RE: ZONING ORDINANCE VIOLATION – LAND USE
Dear Ms. Seat:
This letter is being provided to inform you that our department has recently received some
concerns regarding 3717 97th St. W, in the City of Carmel, a property listed under your
ownership. The concern cited that a junk yard was being operated from the property. As
per Appendix A, Schedule of Uses, of the Carmel/ Clay Zoning Ordinance (see attached),
a junk yard is not a permitted use in an S1 (residential) zoned district.
Junk Yard – Any place at which personal property is or may be salvaged for reuse,
resale or reduction or similar disposition and is owned, possessed, collected,
accumulated, dismantled or sorted, including, but not limited to used or salvaged base
metal or metals, their compounds or combinations; used or salvaged rope, bags, paper,
rags, glass, rubber, lumber, millwork, brick and similar property, except animal matter; and
used motor vehicles, machinery or equipment which is used, owned or possessed for the
purpose of wrecking or salvaging parts therefrom.
This department performed an initial site inspection of the subject property on February
10, 2005. During that inspection unlicensed vehicles, dismantled vehicles, auto parts and
miscellaneous junk, trash and debris were observed on the property. The items
discovered on the property provide the evidence necessary to require this office to take
enforcement action. All of the items mentioned must be removed from the property and
this activity discontinued permanently. Failure to comply with this request may result in
further enforcement action, which may include litigation and fines assessed by the court.
