Kocinski 11421 Washington Blvd. Carmel, Indiana 46032 RE: ZONING ORDINANCE VIOLATION Dear Mr. & Mrs. Kocinski: This letter is being provided to inform you that our department has recently received some concerns regarding 11421 Washington Blvd., in the City of Carmel, a property listed under your ownership. This property was inspected on February 14, 2005 and found to be in violation of the permit requirements and the side yard setback provisions as regulated by the Carmel/Clay Zoning Ordinance §25.01.B.3. The ordinance states a minimum setback for an accessory structure is five (5) feet from the property line or the drainage and utility easement plus three (3) feet. The accessory structure appears to be only two (2) feet from the property line. The accessory structure is located within the easement and appears to be blocking the natural flow of water thus causing a serious problem on abutting properties. Additionally, the parking and/or storage of commercial trailers on the property is not a permitted use on residentially zoned property. Home occupations are allowed to exist on residentially zoned properties but, the nature of the home occupation standards is to allow a home business to operate with NO visible evidence or impact upon the property’s residential character. Activities such as commercial vehicles (enclosed trailers) stored upon the property violates these regulations. There is a certain impracticality of attempting to run a construction business in a residential neighborhood in a way that would not impact the residential character, much less have no visible exterior evidence of the business when the business requires the storage of business related equipment, regardless of whether or not they are stored indoors or outdoors. Also recreational vehicles cannot be located next to a property line. §25.04 states: Recreational vehicles may not be stored any closer to a lot line than three (3) times the maximum height of the recreational vehicle, except when completely enclosed. ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 Please obtain the required permit and have the location of the accessory structure changed to gain compliance, remove the trailers from the property and relocate the recreational vehicle within ten (10) days of the receipt of this letter.
