violation.
