RE: ZONING ORDINANCE VIOLATION — LAND USE
Dear Sir or Madam:
This letter is a follow-up to the concerns raised about the property at 506 Smokey Row Road, in the City
of Carmel, a property listed under your ownership. This property is currently zoned residentially (R1),
which does not permit for business operations to be run from the property, except for in strict, very low -
intensity situations, provided for in the Home Occupation standards of the Carmel Clay Land Use
Regulations (§25.18) and the Sign Ordinance (§25.07.02-03- see Enclosed).
The nature of the home occupation standards is to allow a home business to operate with NO visible
evidence or impact upon the property's residential character. Activities such as vehicles being used to
store materials, yard signage, and storage of materials around the property violate these regulations.
There is a certain impracticality of attempting to run a construction business in a residential neighborhood
in a way that would not impact the residential character, much less have no visible exterior evidence of
the business when the business requires storage of machinery, vehicles, and materials, regardless of
whether or not they are stored indoors or outdoors.
Inspections were performed of the property on numerous dates in August and September of 2009. On
those occasions a pick up truck that was being used to store building materials and debris was repeatedly
seen parked outside of the garage on the property. Additionally, there has been a large yard sign
advertising for contracting work along the property's Smokey Row Road frontage, and the driveway of the
property has been observed with varying amounts of construction materials and debris present. All of
these are violations of the Ordinance and must be corrected by the removal of the equipment, the
materials and the sign from the property. Failure to abide by the conditions of the Ordinance will result in
additional enforcement action, including written citations and the requirement to appear in Carmel City
Cou rt.

RE: CITY CODE VIOLATION — CONDITION OF PROPERTY
Dear Sir or Madam:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible City Code Violation at 506 Smokey Row Road W, in
the City of Carmel, a property listed under your ownership. An inspection revealed that the
concern appears to be valid and that the property is in violation of the Carmel City Code, §6-
77(k), which construes the following conditions to be public health nuisances:
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building
materials, machinery, dead trees, or parts thereof, upon any premises in a
residential area.
Please bring the condition of this property into compliance with the Carmel City Code by
removing the rubbish and debris no later than August 9, 2009. Failure to resolve the
violation(s) by the specified deadline may result in further enforcement action by the City of
