Surveyor's Report 1. In accordance with Title 865, Article 1, Chapter 12 of the Indiana Administrative Code ("Rule 12 the following observations and opinions are submitted regarding the various uncertainties in the locations of the lines and corners established this survey as a result of uncertainties in reference monumentation; in record descriptions and plats; in lines of occupation; and as introduced by random errors in measurement "Theoretical Uncertainty There may be unwritten rights associated with these uncertainties. The client should assume there is an amount of uncertainty along any line equal in magnitude to the discrepancy in the location of the lines of possession from the surveyed lines. There may be differences of deed dimensions versus measured dimensions along the boundary lines shown hereon and, likewise, there may be found survey markers near, but not precisely at, some boundary corners. In cases where the magnitude of these differences are less than the Theoretical Uncertainty stated below, less than the Positional Tolerance (stated in the certification in the case of an ALTA /ACSM Land Title Survey), and less than the uncertainty identified for the reference monumentation (discussed below), the differences may be considered insignificant and are shown only for purposes of mathematical closure. Such differences that are greater than the Theoretical Uncertainty, Positional Tolerance and the uncertainty in reference monumentation should be considered worthy of notice and are therefore discussed further below. Unless otherwise noted or depicted hereon, there is no evidence of occupation along the perimeter lines of the subject tract. All survey monuments set or found this survey are flush with existing grade unless otherwise noted. If the surveyed tract is bounded on any side by a natural water boundary, it should be noted that such boundary is subject to change due to natural causes and it may or may not represent the actual limit of title. The Theoretical Uncertainty (due to random errors in measurement) of the corners of the subject tract established this survey is within the specifications for a Class B Survey (0. 25 feet) as defined in IAC 865. The within retracement survey was commissioned by the client to locate and monument the lines and corners of the subject real estate and to locate all physical improvements thereon in accordance with the requirements of an ALTA /ACSM Land Title Survey. The within retracement surve is located in the Southeast Quarter of Section 31, Township 18 North, Range 4 East in Hamilton County, Indiana. The basis of bearing for the subject real estate is based upon the South line of the Southeast Quarter being South 89 degrees 50 minutes 55 seconds West per the record deed The section corners recovered this survey consisted of a Harrison monument at the southeast corner of the Southeast Quarter and a brass plug in a box at the southwest corner of the Southwest Quarter of Section 31. Both found monuments matched the Hamilton County Surveyor's reference ties for the corner. The uncertainty associated with the position of these found monuments are negligible. The south line of the record deed was established per said found section corner monuments. The west, north and east lines were established by record deed geometry. The east right -of -way line of Keystone Avenue (U.S. 431) and the north right -of -way line of 116th Street were established per stationing denoted on the State Highway Department Plans for Project Number S165 (13) dated February 24, 1960. The location of the lines and corners established per said right -of -way plans agreed well with a prior survey of the subject site conducted by Kimbley Proctor, Inc. as Job #00130, dated August 28, 2001. All boundary monuments were found within 0.2 feet of their expected position. Therefore uncertainty due to monumentation is 0.2 feet. The north and east adjoining real estate is platted as Maples of Carmel being a Horizontal Property Regime. There are no gaps or overlaps associated with said adjoining plats creating no uncertainty in description. There is a woven wire right -of -way fence along the west line of the subject real estate which varies from 2.9 feet west to 12.6 feet west of the surveyed line. There is a 6 foot tall privacy fence along the north line of the subject real estate which varies from on line to 3.4 feet north of the surveyed line. There is a 6 foot tall privacy fence along the east line of the subject real estate which varies from 1.1 foot east to 4.0 feet east of the surveyed line. At the time of survey, the subject site was mostly snow covered. 2. The accuracy of any flood hazard data shown on this report is subject to map scale uncertainty and to any other uncertainty in location or elevation on the referenced Flood Insurance Rate Map. The within described tract of and lies within Flood Hazard Zone C as said tract plots by scale on Community Panel Number 180081 0008 C of the Flood Insurance Rate Maps for the City of Carmel, Hamilton County, Indiana (maps dated May 19, 1981). 3. Ownership information indicated hereon is as identified in County or Township records or on title work provided by others. 4. The subject tract is zoned B -3 Business per a telephone conversation with a representative of the Area Plan Commission of Carmel, Indiana on February 24, 2004. The setback requirements for B -3 zoning can be variable, transitional and subject to legal interpretation, therefore, setback lines are not depicted hereon. 5. Evidence of source of title for the subject tract was provided in the form of Chicago Title Insurance Company, Commitment No. 000345139, dated September 29, 2003. Some of the items disclosed in Schedule Bli thereof may have been depicted on the survey and are identified by their recording data. Should any additional items need to be depicted on the survey please advise and provide the appropriate documents.
