RE: CITY CODE VIOLATION —TRASH AND DEBRIS/PROPERTY MAINTENANCE
Dear Sir and/or Madam:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible City Code Violation at 741 Oswego Rd., in the City of
Carmel, a property listed under your ownership. An inspection revealed that the concern
appears to be valid and that the property is in violation of the Carmel City Code, §6-77(k), which
construes the following conditions to be public health nuisances:
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building
materials, machinery, dead trees, or parts thereof, upon any premises in a
residential area.
The investigation resulted in finding tires, discarded furniture, brush, etc., on the
property. Also, an inspection of the dwelling resulted in the determination that a public
nuisance exists due to the condition of the structure. A Public Nuisance shall include
those definitions as defined by Carmel City Code Chapter 6, Article 5 in addition to the
following under Article 8 Property Maintenance Code:
(1) Any physical condition, use or occupancy of any premises or its
appurtenances considered an attractive nuisance to children, including, but
not limited to, abandoned wells, shafts, basements, excavations and unsafe
fences or structures; or,
(6) Any premises which is unsanitary, or which is littered with rubbish or garbage,
or which has an uncontrolled growth of weeds, or,
(7) Any structure or building that is a state of dilapidation, deterioration or decay;
faulty construction; overcrowded; open, vacant, or abandoned; damaged by
fire to the extent as to not provide shelter, in danger of collapse or failure and
dangerous to anyone on or near the premises.

In particular, as set forth in Section (C) Exterior Structure of §6-222 General
Requirements:
(1) General. The exterior of a structure shall be maintained in good repair,
structurally sound and sanitary so as not to pose a threat to the public health,
safety, and welfare.
(2) Protective Treatment. All exterior surfaces, including but not limited to, doors,
door and window frames, cornices, porches, trim, balconies, decks and fences
shall be maintained in good condition. Exterior wood surfaces, other than
decay resistant woods, shall be protected from the elements and decay by
painting or other protective covering or treatment. Peeling, flaking, and
chipped paint shall be eliminated and surfaces repainted. All siding and
masonryjoints as wll as those between the building envelope and the
perimeter of windows, doors, and skylights shall be maintained weather
resistant and water tight. All metal surfaces subject to rust or corrosion shall be
coated to inhibit such rust and contusion. Oxidation stains shall be removed.
All trim and exposed wood needs to painted or coated to make it water proof and weather tight
to prevent further rot or corrosion. And,
(6) Roofs and Drainage. The roof and flashing shall be sound, tight and not have defects
that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration
in the walls or interior portion of the structure. Roof drains, gutters, and down spouts
shall be maintained in good repair and free from obstructions. Roof drain discharges
shall be discharged as a Legal Connection or a Legal Discharge. Inappropriate or
temporary roofing coverings including but not limited to tarps shall be deemed
inadequate protection and not uniform and as such shall be prohibited for a period
exceeding seven (7) consecutive days.
There appears to be severe warping to the decking of the roof, indicating a weakened roofing
system that needs repair. Gutters have also been loosened from their fastening system to the
structure. This is resulting in deterioration and rot to the gutter board(s) which connect the
roofing system to the discharge and drainage system. Please repair all as necessary, as well as
the deteriorated soffit(s).
(12) Window. Skylight, and Doorframes. Every window, skylight door and frame shall be
kept in sound condition and in good repair. And,
(13) Glass. All glass and plexi-glass materials shall be fully glazed and maintained free
from cracks and holes if it is determined by the Code Enforcement Official that such
cracks and holes pose a safety risk.
The window on the left (south) of the back door is broken and has a hanging shard of glass that
poses an immediate health and safety risk. This window needs to be repaired immediately, and
all accompanying windows need to be repaired to good condition..
(16) Doors. All exterior doors, door assemblies and hardware shall be maintained in
good condition. Locks at all entrances to dwelling units, rooming units, and
guestrooms shall tightly secure the door, however no double dead bolts shall be
permitted for the structure's main escape.

Various doors on the structure are unsecured, and/or unattached, and obviously not in good
condition. Please correct violations so that all doors operate in good condition.
Please bring the trashlrubbish issues into compliance by April 25, 2008. Failure to resolve the
violation(s) by the specified deadline will result in further enforcement action by the City of
Carmel, to include City abatement (to which property owner is billed). Please bring the Exterior
Structure/Public Nuisance issues into compliance by June 15, 2008.
