COPY 10602 N College Ave Indianapolis, IN 46280 RE: ZONING ORDINANCE VIOLATION —TEMPORARY SIGN(S) / RIGHT-OF- WAY SIGNAGE Dear Sir or Madam: This letter is being provided to inform you that a temporary sign(s) violation has been brought to this department's attention. The sign(s) advertises for 10602 North College Avenue in Home Place, a property listed under your ownership. BUSINESSES ARE NOT PERMITTED TO DISPLAY TEMPORARY SIGNS, regardless of whether or not the sign is located on the business's premises. According to Section 25.07.01-4 Prohibited Signs, of the Carmel/Clay Zoning Ordinance the following sign(s) are prohibited: (f) Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light bulbs, spinners or similar devices, unless they are permitted specifically by other sections of this Ordinance. Furthermore, the property is in violation of Carmel Zoning Ordinance for signs in the right-of-way of 106`" Street. Section 25.07.01-04 (i) reads: 25.07.01-04(i) Prohibited Signs Signs which are located upon, over, or in any street or highway right-of-way except for official highway signs. This letter shall serve as the first and final warning for this ty�e of violation. Please remove the illegal banners and the sign in the right-of-way of 106 Street by October 16, 2009. If the signs are not removed by that date, the City of Carmel will pursue additional enforcement action, including removal of the sign from the right-of-way and written citations.
