A. Franke's Subdivision, an Addition in Hamilton County, Indiana, as per plat thereof recorded in Deed Record 128, Page 197, in the Office of the Recorder of Hamilton County, Indiana. UPON COMPLETION OF THIS SURVEY, OUR CLIENT ASKED US TO PREPARE A LAND DESCRIPTION FOR A PORTION OF THE ABOVE DESCRIBED REAL ESTATE AND IT IS AS FOLLOWS: Outlot "13" in Providence at Old Meridian, as per plat thereof recorded in Instrument Number 2003 118575 in Plat Cabinet 3, Slide 300, all of Lot numbered 10, and a part of Lots numbered 11 and 12 in R. A. Franke's Subdivision, an Addition in Hamilton County, Indiana, as per plat thereof recorded in Deed Record 128, Page 197, in the Office of the Recorder of Hamilton County, Indiana, more particularly described as follows: Beginning at the Northeast corner of said Outlot "B said corner being marked by a 5/8" rebar with cap stamped "S A Finn #0008" (hereafter referred to as a S A rebar); thence South 00 degrees 13 minutes 50 seconds West along the East line of said Outlot "B" a distance of 73.87 feet to a point on a curve concave northeasterly, the radius point of said curve being North 23 degrees 20 minutes 03 seconds East 750.00 feet from said point, said point also being the Southeast corner of said Outlot "B thence northwesterly along the Southwesterly line of said Outlot "B the northwesterly extension thereof, and said curve 157.88 to the point of tangency of said curve, said point being South 35 degrees 23 minutes 42 seconds West 750.00 feet from the radius point of said curve; thence North 54 degrees 36 minutes 19 seconds West 271.77 feet to a point on a curve concave westerly, the radius point of said curve being North 77 degrees 13 minutes 31 seconds West 130.00 feet from said point; thence northerly along said curve 100.05 feet to the southeasterly right -of -way of Old Meridian Street and the point of tangency of said curve, said point being North 58 degrees 40 minutes 52 seconds East 130.00 feet from the radius point of said curve; thence North 36 degrees 03 minutes 41 seconds East along said southeasterly right -of -way line 140.05 feet to a S A rebar on the North line of said Lot 10; thence North 89 degrees 03 minutes 12 seconds East along said North line 294.01 feet to a S A rebar at the Northeast corner of said Lot 10; thence South 00 degrees 13 minutes 50 seconds West along the East line of said Lots 10, 11, and 12 a distance of 375.21 feet to the place of beginning, containing 2.717 acres, more or less, subject to all legal highways, rights-of-ways, easements, and restrictions of record. I further certify that there are no buildings on the above described real estate and that the buildings located on the adjoining property do not encroach upon said real estate, except as indicated. Items 7, 8, 14, 23, and 25 of the Schedule B F. Special Exceptions of the abovementioned title commitment encumber the subject real estate. Item 9 of the Schedule B F. Special Exceptions of the abovementioned title commitment, a 100 foot front building setback line has not been depicted on the survey, but rather the building set back lines as per the Carmel/Clay Zoning Ordinance. The documents for items 11, 12, 13,15 of the Schedule B F. Special Exceptions of the abovementioned title commitment have not been provided to the survey and thereof have not been examined as a part of this survey. Item 16 of the Schedule B F. Special Exceptions of the abovementioned title commitment does not encumber the subject real estate. All other items of the Schedule B F. Special Exceptions of the abovementioned title commitment that could be plotted on the within survey have been depicted. Said survey is recorded as Instrument Number 2003- 121747 in the Office of the Recorder, Hamilton County, Indiana. Reference: A Retracement Survey preformed by Weihe Engineers, Inc., certified by Michael L. DeBoy, R.L.S. No. S0539, and dated July 7, 1995. Weihe Engineers, Inc job number 95 -744. Reference: An ALTA/ACSM Land Title Survey preformed by Mid States Engineering, L.L.C., certified by Bryan F. Catlin, R.L.S. No. 910012, and dated April 18, 2000. This is both an original and retracement survey of Outlot "B" in Providence at Old Meridian, as per plat thereof recorded in Instrument Number 2003 -1 18575 in Plat Cabinet 3, Slide 300, and Lots numbered 10, 11, and 12 in R. A. Franke's Subdivision, an Addition in Hamilton County, Indiana, as per plat thereof recorded in Deed Record 128, Page 197, in said Recorder's Office. The last day of field work was performed on September 15, 2008. The original portion of this survey refers to the creation of Tract "A Our client requested that Tract "A" include all of said Outlot "B" and to be bound by the North line of Lot 10, the East line of Lots 10, 11 and 12, the Southeasterly Right-of-Way line of Old Meridian Street, and the proposed Northeasterly Right-of-Way lines of a future boulevard. The location of the corners and the lines of the subject real estate is dependent upon the location of the perimeter of the Northwest Quarter of the Southeast Quarter of the Southeast Quarter of Section 26, Township 18 North, Range 3 East and the location of the Southeasterly Right-of-Way line of Old Meridian Street. The perimeter of the Northwest Quarter of the Southeast Quarter of the Southeast Quarter of Section 26, Township 18 North, Range 3 East and the location of the Southeasterly Right-of-Way line of Old Meridian Street were established during the abovementioned ALTA/ACSM Land Title Survey preformed by Stoeppelwerth and Associates Inc. and were utilized for this survey. The reference monuments for the Quarter Section corners were found in place per Hamilton County Surveyor's Reference ties as shown and are discussed in grated detail in the below section labeled "Availability and condition of reference monuments." No Hamilton County Surveyor's Reference ties were available for the Southeast corner of said Southeast Quarter Section. The abovementioned surveys performed by Mid- States Engineering, L.L.C. and Paul I. Cripe, Inc. found and accepted a 4" x 6" stone (10" down) as said corner. However, during our investigation of said corner, several stones, laths with ribbon and a 6" x 6" wooden fence post were found in the vicinity of said corner. Since it was uncertain which stone was the reference monument, the position of said corner was established by best fitting the boundary of the abovementioned Boundary Survey preformed by Paul I Cripe, Inc., (Job No. 010394- 30400) to monuments found along the perimeter of said boundary. The uncertainty in this corner is unknown. The 6" x 6" wooden fence post lies 0.2 feet North and 1.5 feet West of the calculated position of said corner. The breakdown of said Southeast Quarter Section was calculated as shown hereon. The Northeast Quarter of the Southeast Quarter of the Southeast Quarter of said Section 26 consist of Lots 9 through 15 and the platted right -of -way of Old Meridian Street as established by the Plat of the R.A. Franke's Subdivision. Surpluses and/or deficiencies within said Northeast Quarter Quarter Quarter Section were prorated among said platted lots and is shown in detail on the abovementioned ALTA/ACSM Land Title Survey preformed by Stoeppelwerth and Associates Inc. SURVEYOR'S REPORT In accordance with Title 865, Article 1, Chapter 12, Section 1 through 29 of the Indiana Administrative Code, the following observations and opinions are submitted regarding the various uncertainties in the locations of the lines and corners established on this survey as a result of: A. Availability and condition of reference monuments: A PK Nail was found and accepted at the Northwest corner of the Southeast Quarter of said Section 26 per the Hamilton County Surveyor's Reference ties. Said PK Nail was found at the surface and has been in place for more than five years. A PK Nail was found and accepted at the Northeast corner of the Southeast Quarter of said Section 26 per the Hamilton County Surveyor's Reference ties. Said reference ties call for an "I.P. Set however said PK Nail was found at the surface and has been in place for more than five years. A PK Nail was found and accepted at the Southeast corner of the Southeast Quarter of said Section 26 per the Hamilton County Surveyor's Reference ties. Said reference ties call for an "I.P. Set however said PK Nail was found at the surface and has been in place for more than five years. The abovementioned surveys performed by Stoeppelwerth and Associates Inc., Paul I. Cripe, Inc., Weihe Engineers, Inc,, and Mid States Engineering, L.L.C. were all utilized in solidifying the location of the section corners. There may be references made to monuments found at or near the corners, or along the deed lines of the subject real estate. In cases where the monument is not exactly in agreement with this survey but within the relative positional accuracy of the measurements this survey, no new monument was set because the difference is deemed insignificant; the difference is shown to accentuate the uncertainty of that corner. In those cases where the difference is greater than the relative positional accuracy and uncertainty in referenced monuments, cautions should be exercised before making any improvements along those lines affected. Those uncertainties considered to be significant are discussed below. B. Occupation or possession lines: The possession along the North and East lines of the subject real estate is to a dilapidated fence. The possession along the Northwesterly line of the subject real estate is to the street improvement of Old Meridian Street. Unless specifically discussed above, there are no other observed lines of occupation. Existing monumentation and fence lines for adjoining tracts were found as shown on this survey. C. Clarity or ambiguity of the record descriptions used and/or adjoiner's descriptions: Unless discussed above, there are no discrepancies between the record land descriptions of the subject real estate and the adjoiners. Similarly, the lines of the subject real estate are contiguous with the adjoiners' lines. A title company and/or legal council should be consulted regarding all gap and overlap areas. D. The relative positional accuracy of the measurements: The relative positional accuracy (due to random errors in measurement) of the corners ofthe subject real estate established on this survey is within the specifications for an Urban Survey (0.07 feet plus 50 parts per million) as defined in IAC 865. E. Positional uncertainty: As a result of the above observations, it is my opinion that the uncertainties in the location ofthe lines and corners established on this survey are as follows: Due to variances in reference monuments: 1.8 feet North -South and 2.3 feet East -West Due to Discrepancies in the record descriptions:. None Found Due to Inconsistencies in lines of occupation: EQUAL to the differences shown between the property line evidence found and the property lines established by this survey.
