RE: CITY CODE VIOLATION – PUBLIC NUISANCE
Dear Mr. Marthin:
This letter is being provided to inform you that there is some concern regarding the condition of
the property at 22 Rangeline Rd. N, in the City of Carmel, a property listed under your
ownership. A simple site visit was performed on January 27, 2005 in which the following
Carmel City Code violation was documented:
§6-75 Public Nuisances Prohibited. No person shall erect, contrive, cause,
continue, maintain or permit to exist any public nuisance within the City.
§6-76 Public Nuisances Defined. A public nuisance is a thing, act, occupation,
condition or use of property which shall continue for such length of time as to:
(a) Substantially annoy, injure or endanger the comfort, health, repose or
safety of the public; or
(b) In any way render the public insecure in life or in the use of property; or
(d) Unlawfully and substantially interfere with, obstruct or tend to obstruct or
render dangerous for passage any street, alley, highway, navigable body of water
or other public way; or
(e) Is injurious to health, or indecent, or offensive to the senses, or an
obstruction to the full use of property, so as essentially to interfere with the
comfortable enjoyment of life or property.
§6-79 Public Nuisances Affecting Peace and Safety. The following acts,
omissions, places, conditions and things are declared to be public nuisances affecting
peace and safety, but such enumeration shall not be construed to exclude other
nuisances affecting public peace or safety coming within the provisions of §6-76:
(i) All obstructions of street, alleys, sidewalks or crosswalks and all
excavations in or under same, except as permitted by the ordinances of the City of
which, although made in accordance with such ordinances are kept or maintained
for an unreasonable length of time after the purpose thereof has been
accomplished.
(k) All abandoned refrigerators, iceboxes or similar containers from which the
doors and other covers have not been removed or which are not equipped with a
device for opening from the inside by pushing only with the strength of a small
child.

(m) Any sign, marquee or awning which is in an unsafe condition, or which
overhangs any roadway, or which overhangs any sidewalks less than eight feet
above the sidewalk surface.
A survey of the area of “Old Town Carmel” has recently been completed. The area directly in
front of your building is located within the City’s right-of-way of Rangeline Rd. It is a violation of
the Code of the City of Carmel to use the right-of-way for any personal or business use. No
products related to your business may be displayed or temporarily stored in front of your building
at any time. The products stored in the rear of your building should either be stored inside the
structure or placed within the dumpster. Additionally, the awning frame that is attached to the
building is also located within the City’s right-of-way. Either remove the frame from the building
or apply for an encroachment permit from the Engineering Department.
