City of Canne 1 DEPARTMENT OF COMMUNITY SERVICES Division of Building and Code Services VIA CERTIFIED MAIL June 30,2009 Maria Socorro and Humberto Salcedo 10529 Cornell Avenue Indianapolis, IN 46280 RE: ZONING ORDINANCE VIOLATION O�� Dear Sir or Madam: This letter is being provided to inform you that our department has recently received some concerns regarding 10529 Cornell Avenue in Clay Township, a property listed under your ownership. This property was inspected on June 29, 2009 and found to be in violation of the rear yard setback provisions as regulated by the Carmel/Clay Zoning Ordinance §25.01.02.B.3.b.i. The ordinance states a minimum setback for an accessory structure, which is located more than ten feet from the principal building, is five (5) feet from the rear and side property lines. The accessory structures appear to have been built within one foot of the rear property line. As such, these two structures are in violation of the Zoning Ordinance. In order to achieve compliance, you may either file for a variance of development standards, which, it approved, could legalize the current location of the existing structures; or, you may move the structures to a location that is at least five feet from the rear property line. Should you wish to apply for the variance, you will need to contact the City of Cannel's Planning Department at 571-2417. A reinspection of the property will be conducted on July 30, 2009. If at that time the structures are not moved and a variance has not been filed, further enforcement action will ensue, including written citations and the requirement to appear in Hamilton County Court. Its lot 21 in the Home Place subdivision, which was originally laid out in 1914, and there are no platted easements. A few sections have platted building lines, but just in the front yards, and not this section. There's an accessory structure in the "easement" (according to the complainant) that I imagine is just an aaccessory structure in the required side yard. Bryan W.
