ORDINANCE D- 1954 -09
AN ORDINANCE OF THE COMMON COUNCIL OF THE CiTY OF CARMEL,
INDIANA AMENDING CHAPTER 2, ARTICLE 4 SFCTION 131 TO TiiE CARMEL
CITY CODE, THEREBY ESTABLISHING THE CITY OF CARMEL
"SUPPORT FOR THE ARTS FUND #504)"
WHEREAS, the Common Council of the City of Carmel Indiana is, pursuant to Indiana
Code 36 4 -6 18, authonzed to pass ordinances and resolutions regarding the control of the City's
finances and the appropriation of money, and
WHEREAS, the Mayor of the City of Cannel, Indiana is, pursuant to Indiana Code
36 4 -5 3(4), authorized to recommend to the Council, in wnting, actions that he considers
propel, and
WHEREAS, the Council annually appropnates money to support arts organizations that
benefit the City s citizens and guests, and
NOW, TiIEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows
Section 1 The foregoing Recitals are incorporated herein by this reference
Section 2 That Chapter 2, Aiticle 4 Section 131 is hereby added to the Cannel City Code
and shall Lead as follows
"Sect 2 -131 Carmel Support For The Arts Fund #504)
(a) There is established a City of Carmel Support Fot The Arts Fund #504)
(b) The Fund shall be funded by monies appropnated from the General Fund, and
used exclusively for the support of the arts and of arts organizations
(c) The Fund shall be administered by the Common Council
(d) When the Mayor determines that a request for a disbursement from the Fund is
appropnate, the Mayor shall submit a written recommendation (the
"Recommendation for such disbursement to the Council Within the

Recommendation, the Mayor shall specify the public benefit provided by the art
project or organization that would receive the Funds
(e) The Council shall, after appropriate discussion and deliberation, adopt or amend
the Recommendation by resolution The Council may not increase the amount of
the disbursement, change the requested recipient or make disbuisement without a
Recommendation from the Mayor
(f) The President Pro Tempore of the Council shall account, by separate line item,
for the receipt and disbursement of all sums to and from the fund
Section 3 That the remaining provisions of Carmel City Code Chapter 2, Article 4 are not
affected by this Ordinance and remain in full force and effect
Section 4 This Fund shall be identified as fund #504)
Section 5 If any portion of this Ordinance is for any reason declared to be unconstitutional
or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so
long as enforcement of same can be given the same effect
Section 6 This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor and such publication as is required by law
