Grant of Drainage, Utility and Sewer Easement
Subject to the following, the undersigned owner "Grantor hereby grants to the City of Carmel, Indiono and public utilities with the
proper authorization and franchises from the City of Carmel, Indiana and their successors and assigns (Grantee) a non exclusive
easement under and across those areas shown as D.U. S.E." on this plat ("Easement Areo') for the purpose of the construction,
repair, replacement, maintenance and operation of sanitary sewer, storm sewer, water, electrical, telephone and natural gas lines,
equipment, fixtures and attachments, including surface manholes, underground conduits, pipes and equipment, to provide such utility
service to the property plotted hereby and adjacent property, together with the reasonable right of ingress and egress for the purpose
of access to the Easement Area across those portions of the land plated hereby thot are not now or hereafter improved with
buildings. The easements granted herein shall be subject to the following terms conditions: (o) such easements ore subject to all
easements and encumbrances of record; (b) all lines, equipment, fixtures and attachments placed within the Easement Area by
Grantee, or its agents or contractors, pursuant to this instrument "Grantees Property') shall remain the property of Grantee and
shill be located below ground or at the surface of the Easement Area; (c) Grantor and its successors and assigns retain the right to
full use of the surface and subsurface of the Easement Areo except where Grantee has placed Grantee's Property, provided, however,
Grantor will not erect any building or major structure within the described easement area(s); (d) Grantee shall at all times safely
operate and maintain Grantee's Property within the Easement Areas and shall promptly repair and restore to its prior condition any
paving, parking lot striping or other improvements, (except buildings and other major structures existing within the Easement Areo)
which are disturbed by the construction or maintenance of Grantee's Property by Grantee, or its agents or contractors; and (e)
Grantee shell not in the exercise of its rights hereunder unreasonably interfere or obstruct Grantor, or Grantor's agents or contractors,
in the location or construction of any buildings located in the area adjoining the Easement Area, or unreasonably interfere with any
business of Grantor; provided, however that nothing in this subporograph (e) shall allow Grantor or Grantor's agents or contractors to
construct a building or other major structure within the Easement Area, or to unreasonably interfere with Grantee's rights to
construct, operate and maintain Grantees Property hereunder.
Ingress Egress Easement
Those areas on this plot shown as "Ingress /Egress Esmt.' Are subject to a non exdusive ingress and egress easement as set forth
in that certain Declaration of Restrictions and Easements dated September 5, 2000 and recorded with the recorder of deeds of
Hamilton County, Indiana on September 7, 2000 as Document No. 2000 -44612 as amended by Furst Amendment to Declaration of
Restrictions and Easements doted September 5, 2000 and recorded with the recorder of deeds for Hamilton County, Indiana as
Document No. 2000 44613.
Building Line
All buildings located on the parcel of land plotted hereby shall be setback from boundaries of said parcel by a minimum distance as
indicated by those lines shown on this plat as 'BL' (i.e., building setback line).
This subdivision shall be known and designated as Hazel Dell Corner Lot 4 an addition in
Hamilton County, Indiana.
All streets shown in this Plat and not heretofore dedicated are hereby dedicated to the public.
The real estate described within this plat is hereby platted, subdivided and made subject to these
plat, covenants, conditions and restrictions and is further subject to the terms, definitions and
conditions of a certain declaration of covenants, conditions and restrictions recorded as instrument
in the Office of the Recorder of Hamilton County, Indiana
