SURVEYORS REPORT
In accordance with Title 865, Article 1.1, Chapter 12, Sections 1 through 19 of the
Indiana Administrative Code, the following observations and opinions are submitted
regarding the various uncertainties in the locations of the lines and corners
established on this survey as a result of:
A) Variances in the reference monuments;
B) Discrepancies in record descriptions and plats;
C) Inconsistencies in lines of occupation and;
D) Random errors in measurement (Theoretical Uncertainty)
A.) This is a survey of a part of the Northwest Quarter of Section 7, Township 17
North, Range 3 East of the Second Principal Meridian, Hamilton County, Indiana. The
following section corners were used to control this survey: the Northeast Corner of
said Northwest Quarter (a railroad spike found) and the Southeast Comer of said
Northwest Quarter (a capped rebar found). The aforementioned section corners were
found referencing the various plat of West Carmel Center and the housing
subdivisions along the East Line of said Northwest Quarter. These points were
accepted as being the "true" corners.
B) Record descriptions of the adjoining tracts were obtained from the Hamilton
County Recorder's Office (latest research date October 9, 2002) between the lines
of this surveyed parcel and its adjoiners. The following observations are made as a
result of this retracement survey:
1.) This is a survey of a newly created parcel description, owner of record, Fred C.
Wurster, Paul W. Sweeney and 421 Realty Company, Inc. (shown on this survey as a
portion of Instrument Numbers 97099729899, 9709729900 and 9909931338).
2.) There are no gaps or overlaps between this site and its northwestern adjoiner,
Fred C. Wurster, 421 Realty Company, Inc. (shown on this survey as the balance of
Instrument Numbers 97099729899, 9709729900 and 9909931338).
3.) There are no gaps or overlaps between this site and its southwestern adjoiner,
the right -of -way for Commerce Drive, the Board of Commissioners of Hamilton
County, Indiana (shown on this survey as Instrument Number 9809836325).
4.) There is a gap between this site and its southeastern adjoiner, the right -of -way
of Carwinion Way, the Board of Commissioners of Hamilton County, Indiana (shown
on this survey as Instrument Number 9809836325). This street right -of -way was
realigned from its former location.
5.) There are no gaps or overlaps in deed between this site and an eastern
adjoiner, Ashbrooke Section 4 (shown on this survey as Instrument Number 94
40467, Plat Cabinet 1, Slide 468).
6.) There are no gaps or overlaps in deed between this site and an eastern
ad joiner, Jay and Jane Ellen Teeter (shown on this survey as Instrument Number
9909903888).
C) Significant inconsistencies in the lines of occupation were observed during this
survey.
1.) The fences along the eastern boundary are as shown herein.
2.) There is a 27 -inch reinforced concrete storm pipe traversing the southwestern
portion of this site (as shown) apparently not within an easement known to me.
3.) There is a drainage manhole with an 18 -inch reinforced concrete pipe along the
southern boundary and a 12 -inch reinforced concrete pipe along the eastern
boundary apparently not within an easement.
4.) There is a telephone pedestal, electric transformer and a cable television
pedestal, all with underground cables, encroaching upon the southeastern portion of
this site apparently not within an easement known to me.
D) The Theoretical Uncertainty (Due to Random Errors in Measurement) of the
corners of the subject tract established by this survey is within the specifications
for a Class C Survey (0.50 feet) as defined in IAC 865.
As a result of the above observations, it is my opinion that the uncertainties in the
locations of the lines and corners established on this survey are as follows:

Basis of Bearing System: The bearing of the East Line of the Northwest Quarter of
Section 7, Township 17 North, Range 3 East was assumed to be South 00
degrees 25 minutes 52 seconds East as per the provided description for this site.
NOTE: This plat of an ALTA /ACSM Land Title Survey represents the conditions at the
date of latest field activity.
Date of Latest Field Activity: November 25, 2002
NOTE: There is no ongoing construction in, on or around this site at the time of
this survey.
NOTE: To the best of my knowledge, there are proposed changes in street
right -of -way lines associated within this site. (See Note B -4 of this report) There
was no observable evidence of recent street or sidewalk construction or repairs.
NOTE: There was no evidence observed during the course of this survey that this
site is or was being used as a sump, dump or sanitary landfill.
This plat of an ALTA /ACSM Land Title Survey was performed without benefit of a
commitment for title insurance and may or may not reveal all of the facts
associated with this site.
There are no: (i) encroachments upon the subject property by improvements on
adjacent property; (ii) encroachments on adjacent property, streets or alleys by
improvements on the subject property; (iii) no party walls; or (iv) no visible and
apparent conflicts or protrusions, except as shown and noted herein.
NOTE: According to the Federal Emergency Management Agency, Flood Insurance Rate
Map having Community Panel Number 180082 0015 E, with an effective date of
March 2, 1981 and last revised September 24, 1982, this site lies entirely within
Zone "C" (areas of minimal flooding).

This is to certify that this map or plat and the survey on which it is based were
made in accordance with "Minimum Standard Detail Requirements for ALTA /ACSM
Land Title Surveys," jointly established and adopted by ALTA, ACSM and NSPS in
1999, and includes Items 1 -16 of Table A thereof. Pursuant to the Accuracy
Standards as adopted by ALTA, NSPS, and ACSM and in effect on the date of this
certification, undersigned further certifies that proper field procedures,
instrumentation, and adequate survey personnel were employed in order to achieve
results comparable to those outlined in the "Minimum Angle, Distance, and Closure
Requirements for Survey Measurements Which Control Land Boundaries for

Part of the Northwest Quarter of Section 7, Township 17 North, Range 3 East
located in Clay Township, Hamilton County, Indiana being bounded as follows:
BEGINNING at a point on the East Line of the Northwest Quarter of Section 7,
Township 17 North, Range 3 East, said point of beginning being South 00 degrees
25 minutes 52 seconds East (assumed bearing) 446.86 feet from the Northeast
Corner of said Northwest Quarter; thence South 00 degrees 25 minutes 52 seconds
East 418.37 feet along the East Line of said Northwest Quarter to the northeastern
corner of the 0.047 acre portion of Block G of West Carmel Center as per plat
thereof recorded as [insert recording information] by the Recorder of Hamilton
County, Indiana, said point being on a non tangent curve concave to the southeast
and being North 25 degrees 09 minutes 19 seconds West 257.38 feet from the
radius point of said curve, the following three courses are along the northern
