Sign Ordinance at the time that they apply for the sign. Seconded by Mr. Boone. Mrs. McMullen questioned if residents across the street had been notified as requested. Mr. Senefield said that they had and that neither property owner has responded to their letter as of this date. Mrs. Litvan said that some date should be set after which, if they have not responded, the'petitioner is not responsible for providing these plantings. Mrs. Litvan suggested that this should be stated in the motion. Mr. Senefield said the projected date of occupancy is for late fall or early winter of 1983. Mr. Boone amended the motion to include if there has been no response to the letters 60 days from todays date, the petitioner is not respons- ible for providing plantings, and with another notice to be sent out. Seconded by Mr. Story. Mr. Senefield said that, if it is the Commission's request, he will notify the two property owners again by registered mail. Mr. Terry said he feels that sufficient notice has been given to the property owners. Mr. Senefield said he would like to give the property owners two weeks. Mr. Terry moved to amend the motion to include that, if the petitioner does not hear from the property owners in two weeks, the matter of the plantings is closed. Seconded by Mrs. McMullen Motion carried. K. New Business Page 2 lk. Commission to consider Sign Application for Hunan Gourmet, 2340 E. 116th St. (formerly Charcoal Steak House) in Keystone Square and B -4 zoning. Proposed sign larger than allowed by Carmel Sign Ordinance. Proposed sign is 40' x 4' or 160 sq. ft. Sign allowed by Ordinance is 50 sq. ft. Design, color and logo conform to Key- stone Square Sign Package. Also to be determined is if the current sign can is grandfathered as to size allowed. If it is not, a Variance will be required. Filed by Jack Johnson and Harold Eggars for Hunan Gourmet. Mr. Eggars made the presentation. A sign rendering was passed to members. Mrs. McMullen questioned why the Commission is looking at this sign when last month a Sign Package for this area was passed by the Commission stating that if this sign conformed to the ordinance requirement and was only oversized, that only the BZA would look at the matter. Mr. Eggars said they are before the Commission because they feel that the sign is grandfathered- a legal non conforming issue. Mrs. Litvan said that, if this sign was erected for the original Sign Ordinance in 1973, then it is grandfathered. Mr. Eggars cited page 22 of the Sign Ordinance, paragraph 25- Non -Con- forming Signs. Mr. Eggars said they were not advised on certain dates, as stated in the ordinance, that these signs are non- conforming and they feel that they are a legal non conforming sign in Keystone Square. Mr. Eggars said they feel they are not changing the sign. The can re- mains the same and they are only changing the copy. The rendering passed to members shows the copy to be in the can and Mr. Eggars stated that he cannot get a permit from Mr. Kiphart to put in this new copy. Mrs. Litvan explained the circumstances for the former Estridge sign and lights there, stating that a Variance was granted for the sign to say CARMEL PLAN COMMISSION MINUTES JANUARY 18, 1983 Page 3 55 "Estridge's Charcoal Steakhouse but that she does not recall whether the Variance was granted for the can to stay on the building. It will be necessary to pull the file in order to determine the matter. (Mr. Kiphart went to City Hall for the file) Mrs. Badger questioned ownership of the sign cans. The Commission will continue this issue with Mr. Eggars later in the meeting, at the end of the agenda, when Mr. Kiphart returns with the necessary information regarding the former Variance. 2k. Commission to consider Architectural Design, Lighting and Signage Sign Approval for proposed Standard Food sign completely different than approved Sign Package for Keystone Square Shopping Mall, locat- ed where Green Basket Food Store was in Keystone Square Shopping Mall, 116th Street side. a. larger than allowed. b. individual letters not a box sign. c. not trapezoidal in shape. d. logo is larger than allowed. e. different colors than approved in Sign Package. Filed by Robin Arnold for Standard Food Stores. Mr. Jim Nelson made the presentation. Ms. Robin Arnold and Bill Chance, from the Real Estate division, were present. Mr. Nelson related that items d and e in the agenda can be eliminated. A rendering of the 26,400 sq. ft. building with signage in place was shown. The ordinance allows 90 sq. ft. of signage for this location. Mr. Nelson said they request a Variance because this space was intended for an anchor tenant for the center and they feel they should have identi- fication available to them the same as their competition in the community has. Also, they feel they need identification as a new competitor in the Carmel market. They are 631 ft. back from 116th St. and unless the Variance is granted they will not have the visibility needed. Robin Arnold explained the sign dimensions. Mr. Gundersen questioned why the Commission is hearing this request for a Variance. Mr. Merrill related that we are looking at the architectural design. Ms. Arnold passed a photo to show what the sign will look like and stated that it will be smaller than the former Marsh or Green Basket signs. Letters are to be 48" and 58" high and the sign will be internally lighted. The sign will have a dark background with ivory letters. Mrs. Badger questioned logo size. The logo size does not meet ordin- ance requirements. Mr. Merrill said the purpose tonight is to give an opinion on archi- tectural design. Mrs. McMullen moved to suspend the rules and vote on this item this evening. Seconded by Mr. Terry. Motion carried. Mr. Terry moved to approve the architectural design. Seconded by Mrs. McMullen. Mrs. McMullen stated she feels that looking at this this evening has been a waste of time and of no help to the BZA. Mr. Gundersen asked how many signs in the center are not trapezoidal. Mr. Nelson said Target, Haag and the former Green Basket. Mr. Kiphart stated that he feels the signs approved should meet the previously approved Sign Package for Keystone Square. Ballots were cast. Commission to consider Architectural Design, Lighting and Sign Appli- cation for Jim Dandy Restaurant to be located at 715 E. Carmel Drive (formerly Sambo's) in B -4 zoning. Sent to Industrial and Commercial Committee for review and report. Filed by Harry Reasner, Jr. for Jim Dandy. Mr. Reasner was present. Mrs. Litvan gave the Industrial and Commercial Committee report (which is a part of the official minutes and attached to the master copy). The committee recommended approval, but Mrs. Litvan felt it was necessary to address the directional sign, and Mrs. Litvan so moved. Seconded by Mr. Boone. Discussion followed. The vote was unanimous for approval. 3h. Commission to consider Docket No. 16 -82 Z, Rezone Application for 7.75 acres located at S.E..corner of 116th St. and Range Line Rd. (surrounding Mobil Oil Co.), from R -1 to B -5 classification. Sent to Land Use and Technical Advisory Committees for review and report. Filed by Robt. Hughes for T.K. Stevens and 4.R. Fisher. This item was tabled at the petitioner's request until the February subcommittee and regular meetings. I. New Business li. Commission to consider Amendment to Final Plat for Winterwood Sub- division concerning relocation of easement for access to common area. Filed by Chris White for Mid States Engineering. Mr. White made the presentation. Agreement modifying covenants and restrictions for Winterwood was presented to members. Amendments were given and explained. Mr. White requested approval. Mr. Merrill asked to be excused from this petition. Mr. Gundersen chaired and Mrs. Litvan moved to approve this item subject to Technical Advisory Committee approval and that their approval be placed in the TAC minutes. Seconded by Mrs. Badger. Motion carried. 3i. Commission to consider Sign Package for two outlying buildings of Keystone Square Shopping Center. The buildings involved are south- east of mall. Filed by Harold Eggar for Keystone Square Shopping Center. Mr. Eggar made the presentation for signage to be trapezoidal, cream and brown in color and to the disgression of the Sign Ordinance and the Department of Community Development. Mr. Eggar related that item 2i, Sign Application for Hunan Gourmet, meets these requirements. Mr. Eggar requested that, if the signs on the strip buildings meet the Ordinance, trapezoidal configuration, color schemes- that the Director of Community Development be authorized to issue a permit for that sign. Mrs. Litvan stated she feels that this is an excellent idea and that there is need for the record to get a sign package approval by the Commission. Mrs. Litvan moved to accept as a sign package for Keystone Square Shop- ping Center, that is not already dealt with by the Variance which is on
